ORDINANCE NO. 46-88
AN ORDINANCE OF THE CITY OF DANIA, FLORIDA,
AMENDING SECTION 4 . 20, ARTICLE 4 , OF CHAPTER 28 ,
OF THE CODE OF ORDINANCES OF THE CITY OF DANIA,
FLORIDA, TO PROVIDE FOR THE SALE OF FIREWORKS AS
A SPECIAL EXCEPTION USE IN C-2 ZONING CLASSIFICA-
TION; AND PROVIDING THAT ALL ORDINANCES OR PARTS
OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF
RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO
THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA:
Section 1. That Section 4 . 20 , Article 4 , of Chapter 28

y of the Code of Ordinances of the City of Dania, Florida , be and
the same is hereby amended by adding the sale of fireworks to the
special exception uses in zoning classification C-2 , which shall

read as follows:
"Schedule of Use Regulations E
_ C-2 SPECIAL EXCEPTION USES
,. 4 . The sale of fireworks at wholesale and mail order; pro-
vided , however, said fireworks shall be limited to '
those which fall within the Class C definition and said
sale shall further be limited to a free standirg
structure that is set back from the side property line
at least forty feet (40 ' ) and from the rear property
line at least one hundred fifty feet (150 ' ) and shall
abe permitted within said structure, in that portion
thereof, set back at least seventy-five feet (75 ' )
from the front property line. "
Section 2 . That except as herein amended, all other provisions

I of said Section 4 . 20 , Article 4 of Chapter 28 of the Code of �
Ordinances of the City of Dania, Florida , shall remain in full
force and effect.
Section 3 . That all ordinances or parts of ordinances and
I
all resolutions or parts of resolutions in conflict herewith be
and the same are hereby repealed to the extent of such conflict .
Section 3 . That this ordinance shall be in force and take
effect immediately upon its final passage and adoption.
PASSED and ADOPTED on First Reading on the23rd day of
August 1988 . 4
