I / AN ORDINANCE PROHIBITING "FAKE SALES"; DEFINING CERTAIN TERM6 USED ON CONNECTION HEREWITH; PROVIDING A PENALTY FOR VIOLA- TION HEREOF; PROVIDING A SAVINGS CLAUSE; AND REPEALING ALL LAWS OR PARTS OF LAWS IN CONFLICT HEREWITH. i BE IT ORDAINED BY THE CITY COMvIISSION OF THE CITY OF DANIA, FLORIDA: Section 1: It shall be unlawful for any person, firm i or corporation to conduct, maintain, operate or advertise at retail any fake sale of goods, wares or merchandise within the City of Dania, Florida. f Section 2: For the purpose of this ordinance, a fake sale is hereby defined to be: 1 (a) The sale of goods, wares or merchandise at i j auction or otherwise, to agents or other persons purchasing the same for or on behalf of the owner or other person interested i in the sale thereof. (b) The sale of goods, wares or merchandise, or the offering of goods, wares or merchandise for sale in limited quantity or quantities of less than the full amount of such merchandise carried in retail stock on the premises by the person, firm or corporation offering the same for sale. (c) The sale or offering for sale of goods, wares or merchandise of a different quality or brand or bearing a different trademark as a substitute for merchandise previously advertised for sale. (d) The sale or offering for sale of any goods, wares or merchandise misrepresented as to quantity, quality, brand or otherwise. (e) The sale or offering for sale of any goods, i wares or merchandise which is contingent upon the concurrent purchase or sale of any other article. I Section 3: Any person, firm, or, in the case of a 1 corporation the officers thereof, violating any of the provisions .1_ I /000, of this ordinance shall, upon conviction, be punished by fine not exceeding five hundred dollars ($500.00) or by imprisonment not exceeding thirty (30) days, or by both such fine and im- prisonment. Each such person, firm or corporation shall be deemed i guilty of a separate offense for every day during any portion of which any violation of any provision of this ordinance is corn- ; mitted or continued or permitted by such person, firm or corpo- ration, and shall be punishable therefor as provided by this ordinance. 1 Section 4: In the event any section, sub-section, i sentence, clause, or phrase of this ordinance shall be declared or adjudged to be invalid or unconstitutional, such adjudication shall in no manner affect the remaining portion hereof which i shall remain in full force and effect as if such invalid or un- constitutional section, sub-section, sentence, clause or phrase had not originally been a part of this ordinance. 1 Section 5: All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the I extent of such conflict. jSection 6: This ordinance shall be in force and take r effect immediately upon its passage and adoption.
