HomeMy WebLinkAboutO-1988-060 I jORDINANCE NO. 60-88 f AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING SECTION 13-32 OF ARTICLE II , CHAPTER 13, OF THE 1980 CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA, TO PROVIDE FOR THE PAYMENT OF INTEREST ON LIENS ASSESSED UNDER THE PROVI- SIONS THEREOF; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE C REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, i FLORIDA: Section 1. That Section 13-32 of Article II , Chapter 13 , of the 1980 Code of Ordinances of the City of Dania, Florida, be and the same is hereby amended to read as follows : (a) It is the responsibility of all owners of empty lots to keep said lots clean of inflammables and grass and weeds from growing above twelve ( 12) '. inches in height (Section 11-37 , Article II , Chapter 11 of the City Code) and free of excessive accumulation, untended weeds , undergrowth or plant life that endangers public health, safety, or wel- fare (Section 13-26 , Article II, Chapter 13 of the City Code) . (b) Owners of empty lots have the responsibility to { { keep said lots clear and/or mowed at their own expense . Owners of empty lots on which the grass and weeds exceed twelve (12) inches will be notified by certi- fied mail that the lot must be cleared and/or mowed within ten (10) working days of the postmark of the notice. In the event the owner fails or refuses to mow and/or clear the lots within ten (10) working days , the Director of Public Works shall cause the empty lot to be mowed and/or cleared and charge the cost of same to the owner. The cost to the City shall include the amount charged by the contractor engaged by the City plus a ten dollar ($10. 00) service fee for the first offense and a twenty-five dollar ($25. 00) service fee for any additional offenses in excess of one . The total cost to the City including the service fee shall constitute a lien upon the property which shall accrue interest at the rate of twelve percent ( ) per annum. Section 2 . That except as herein amended, all other provisions of Article II of Chapter 13 of said Code of Ordinances of the City I of Dania, Florida , shall remain in full force and effect . Section 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict .
