AN ORDINANCE CREATING THE POSITION OF A CITY
ROOF AND SHEET METAL INSPECTOR FOR THE CITY
OF DANIA, FLORIDA, AND PROVIDING A WAY AND
MEANS FOR THE INSPECTOR OF ROOFS, ROOFING
MATERIALS, AND SHEET METAL WORK, FABRICATION
AND APPLICATION OF ROOFS, AND SHEET PETAL
WORK BY A CITY ROOF AND SHEET I'MAL INSPECTOR,
AND PROVIDING FOR THE ISSUANCE OF PERMITS AND
FEES THEREFOR, PROVIDING PENALTIES FOR THE
VIOLATION OF THIS ORDINANCE, AND DECLARING
THIS ORDINANCE TO BE AN EMERGENCY M.ASURE;
PROVIDING IF ANY SECTION OF THIS ORDINANCE
BE DECLARED UNCONSTITUTIONAL IT SHALL NOT
AFFECT THE REMAINING SECTIONS AND PROVIDING
THAT THIS ORDINANCE SHALL BECOI-iE EFFECTIVE
UPON ITS PASSAGE, AS PROVIDED BY LAW.,
BE IT ORDAINED BY THE CITY CO10111ISSION OF THE CITY
OF DANIA, FLORIDA:
Section 1: That for the better protection of lire
and property, and in the interest of public safety and welfare,
and for the enforcement of the ordinances of the City of Dania,
Florida, as same relate to the fabrication and application of
roofs, and roofing materials, and sheet metal work, there is
hereby established and created the position of City Roof and
Sheet Metal Inspector within the Building Division of the City
` of Dania, Florida, which position shall be filled to the

Charter requirements of the City of Dania, Florida; and his

duties shall be such as are prescribed and laid down by this
ordinance, which are as follows:
1 (a) To make an inspection of any and all fabri-
cation and application of roofs and roofing materials, and
repairs to roofs, and sheet metal work, in the City of Dania;
to ascertain if the established rules and regulations have been

complied with, as well as any other provisions in the City
Building Code with reference to the fabrication and application
of roofs, and repairs, sheet metal work, and to report any vio-
lation to the Chief Building Inspector of the City of Dania,

(b) To recommend or disapprove to the Chief
Building Inspector of the City of Dania, Florida, all applica- I

tions for a permit to engage in the business of building and/
or repairing, or fabricating, or application of roofs, or sheet
metal work, in the City of Dania, Florida, before same shall be
issued to any person, persons, firm or corporation, making
application for such permit or permits.
(c) The aforesaid City Roofing and Sheet Metal
Inspector to be provided with assistants or deputies as may be
required to give adequate and prompt inspections.
Section 2: It shall be unlawful for any person, firm
or corporation, desiring to engage in the business of building,
fabricating, applying or repairing roofs, or sheet metal work,
or to perform such work, in the City of Dania, Florida, to be-
gin work or operate such a business, or cause such work to be
done, without first obtaining a permit to do so from the
Building Division of the City of Dania, and all applications
for permits to perform such work shall be on a blank provided
for such purpose, and shall be accompanied by a description of
the work to be undertaken, a specification of the nature and
character of the materials to be used, and if requested, a
brief sketch or plan, all such descriptive matter to be attached
to and become a part of the application for permit. Said appli-
cation shall contain a statement showing whether or not the
person making such application is a roofing contractor holding
a license under City of Dania Ordinance No. 110
9 and any
amendment thereto, or whether or not he is a private property
owner not regularly engaged in the roofing and sheet metal
business; provided, however, nothing in this ordinance shall
be construed to restrict or prohibit a private property owner
from building, fabricating, applying, or repairing his or her,
or its, own roof or roofs, and sheet metal work, and provided
further that all such work whether performed and done by a
Roofing and Sheet Metal Contractor, or by a private property
owner, shall be performed and done in compliance with the re-
strictions, limitation, auu requirements of the City Building

Code, and by the Rules and Regulations and inspection of the
City Roof and Sheet Metal Inspector.
Section 3: When, and if, the Building Inspector
shall accept any application which conforms to the requirements
of this ordinance, there shall be issued to the applicant a
permit to proceed with the work, and for issuing such permit
the Building Division of the City of Dania shall assess the
following fees:
For jobs, including labor and materials,
costing less than 025.00 No Fee
From $25.00 to $5 00.00 $2.00
From 45Q)1.00 and over $5.00
Section Any person, or persons, firm, or corpora-
tion violating any of the provisions of this ordinance shall be
._� punished upon conviction by a fine not exceeding V200.00, or
by imprisonment not exceeding 60 days, or both, such fine and
imprisonment shall be in the discretion of the Municipal Judge
of the City of Dania, Florida. Upon conviction of any person
of the violation of this ordinance, or any part thereof, then
the Municipal Judge of the City of Dania, Florida, may there-
upon, in his discretion revoke the license and/or
/ permit of
the person, persons, firm or corporation, as an additional
penalty for the violation of this ordinance.
Section This ordinance is hereby declared to be
an emergency measure on the ground of urgent public need for
the preservation of peace, health, and safety and property of
the City of Dania, Florida.
Section 6: This ordinance shall be in force and take
effect immediately upon its passage and adoption.
Section 7: All ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed to the
extent of such conflict.
Section 8: By unanimous consent of all the commis-
sioners present, this ordinance has been introduced and read

for the first time and read for the second time and third time;
and passed on all three readings at this meeting of the City
i
Commission of the City of Dania, Florida; and has been passed
by unanimous vote of all the commissioners present at this
j meeting.
