HomeMy WebLinkAboutO-1978-177 r >� J� ORDINANCE N0. 177 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING ARTICLE 4 OF ORDINANCE NO. 100 ENTITLED "DISTRICT REGULATIONS" BY ESTABLISHING NEW COMMERCIAL DISTRICT CLASSIFICATIONS TO BE KNOWN AS C-1 , C-2, C-3 AND C-4 WITH A SCHEDULE OF USE REGULATIONS FOR SAID DISTRICTS ; AND BY ESTABLISHING A NEW SCHEDULE OF USE REGULATIONS FOR THE INDUSTRIAL DISTRICT KNOWN AS I-G (INDUSTRIAL GENERAL) ; AND SETTING FORTH IN THE SCHEDULE OF USE REGULATIONS THE PURPOSE , PER- MITTED USES, ACCESSORY USES AND SPECIAL EXCEPTION USES IN EACH SAID DISTRICT; AND REPEALING THE EXISTING SCHEDULE OF USE REGULATIONS FOR C-1 I (COMMERCIAL AND I-G (INDUSTRIAL) OS GENERAL) GENERAL) DISTRICTS ; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF j ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOL- UTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. I WHEREAS , the Planning and Zoning Board of the City of Dania has i j recommended certain modifications and changes in the schedules of use j regulations for commercial and industrial districts as set forth in City Ordinance No. 100, passed and adopted by the City Commission of Dania, Florida, on final reading July 20, 1976 ; and jj WHEREAS , the City Commission of the City of Dania has reviewed the said recommendations with the said Planning and Zoning Board and the Zoning Consultant for the City and after said review finds that ? said recommended modifications and/or changes would be in the best j interest of the citizens of the City of Dania. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: � I Section 1 . That Chapter 33 of the Code of Ordinances of the City of Dania, Florida, as set forth in City Ordinance No . 100 passed and i adopted on July 20, 1976 , be and the same is hereby amended by repealing the existing district regulations for C-1 (commercial-offices) , C-2 (commercial-general) and I-G (Industrial-general) districts and sub- stituting in place thereof new district regulations to be hereinafter known and classified as C-1 , C-2, C-3, C-4 and I-G districts , with the i purpose, permitted uses , accessory uses and special exception uses for II ` J i I � z vu t) each said district classification which are as follows : DISTRICT PURPOSE C-1 The purpose of this district is to create an 1 environment especially suited to a group of jprofessional and administrative offices com- patible in appearance with single family housing . PER11ITTED USES i Business or professional offices i Banks and financial institutions i Churches , synagogues or other houses of worship I Non-Profit cultural centers i j Eating and drinking places provided that such use shall not I occupy more than 15 percent of the gross floor area of the structure in which they are located ACCESSORY USES Off-Street parking and loading i Signs Accessory uses customarily incident to the permitted or approval special exception uses I I SPECIAL EXCEPTION USES Public or private parking lots or storage garages iI Essential services r Supplemental parking Public or private academic schools Hotels I Entertainment I j DISTRICT PURPOSE i C-2 A "C-2" district is intended for retail stores , j j offices , or service establishments with convenient pedestrian access throughout the district. It does j j not allow auto-oriented land uses such as boat and 1 t . -2- j I 1 I motor vehicle showrooms or drive-in theatres , jwhich have large acreage requirements and j I destroy the pedestrian orientation. "C-2" I � zoning is appropriate for neighborhood shopping centers , town centers , central business districts , i and shopping malls , all of which have compactness , pedestrian scale or orientation, and a strong 1 "sense of place" i PERMITTED USES j All Permitted Uses , Accessory Uses and Special Exception Uses 1 Iset forth in C-1 Sales of merchandise or services excluding boat , auto, truck, motorcycles , tractor, recreational vehicle, and mobile home {{ sales , body shops , tire stores , car washes , sales of lumber, i block, gravel , and other bulk materials and drive-in theatres Restaurants and bars Preparation of baked goods , sweets and delicatessen items sold exclusively on the premises I i Indoor recreation or athletic facilities Offices and studios Laundries and dry cleaners Libraries Charitable, civic, faternal , and professional associations Hotels, motels , and lodgings for transients Auditoriums and convention halls Museums and galleries Schools i Clinics Broadcasting studios without towers Handicraft production ACCESSORY USES Same as C-1 -3- 1, 4 J SPECIAL EXCEPTION USES 1 Broadcasting studios with towers Multi-family 1 DISTRICT PURPOSE I C-3 A "C-3" district is intended for retail stores , offices , or service establishments spread along a trafficway or adjacent streets . It is oriented to patrons who drive from one store, I i office, or shop to another by motor vehicle. Enclosed vehicle repair shops , auto service stations , parking areas , and drive-up windows within a C-3 district shall be subject to especially careful design control . There is less interdependence of design and a wider variety of allowed land uses than in the "C-2" district . PERMITTED USES I S All Permitted Uses , Accessory Uses and Special Exception Uses set forth in C-1 and C-2 Auto service stations Preparation of baked goods , sweets and delicatessen items sold primarily on the premises Funeral homes Nursing homes ACCESSORY USES One dwelling unit SPECIAL EXCEPTION USES Vehicle service establishments (enclosed only) Warehousing t t j ` I DISTRICT PURPOSE C-4 A "C-4" district is intended for retail stores , offices , or enclosed service establishments , and enclosed vehicle repair shops , spread along a 1 trafficway or adjacent streets . It is oriented jto patrons who drive from one store , office or shop to another by motor vehicle. There is less interdependence of design and a wider variety of allowed land uses than in the "C-1',' "C-2" and "C-3" districts . i PERMITTED USES I All Permitted Uses , Accessory Uses and Special Exception Uses I set forth in C-1, C-2 and C-3 Sales of merchandise or services Indoor or outdoor recreation or athletic facilities Parking facilities " Inside storage and sales of lumber and building materials Transportation terminals I� Maintenance or repair within an enclosed building { Auto rental facilities Warehousing I ACCESSORY USES I I Same as C-1 , C-2 and C-3 { SPECIAL EXCEPTION USES Same as C-1 , C-2 and C-3 ! I DISTRICT PURPOSE I-G An "I-G" district is intended for office and research parks , manufacturing, warehousing, i transportation terminals , major utility plants , j sales of bulk materials , or mineral extraction. { Retail sales and services should be clustered in i 11C-11' , "C-211 , "C-3" and "C-4" districts , rather than scattered through "I-G" districts , unless the 1 -5- 1 , jsales are ancillary to a land use which is limited to an "I-G" district. I PERMITTED USES ' I All Permitted Uses , Accessory Uses and Special Exception Uses i set forth in I-R i Hotels and motels i Restaurants and bars Offices i Research and developement laboratories Manufacturing, processing, assembly, maintenance or repair Parking facilities Streets i Flood control facilities i Sales of merchandise or services excluding motor vehicles Police and fire protection facilities Ambulance services I ' I Public utilities Transportation terminals Waste collection and treatment facilities Parks and recreational or athletic facilities Service establishments including automobile and gasoline I Boat manufacturing up to 150 feet Auditoriums and convention halls Grazing Crop raising Aquaculture ACCESSORY USES j One dwelling unit i SPECIAL EXCEPTION USES i j Packing or canning plants Section 2 . That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict . -6- J i i I <it Section 3. That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on First Reading on the 23rd day of May 1978 .
