HomeMy WebLinkAboutO-1989-044 t 1 j 3 ORDINANCE NO. 44-89 f AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING ARTICLE 5 , PART II OF THE CITY CHARTER ENTITLED "SPECIAL ASSESSMENTS FOR LOCAL IMPROVEMENTS" BY THE ADOPTION OF THE PROVISIONS OF CHAPTER 170 , FLORIDA STATUTES , FOR THE, ASSESSMENT AND COLLECTION OF SPECIAL f ASSESSMENTS WITHIN THE CITY; PROVIDING FOR SEPARABILITY; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR j PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND I� PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article 5, Part VII of the City Charter provides a mechanism for imposing special assessments within the city; j and i WHEREAS, Chapter 170 , Florida Statutes, provides a uniform system for assessing and collecting special assessments; and WHEREAS , the city desires to adopt the provisions of Chapter. 170 , Florida Statutes . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE i i CITY OF DANIA, FLORIDA: Section 1 . That Article 5 , Part VII of the City Charter is hereby amended in its entirety to read as follows: "Article 5. Special assessments for local improvements adoption. The city hereby adopts by reference, the provisions of Chapter 170 , Florida Statutes , relating to the assessment and collection of special assessments within the City of Dania, Florida. " f Section 2. If any section, subsection , sentence, clause , phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed to be a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this ordinance. Section 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. j i i Ordinance No. 44-89 f f �J Y 17 C I Section 4 .
