HomeMy WebLinkAboutO-1973-023 i F_ 1 ORDINANCE NO. 23 AN ORDINANCE REQUIRING THE UNDERGROUND WIRING IN NEW SUBDIVI- SIONS OF ELECTRICAL AND COMMUNICATIONS LINES; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE- WITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVID- ING THAT, BY UNANIMOUS CONSENT OF ALL COMMISSIONERS PRESENT AT THE MEETING OF THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA, FIELD ON MAY 7, 1973, THE ORDINANCE HAS BEEN INTRO- DUCED, READ THE FIRST TIME, READ BY TITLE ONLY THE SECOND i AND THIRD TIMES, AND PASSED ON ALL THREE READINGS AT THE MEET- ING OF MAY 7, 1973; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND ADOPTION ON THIRD READING ( BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: 1 1 Section 1. Underground installation of public utilities-- innew residential subdivisions whose plats are approved after the effective i date of this ordinance, all utility lines (including, but not limited to, those required for i ? electrical power distribution, telephone and telegraph communication, street lighting and 7 television signal service) shall be installed underground. This section shall apply to all cable, conduits or wires forming part of an electrical distribution system, including service ilines to individual properties necessary to serve the subdivision under consideration. How- ever, this section shall not apply to wires, conductors or associated apparatus and support- Iing structures whose exclusive function is in transmission of electrial energy between generat- ing stations, substations and transmission lines of other utility systems and main distribu- tion feeder electric lines delivering power to local distribution systems. Appurtenances such as transformer boxes, pedestal mounted terminal boxes, and meter cabinets may be placed above ground and shall be located in such a manner as to minimize noise effects upon the surrounding residential properties. i 1 Section 2. Easements-- Easements shall be provided for the installation of underground utilities or re- locating existing facilities in conformance with such size and location of easements as may be determined by the building inspector of City of Dania to be compatible with the require- ments of all utility companies involved with respect to a particular utility service. Section 3. Costs-- i The subdivider or developer shall make the necessary costs and other arrangements for such underground installation with each of the persons, firms or corporations furnishing utility services that are involved with respect to a particular development. Section 9. Evidence of arrangements with utility companies-- jThe subdivider or developer shall submit written evidence of a satisfactory arrange- ment with each of the persons, firms or corporations furnishing utility services involved with respect to a particular development before the final plat of the subdivision is submitted to i the city commission for its approval. i Section 5.-- All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. I7 Section 6.-- ( By unanimous consent of all commissioners present at the meeting of the City Com- {7 mission of the City of Dania, Florida, held on May 7, 1973, this ordinance has been intro- I� duced, read the first time, read by title only the second and third times, and passed on all three readings at the meeting of the City Commission of the City of Dania, Florida, held on May 7, 1973. Section 7.-- This ordinance shall be in force and take effect immediately upon its passage and i adoption. PASSED and ADOPTED on First Reading on the 7th day of May, 1973, PASSED and ADOPTED on Second Reading on the 7th day of May, 1973.
