ORDINANCE NO. 02-89
AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, ANNEXING
TO THE CITY OF DANIA CERTAIN PROPERTIES DESCRIBED AS
THE EAST 1/2 OF LOT 6, BLOCK 1 , WILMA MANORS,
ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT
BOOK 31, PAGE 4, OF THE PUBLIC RECORDS OF BROWARD
COUNTY, FLORIDA; SAID LANDS SITUATE, LYING AND BEING
IN BROWARD COUNTY, FLORIDA, TOGETHER WITH ANY
INTEREST OF PETITIONERS/OWNERS IN ADJACENT PUBLIC
RIGHT-OF-WAY; AND PROVIDING FOR FILING OF COPIES,-
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the owners of that property described hereinbelow have

petitioned the City Commission to annex such property to the City of
Dania ; and
i
WHEREAS, the City Commission has determined that :
1. Such property, in fact, is owned by the petitioner, RONALD J.
GATTO; and no others, as evidenced by Opinion of Title submitted by
Thomas J. Tighe, Esquire, Lunny, Tucker, Karns & Tighe , Attorneys At Law
dated December 1, 1988, a copy of which is attached hereto as Exhibit A;
and
2. Such property is contiguous to the City of Dania, Florida, and
3. Such property is reasonably compact ; and
4. The annexation of such property will not result in the creation
of an enclave ; and

WHEREAS, the City Commission has determined further that the City

can provide necessary municipal services to such property ; and
WHEREAS, the annexation of such property will be in the best
i
interest of the City of Dania and its residents .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
DANIA, FLORIDA:
Section 1 . That the property described as :
THE EAST 1/2 OF LOT 6, BLOCK 1 , WILMA MANORS,
ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK
31 , PAGE 4, OF THE PUBLIC RECORDS OF BROWARD COUNTY,
FLORIDA; SAID LANDS SITUATE, LYING AND BEING IN
BROWARD COUNTY, FLORIDA;
be and the same is hereby annexed to the City of Dania, Florida.

Section 2 . That the boundary lines of the City of Dania , Florida,

be and the same are hereby re-defined to include the land herein

described.

Section 3. That this ordinance shall be published once a week for
four (4 ) consecutive weeks in a newspaper of general circulation within
the City of Dania, such publication to occur between the first and second

readings hereof by the City Commission.
Section 4 . That a certified copy of this ordinance shall be filed
i
with the Clerk of the Circuit Court of Broward County, Florida and with
the Department of State of the State of Florida .

Section 5 . That this ordinance shall be in force and take effect
f
immediately upon its final passage and adoption.

PASSED and ADOPTED on First Reading on the 13th day of December
1988.
PASSED and ADOPTED on Second and Final Reading on the 10thday of
January 1989.

Dear Mr. Adler:

i This letter gives opinion of title on the following prop-
erties, for purposes of their annexation into the City of Dania:
1. The West 1/2 of Lot 6 in Block 1, WILMA
MANORS, according to the Plat thereof,
recorded in Plat Book 31, Page 4 of the
Public Records of Broward County, Florida.
2. The East 1/2 of Lot 6 in Block 1, WILMA
MANORS, according to the Plat thereof
recorded in Plat Book 31, Page 4 of the
Public Records of Broward County, Florida.
3. Lot 15 in Block 3 of WILMA MANORS ADDITION,
according to the Plat thereof, recorded in
Plat Book 32 , Page 28 of the Public Records
of Broward County Florida.
The fee simple owner of each of these parcels is Ronald J.
Gatto.
This opinion of title is based on such information as is
prevalently relied upon in Broward County, Florida, in evaluating
title to real estate, to wit: review of existing title insurance
Policies and updates from them. The title information was avail-
able to me up to the date of November 20 , 1988, and that is the
effective date hereof. This opinion of title does not purport to
state easements, encumbrances, mortgages, and restrictions on
these properties, as I understand that is not required, including
under Fla. Stat. §171. 044 (2) .
