AN ORDINANCE CREATING THE OFFICE OF
FINANCE DIRECTOR IN THE CITY OF DANIA,
FLORIDA: AND PROVIDING THAT ALL ORDI-
NANCES OR PARTS OF ORDINANCES IN CON-
FLICT HEREWITH ARE HEREBY REPEALED TO
j THE EXTENT OF SUCH CONFLICT; AND PRO-
VIDING THAT THIS ORDINANCE SHALL BECOME
EFFECTIVE AS OF ITS PASSAGE AND ADOPTION.
WHEREAS, the charter of City of Dania provides for the
appointment of a city clerk-auditor as one of the administrative
or executive heads of the municipal government; and
WHEREAS, the charter further provides that the city
commission may, by ordinance, create offices other than the offices

which are specifically created by the charter; and
i
WHEREAS, an analysis of the duties of the city clerk-
. I
auditor, as set forth in the charter of the city, indicates that
same are primarily in the nature of accounting, bookkeeping and
i
fiscal functions, more closely related to auditing only; and
WHEREAS, the city commission has determined that the
business of the cityhas advanced to the point where it is �
i
desirable to have a separate office, to be known as the finance
director, with it being the primary duty of the finance director
i
to assist the city manager in all budgetary and finance matters
which are not a part of the express duties of the city clerk-
auditor; and
i
WHEREAS, the city commission desires by this ordinance
j to create the separate office of finance director,
i
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF DANIA, FLORIDA.

Section 1. Pursuant to the authority given by
Section 1, Article 11 Part III, of the charter of City of Dania,
the separate and independent office of finance director is
hereby created.

Section 2. The finance director shall be deemed to
be a department head of the city having both executive and
administrative duties. He shall be subject tr the supervision
and direction of the city manager and shall perform all duties
of a budgetary or financial nature wich are delegated to him -
by the city manager and which are not specifically delegated
to the city clerk-auditor under the express provisions of the
charter of the city.
Section 3. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed to the

extent of such conflict.

j Section 4. That this ordinance shall be in force f
and take effect immediately upon its passage and adoption.
PASSED and ADOPTED on First Reading on the 4th day
of December, 1972.
PASSED and ADOPTED on Second Reading on the 4th day
of December, 1972.
PASSED and ADOPTED on Third Reading on the 4th day
of December, 1972.

Dear Mr. Hampton and Mrs. Mullikin:
Resolution number 24, adopted on November 20, 1972, appointed
Mr. E. R. Clay as city clerk-auditor. A separate section of resolu-
tion 24 also appointed Mr. Clay to serve as finance director but

without being entitled to separate compensation.

I note that we did draft a proposed ordinance on or about
December 4, 1972, actually creating the office of finance director
as department head. In the letter to each of you, I enclose a
photocopy of the proposed ordinance.

My internal notes regarding the meeting of December 4, 1972,
do not indicate that the ordinance was either presented or otherwise
discussed.
At this point, I am assuming that someone asked me to draft
the ordinance for presentation on December 4, 1972, but that, for
reasons which I do not recall, the ordinance was not considered or
presented.
Therefore, while I do wish to call the matter to your attention,
I am proceeding on the assumption that the ordinance was never pre-
sented. I do note that Mr. Clay left as an open number the number,
21, for an ordinance in his chronological list of ordinances.
Ordinarily, ordinance number: 21 would have been adopted around

December 4 , 1972.

Please advise me if you want me to bring the matter to the
attention of the present commission if there is any thought that we
should have an ordinance on the subject.

50 SOUTH, RANGE 42 EAST, BROWARD
COUNTY, FLORIDA, FROM EXISTING
ZONING CLASSIFICATION TO R-2 ZONING
CLASSIFICATION; AND PROVIDING THAT,
BY UNANIMOUS CONSENT OF ALL COMMIS-
SIONERS PRESENT, THE ORDINANCE HAS
BEEN INTRODUCED, READ THE FIRST TIME,

follows: On the North by a line 35.00
feet South of and parallel with the
North line of the said E 1/2; on the East
by the East line of the said E 1/2; on the
South by the North right-of-way line of
N. W. 13th Avenue as recorded in Official
Records Book 2007, page 301, Public Records
of Broward County, Florida; on the West by
the East line of said Parcel "A" ; said lands
situate, lying and being in Broward County,
