AN ORDINANCE PROHIBITING DAMAGING OF PUBLIC
PROPERTY OR PROPERTY HELD FOR PUBLIC USE
WITHIN THE CITY OF DANIA, FLORIDA; AND PRES-
CRIBING A PENALTY FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DANIA, FLORIDA
Section 1: That from and after the passage of this
Ordinance it shall be unlawful for any person, firm or corpora-
tion to injure or destory any of the public, buildings , side-
walks, streets or other property situated in or on the public
property of the City of Dania, Florida.
Section 2: That from and after the passage of this
Ordinance it shall be unlawful for any person, firm or corpora-
tion to drive or cause to be driven any vehicle upon, over or
across any sidewalk in the City of Dania, Florida, other than
at an established crossing or at a place prepared for that
purpose, or at a place pursuant to a permit from the City
Manager.
Section 3: That from and after the passage of this
Ordinance it shall be unlawful for any person, firm or corpora-
tioa to desecrate or despoil or to harm or injure any cemetery,
or any other public property set apart for public use or held
for benevolent or charitable purposes., within the City of Dania.
Section 4: Any person, firm or officers of any cor-
Poration violating the provisions of this Ordinance shall, upon
conviction, be punished by a fine not exceeding One Hundred
Dollars (�100. 00), or by imprisonment of a period not exceeding
thirty (30) days, or by both such fine or imprisonment in the
discretion of the Mayor. Each violation hereof shall be deemed
to be a distinct and separate offense.

Section 5= That all Ordinances or Resolutions or
Parts of Ordinances or Resolutions in conflict herewith be and
the same are hereby repealed.
Section g: This Ordinance shall take effect and
be in force immediately upon its passage and adoption.

Section 1 . That from and after the passage of
this Ordinance it shall be unla;vful for any person, firm
or corporation to place upon any public, 9ide;valTc within
the City limits of the City of Dania, Florida any furni-
ture , furnishings, fixtures , merchandise offered for sale,
or other obstructions upon said public sidewalks .
Section 2. An,, person, firm or officers of any
corporation violating the provisions of this Ordinance
shall, upon conviction , be punished by a fine not exceed-
ing OaE HUNDRED DOLLARS, (.R` 100.00) , or by imprisonment of
a period not exceeding thirty (30) days, or by both such
fine or imprisonment in the discretion

duly called a primary election for the 5th day of octo-
ber, A. D• , 1948, for the purpose of nominating six can-
didates for the three vacancies to occur in the City
Council, and,
'NHEREAS, the United States ;b'eather Bureau an-
nounced a hurricane which did occur on said date necessi-
tating the boarding up of the voting places for such of-
fices, and making it therefore impossible to hold such an /
election, 1
NOW, THEREFOR' BE IT ORDAINED BY THE CITY COUPICIL
OE' Thy CITY OF DANIA, FLORIJA :
,_k; Section 1, That the primary election called by
the City Council of the City of Dania, Florida for the

purpose of nominating six candidates for the three vacan-
cies to occur in the City Council which ,vas called for
October 5, 1948, shall be held at the same time of day,

Place and in the same manner as called for by said Council
and notices, which election shall be held on the llth day
Of October, 1949 .

Section 2 , That all. Ordinances or Resolutions

with be and the same are hereby repealed.

AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, j
AUTHORIZING CITY BUILDING , ZONING AND CODE
ENFORCEMENT OFFICIALS TO ISSUE NOTICES TO
APPEAR IN COURT FOR FAILURE TO COMPLY WITH
LOCAL BUILDING AND ZONING CODE OF ORDINANCES
AFTER PROPER NOTICE AND A REASONABLE TIME
j PERIOD FOR VOLUNTARY COMPLIANCE IS GIVEN AND
PROVIDING FOR AN EFFECTIVE DATE ,
RECITALS:
j A. The City has experienced and will continue to ex-
perience instances of willful and flagrant disregarding, of
s
lawful and proper directives by its building, zoning and

code inspectors , and
B. The present method of enforcing such directives is

cumbersome, time-consuming and does not afford the City a
proper remedy, and
C. The City Commission has been advised by its City At-
torney that the situation could be remedied by enacting the
3 Ordinance set forth below.

NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF DANIA, FLORIDA:

Section 1. Notice to owner or occupant .
(a) The owner must vacate, repair, or demolish said
building in accordance with the terms of the notice.
(b) Building, Zoning and Code Enforcement officials have
the authority to issue a notice to appear in court to any
owner or other property person responsible for violating any
provision of applicable building and zoning codes and code of
111 ordinances . Such notice shall be issued only after a reason-
able time period has been granted to allow for voluntary com-
pliance depending upon the nature of the violation , but in no

case, less than ten (10) days from the date of the initial
notice of violation to the property owner or responsible per-
son. Enforcement officers designated pursuant to this subsec-
tion shall not be police officers and shall not make physical

arrests to take any person into custody.

Section 2. If any section, subsection , sentence , clause ,
phrase , or portion of this Ordinance is , for any reason , held
i
invalid or unconstitutional b an court of competent
Y Y p jurisdic-
tion, such portion shall be deemed a separate , distinct , and
independent provision and such holding shall not effect the
i
validity of the remaining portions of this ordinance.

Section 3. This ordinance shall take effect immediately
i
upon its passage and adoption.
