ORDINANCE NO. 160 l
AN ORDINANCE OF THE CITY OF DANIA, FLORIDA,
AMENDING SECTION 3, ARTICLE 3, PART 1X OF
THE CITY CHARTER ENTITLED "VACATING OR CHANG-
ING STREETS OR ALLEYS" BY INCLUDING THEREIN
AN EXCEPTION TO THE REQUIREMENT THAT A NEW
PLAT MUST BE SUBMITTED AND APPROVAL BY THE
CITY COMMISSION; AND PROVIDING THAT ALL RES-
OLUTIONS OR PARTS OF RESOLUTIONS AND ALL
j ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH BE REPEALED TO THE EXTENT OF SUCH
CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE .

WHEREAS , it has been determined by the City Commission of the
City of Dania, Florida, that compliance with the plat requirement
i
contained in Section 3, Article 3, Part 1X of the Charter of the
City of Dania in certain instances imposes undue hardship upon the
property owners within the city; and,
WHEREAS , the City Commission desires to aleviate such undue
hardship imposed by said section,

NOW, THEREFORE , BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section I. That the second sentence of Section 3, Article 3 , j
Part 1X of the City Charter of the City of Dania, Florida be and the
same is hereby amended to read as follows :

"No street, alley or other property dedicated to

the public use shall be vacated or abandoned except
by a new plat submitted to and approval by the City
Commission, showing the condition of the area after
such vacation or abandonment; however, if is determined
by the City Commission that the submission and approval
i
of such new plat would cause an undue hardship to the
property owner or owners requesting such a vacation
i
or abandonment the submission and approval of such new
i
plat may be waived by the City Commission" .

Section 2 . That except as herein amended all other provisions of
I
said Section 3, Article 3, Part 1X of the City Charter of the City of
Dania shall remain in full force and effect.
Section 3. That all resolutions or parts of resolutions and

all ordinances or parts of ordinances in conflict herewith be I
repealed to the extent of such conflict .
Section 4. That this ordinance shall be in force and take
effect immediately upon its passage and adoption.

October 1977.
PASSED and ADOPTED on Second and Final Reading on the 25th
day of October 1977.
