AN ORDINANCE OF THE CITY OF DANIA, FLORIDA,
AMENDING CHAPTER 18 OF THE CODE OF ORDINANCES
OF THE CITY OF DANIA ENTITLED "PENSIONS AND
RETIREMENT" TO CHANGE THE AMOUNT OF THE
MONTHLY RETIREMENT BENEFIT FOR FIREFIGHTERS
AFTER OCTOBER 1 , 1989, CHANGING THE AMOUNT OF
EMPLOYEE CONTRIBUTIONS TO FUND SUCH BENEFITS,
PROVIDING THAT ALL ORDINANCES OR PARTS OF
ORDINANCES AND ALL RESOLUTIONS OR PARTS OF
RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED
TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the 1989-92 collective bargaining agreement between the
City of Dania and the Metro Broward Professional Firefighters Local 3080
provides that the monthly benefit for all active firefighters currently
participating in the City of Dania Police and Firefighters Retirement
System retiring on or after October 1 , 1989 , shall be increased and that
the employee contribution to the System shall be increased in the amount
sufficient to adequately fund such benefit , and ,
WHEREAS, said collective bargaining agreement obligates the City
Commission to amend Chapter 18 of the Code of Ordinances to implement and
./° enact said agreed-upon changes, and
WHEREAS, the Office of the Treasurer and Department of Insurance has
notified the Retirement System that Chapter 18 should be amended to meet
the minimum benefit requirements of state law, and
WHEREAS, the City Commission of the City of Dania wishes to so amend
Chapter 18 ;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
DANIA, FLORIDA:
Section 1 . That Section 18-42 ( 2 ) (b) of Chapter 18 of the Code of

Ordinances of the City of Dania , Florida, is hereby amended to read as
follows :
" (b) Amount .
The monthly retirement benefit for members retiring
before October 1 , 1989, and for police officer, deputy sheriff
and law enforcement officer members who retire on or after
that date shall equal 2. 5% of average monthly earnings for
each of the first 30 years of continuous service and 2% of
average monthly earnings for each year of continuous service
in excess of 37 1/2 years , subject in any event to a maximum
of 100% of average monthly earnings . The monthly retirement
benefit for firefighter members retiring on or after October
1 , 1989 , shall equal 38 of average monthly earnings for each
of the first 25 years of continuous service and 28 of average
monthly earnings for each year of continuous service in excess
of 37 1/2 years, subject in any event to a maximum of 100% of
average monthly earnings . "
Section 2 . That Sections 18-44 ( 1 ) (a ) and (b) of Chapter 18 of the
Code of Ordinances of the City of Dania , Florida, are hereby amended to
read as follows: ,
" (a ) Amount .
All members of the retirement system shall make regular
contributions to the fund at a rate equal to 7% of their
respective earnings. In addition, firefighter members shall ,
commencing October 1 , 1989, contribute an additional percen-
tage of their earnings at a rate determined by the system' s
actuary to be sufficient to fund the increased cost of the
normal retirement benefit for firefighters resulting from the
increase in said benefit from 2. 5% to 38 which took effect on
October 1 , 1989 (which additional contribution shall be
referred to in this subsection as the "additional contribu-
tions . " ) Two percent of each employee ' s earnings shall be
deducted from the employee' s earnings. The remainder of the
employee contributions, comprised of 58 of regular earnings
plus the additional contributions from firefighter members
which commenced on October 1 , 1989, shall be paid and assumed
by the City of Dania in lieu of payroll deductions from
members ' earnings . No members shall have the option of
choosing to receive the contributed amounts directly instead
of having them paid by the City directly to the system. All
such contributions by the City shall be deemed and considered
as a part of the member's accumulated contributions and
subject to all provisions of the system pertaining to accumu-
lated contributions of members . This City "pick up" of

contributions is intended to comply with Section 414 (h) ( 2 ) of
the Internal Revenue Code . j
(b ) Duration .

Contributions shall be deducted from said earnings before I
the same are paid and the remaining employee contributions
shall be "picked up" and paid by the City until the member has
reached his normal retirement date or his maximum retirement j
benefit level , whichever occurs first. "
Section 3 . That Sections 18-41 (2 ) ( c) of Chapter 18 of the Code of
Ordinances of the City of Dania, Florida , is hereby amended to read as
follows :
" (c) Authorization of a 2% payroll deduction payable to
the system, and"
Section 4 . Except as herein amended, all other provisions of said
Chapter 18 shall remain in full force and effect.
Section 5 . That all resolutions or parts of resolutions and all
ordinances or parts of ordinances in conflict herewith be and the same :
are hereby repealed to the extent of such conflict .
Section 6 . That this Ordinance shall be in full force and take
• effect immediately upon its final passage and adoption.
PASSED and ADOPTED on first reading on this 23rd day of
January , 1990.
PASSED and ADOPTED on second and final reading on this 27th day of
March 1990 .
