HomeMy WebLinkAboutO-1978-192 (2)_ 1 i i ORDINANCE N0 . 192 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, ANNEXING CERTAIN UNINCORPORATED LANDS TO CITY OF DANIA, FLORIDA, AND REDEFINING THE BOUNDARY LINES OF THE CITY TO INCLUDE SUCH LANDS ; AND PROVIDING THAT SUCH LANDS SHALL BE IMMEDIATELY SUBJECT TO ALL TAXES , FRANCHISES , RIGHTS , PRIVILEGES AND LIABILITIES OF CITY OF DANIA; AND DIRECTING THE CITY CLERK-AUDITOR TO RECORD A CERTIFIED COPY OF THE ORDINANCE IN THE PUBLIC RECORDS OF BROWARD COUNTY , FLORIDA; AND FURTHER DIRECTING THE CITY CLERK-AUDITOR TO TRANSMIT CERTIFIED COPIES OF THE ORDINANCE TO j CERTAIN OFFICERS NAMED IN THE ORDINANCES ; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT ; AND PROVIDING FOR AN EFFECTIVE DATE . I WHEREAS , Section 171. 04, Florida Statutes , which became effective July 1, 1976 , provides that the owner or owners of real property in an unincorporated area of a county which is contiguous to a municipality and reasonably compact may petition the governing body of said municipality that said property be annexed to the municipality; and i WHEREAS , by two written petitions of JOHN L .A. BOND, the owner i of the following described unincorporated lands , contiguous to the limits of City of Dania, Florida municipal corporation, the said JOHN L.A. WHEREAS , the aforesaid legal descriptions were furnished by j McLaughlin Engineering Co. , Registered Land Surveyor, on a sheet dated i -4- , 1 l l l i if i 1 i August 18, 1978 entitled "Description of Lands to be Annexed to Dania" and containing a certification that the lands were contiguous to the present city limits of Dania, Florida; and WHEREAS, the city commission has determined that the aforesaid petitions bear the signatures of all owners of property in the area proposed to be annexed, namely, JOHN L.A. BOND; and WHEREAS, the procedure under Section 171 . 044, Florida Statutes , jregarding the annexation of unincorporated lands contiguous to a municipality requires the following basic procedures to be followed : I 1 . Upon the determination by the governing body of a the municipality that the petition bears the i 1 signatures of all owners of property in the area I proposed to be annexed, the governing body may, at i any regular meeting, adopt a nonemergency ordinance I to annex said property and redefine the boundary lines of the municipality to include said property. t { Said ordinance shall be passed after same has been j published once a week for four consecutive weeks in some newspaper in such city or town, or if no news- paper is published in said city or town, then in a newspaper published in the same county; and if no newspaper is published in said county . . . . . . . 2. The ordinance adopted shall be filed with the Clerk of the Circuit Court of the County in which i the municipality is located and with the Department i of State. and WHEREAS, in accordance with the requirements of Section 166 .041 and 171. 044, Florida Statutes , the title of this ordinance was published once a week for four consecutive weeks, the dates of said 1 I I f i I 1 i publication being August 28 1978, September 4 1978 , September 11 , 1978 and September 18, 1978 , in the Hollywood Sun-Tattler; and i WHEREAS , the city commission has considered the matter further and now desires to finally annex the lands which are the subject of this ordinance to City of Dania, a Florida municipal corporation, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE i CITY OF DANIA, FLORIDA: Section 1 . Section 3 . That the City Clerk - Auditor be and she is hereby directed to record a certified copy of this ordinance in the Public Records of Broward County, Florida. Further, she is hereby directed and instructed to furnish a certified copy of this ordinance to each of the following officers or agencies : Clerk of Circuit Court , Broward County, Florida; Tax Assessor, Broward County, Florida; Tax Collector, Broward County, Florida; County Administrator, Broward County, Florida; Chairman, Board of County Commissioners , Broward County, Florida; Department of State, State of Florida ; and Chairman, Broward County, Florida legislative delegation Section 4. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict . Section 5 . That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on First Reading on the 22nd day of August 1978 .
