HomeMy WebLinkAboutO-1978-170 r i ORDINANCE NO . 170 1 y AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, ADOPTING SECTION 112 . 061 FLORIDA STATUTES RELATIVE TO PER DIEM AND TRAVELING EXPENSES OF PUBLIC OFFICERS , EMPLOYEES AND AUTHORIZED PERSONS AND THAT NOTWITHSTANDING SAME TO i PROVIDE FOR REIMBURSEMENT OF LODGING PLUS $35 . 00 PER DIEM FOR THE CITY COMMISSIONERS , THE CITY MANAGER AND CITY ATTORNEY; AND PRO- VIDING THAT ALL ORDINANCES OR PARTS OF ORD- INANCES AND ALL RESOLUTIONS OR PARTS OF RES- OLUTIONS IN CONFLICT BE REPEALED TO THE EX- TENT OF SUCH CONFLICT ; AND PROVIDING FOR AN EFFECTIVE DATE . I WHEREAS, the Municipal Home Rule Powers Act, Chapter 73-129, i Laws of Florida, gives broad home rule powers to municipalities and provides essentially that, with certain exceptions , municipalities can enact any legislation concerning any subject matter upon which the state legislature may act , and WHEREAS , there is no express preemption of per diem and travel ^ allowances that may be paid municipal officials in Section 112 .061 , f Florida Statutes , and I WHEREAS , the City Commission of the City of Dania , Florida, wishes to adopt Section 112 . 061, Florida Statutes , with certain modifications which it has determined to be just and reasonable, as 1 I a part of the Code of Ordinances of the City of Dania, Florida . NOW, THEREFORE , BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That Section 112 . 061 Florida Statutes pertaining to the per diem and traveling expenses of Public Officers , Employees and Authorized persons be and the same is hereby adopted and made a part of the Code of Ordinances of the City of Dania, Florida, as though fully set out herein. 4 a Section 2 . That notwithstanding Subsection (6) under the fore- going Section, the City Commissioners , City Manager and the City t Attorney shall receive the actual expenses for lodging at maximum double occupancy rate to be substantiated by paid bills therefor plus $35.00 per diem while traveling on official business . a 1 • i i Section 3. That the provisions of this ordinance shall cover the City of Dania's fiscal year of 1977-1978 and subsequent fiscal i years . e ' Section 4. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict . } Section 5. Be It Enacted by the Legislature of the State of Florida: Section 1. Subsection (6) of section 112.061, Florida Statutes, 1976 Supplement, is amended to read: 112.061 Per diem and traveling expenses of public officers, employees, and authorized persons,-- (6) RATES OF PER DIEM AND SUBSISTENCE ALLOWANCE.--For purposes of reimbursement rates and methods of calculation, per diem and subsistence allowances are divided into the following groups, and maximum rates to-be determined by the agency head; (a) All travelers may be allowed for subsistcnce when traveling to a convention or conference or when travelinq outside the state in order to conduct bona fide state business which convention, conference of business serves a direct an lawful relation public purpose w7th relaon to the public agency served by the person attending such meeting or conducting such business, either of the following: 1. Up to $35 025 per diem, or ff 2. Up to the amounts permitted in paragraph (d) of this subsection for meals, plus actual expenses for lodging at a single occupancy rate to be substantiated by paid bills therefor. _ (b) The Governor, members of the state cabinet, members of the Legislature, members of the Public Service Commission, Justices of the tr Supreme Court and Judges of the District Courts of Appeal, Circuit Courts and County Courts may receive $35 025 per diem while traveling on official business. (c) All other travelers may be allowed: ll� 1. Up to $35 025 per diem; 2. When lodging or meals are provided at a state institution, the traveler shall be reimbursed only for the actual expenses of lodging or meals, not to exceed the maximum provided for in this subsection, (d) Meals only.--All travelers may be allowed- for subsistence while r on Class C travel on official business, up to the following amounts: r 2.
