HomeMy WebLinkAboutO-1990-041 i ; u r C ORDINANCE NO. 41-90 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, : r< AMENDING SECTION 5.36 , ARTICLE 5, CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA, ENTITLED "WALLS, FENCES AND HEDGES" ; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR ?' PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE g' REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That Section 5. 36 , Article 5 , Chapter 28 of the Code of Ordinances of the City of Dania, Florida, be and the same j is hereby amended to read as follows: tr A "Sec. 5. 36. WALLS, FENCES AND HEDGES. f Walls, fences or hedges may be located or constructed within the required yard areas and shall conform to the following t regulations , except where special requirements are set forth for I specific screening purposes elsewhere in this chapter. ' i (a) Front Yard. Walls , fences and/or hedges located between the front building line and the street right-of-way line shall not exceed four (4 ) feet in height. The height of a wall , fence or hedge located in a required front yard shall be measured on the street side of the wall , fence or hedge from the top of the wall , fence or hedge and shall not exceed four ti (4 ) feet in height above the grade of the crown of the street at a point directly opposite such points of measurement. (b) Side and Rear Yards. Walls, fences and/or hedges located between the side or rear building line and the side or rear € lot line shall not exceed six ( 6 ) feet in height. This includes the rear street yard of a through lot and the f required street side yard of a corner lot. The height shall be measured on either side of the wall , fence or hedge from the top of the wall , fence or hedge to grade. Where there is a difference in elevation on opposite sides of the wall , fence or hedge , the height shall be measured from the highest elevation . r f t f f Ordinance No. 41-90 L� W. No wall , fence or hedge shall be located ; k{ closer than two and one-half ( 2 1/2) feet to the rear Lot line fc , when it abuts a platted alley, nor be located within the f '[ street right-of-way or streetward of the front lot line as provided for in Section 5. 14. � . (d) Corner Setback Area. Walls, fences and/or hedges shall fi conform with Section 5. 16 regarding obstructions to vision on r corner lots . ix k>c (e) Barbed Wire in Residential Areas. In residential areas, no fence shall be constructed of barbed wire or any material LX inherently dangerous to pedestrians using the public e sidewalk. r ;#l', (f) Other Requirements. Fences or walls shall be constructed E' of masonry materials , wood, chain link , P.V.C. or other materials approved by the building official. The decorative y side of wall or fence shall face the exterior or public side. " Section 2. Except as herein amended, all other provisions of $: r: said Section 5. 36 of the Code of Ordinances of the City of Dania, ; Florida, shall remain in full. force and effect. ; ti Section 3.
