BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY i OF DANIA, FLORIDt,: i I Section 1: It is unlawful for any person, group of persons or corporation, either singly or collectively, to promote, advocate, support, encourage, advertise, disseminate I or otherwise advance either by words, signs, gestures, writ- >,.. ings, pictures or other form of communication the political ideology known as Communism. i Section 2: It shall be unlawful for any officer or member of the Communist party of this or any other country I or countries to be within the corporate limits or police jur- isdiction of the City of Dania in or upon any day after i forty-eight hours after the date of publication of this ordi- nance and before cessation of hostilities in Korea against the armed forces of the United States . j Section 3: The presence of any such officer or mein- ber within such limits or jurisdiction in or upon any such day a I :J a i J shall constitute an offense separate from the offense of his I presence within such limits or jurisdiction in or upon any other such day. Section 1�: It shall be pr ima ima facie evidence that a person is a member of such Communist party if he shall en- gage in the circulation or distribution of any printed or written matter issued or purporting to have been issued by or over the name of such Communist party or any branch thereof, or if he shall engage in the circulation or distri- bution of any printed or written matter issued or ort u p rp ing to have been issued by or over the name of any organization whose policy is controlled by any person or persons estab- lished to be or to have been a member or officer of such Communist party by proof other than the prima facie evidence referred to in this section, or if he shall be found in any secret or non-public place in voluntary association or com- b A munication with any person or persons established to be or to have been a member of such Communist party by proof other than the prima facie evidence referred to in this sec- tion. Section 5 : All persons who have been heretofore, or i who may now be or my hereafter be members of the Communist party and who are residing within the City limits of the City of Dania, Florida, or who may be within the limits of the City of Dania, hereby are required to register in a book of registration to be kept by the Police Department, and Shall be required to sign said registration book, give their name, place of residence, how long they have belonged to the Communist party, and to furnish to the Police Depart- ment any and all other facts or information concerning them- selves and their membership in the Communist party. I Ii -2- j J i Section 6: The City Commission of the City of Dania hereby adopts each and every provision of Chapter 876, Florida Statutes, being Suctions 876.01 et seq., Florida Statutes Annotated, Chapter 20216, Laws of Florida, 1941, as amended by and including Chapter 2501F6, Laws of Florida, 191�9, and declares that it shall be an offense against the City of Dania to violate or fail to comply with any of the terms and provisions of said Sections 876.01, Florida Statutes, et seq. , Florida Statutes Anno- tated, Section 7: Any person guilty of violation of any provision of this ordinance shall be punished by a fine of not more than Two Hundred Fifty Dollars, (w250.0C) , or by imprisonment of not more than ninety (90) days, or by both such fine and imprisonment in the discretion of the Liunici- pal Court Judge. Sect_ ion 8: A11 ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 9: This ordinance shall take effect and be in force immediately upon its passage and adoption. i Section By unanimous consent of all the commis- sioners present, this ordinance has been introduced and read for the first time and read for the second and third times; and passed on all three readings at this meeting of the City Commission of the City of Dania, Florida; and has been passed by a unanimous vote of all commissioners present at this meeting.
