HomeMy WebLinkAboutO-1988-041 i ORDINANCE NO. 41-83 j AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, f ESTABLISHING "DANIA SAFE NEIGHBORHOOD IMPROVE- MENT DISTRICT NO. 1" AS PROVIDED FOR BY ARTICLE I V OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA, AND SECTION 59 , CHAPTER 87-243, LAWS OF FLORIDA; PROVIDING FOR ADMINISTRA- TION OF THE DISTRICT; PROVIDING FOR FUNDING; PROVIDING FOR GOVERNMENTAL GRANTS; PROVIDING FOR j BOUNDARIES OF THE DISTRICT; PROVIDING FOR CODIFICA- TION ; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLU- TIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of Chapter 2, of the Code of Ordinances of jthe City of Dania, Florida, heretofore enacted pursuant to the authority of Section 59, Chapter 87-243 , Laws of Florida, provides i i for the formation of Safe Neighborhood Improvement Districts within 7 the City of Dania by city ordinances ; and i WHEREAS , the city manager has recommended the creation of i F "Dania Safe Neighborhood Improvement District No. 1" for an area consisting of approximately 405 acres as shown by the boundary map i thereof which is attached hereto and made a part hereof as Exhibit "A" . A j NOW, THEREFORE , BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That the Dania Safe Neighborhood Improvement District No. 1 consisting of approximately 405 acres as shown and described by . ' the boundary map thereof attached hereto and made a part hereof as Exhibit "A" , be and the same is hereby created and established. Section 2. That the district created hereby is authorized to apply for and receive from the Florida Department of Community Affairs up to $50, 000 . 00 for a planning grant and up to an additional $30,000. 00 to employ the services of technical experts . Section 3. The district may utilize a maximum of two mills ad valorem taxes or special assessments on real property within the district . Section 4 . The City Commission of the City of Dania is hereby designated as the board of directors of the district . Section 5 . The board of directors shall engage in some or all Ordinance No . 41-83 t ' I I f i I;l 1 I of the activities specified in Section 62 , Chapter 87-243 , Laws of Florida. The board of directors is empowered to undertake any i and all activities specified in Section 63 , Chapter 87-243 , Laws i of Florida. I Section 6. An advisory board is hereby established for the safe neighborhood improvement district created hereby. The advisory board shall be composed of no fewer than five members who shall be owners of real property located in the district . The members of the advisory board shall be appointed by the board of directors and shall perform such duties as may be prescribed by the board of directors and shall submit within the time period specified by the board of directors , a report on the district ' s i proposed activities and a proposed budget to accomplish the district ' s objectives . In formulating a plan for services or -e. improvements , the advisory board shall consult , in public session, with the appropriate staff and consultants of the City of Dania responsible for preparation of the district' s plan. Section 7. The provisions of this ordinance shall be included 1 in and incorporated in the Code of Ordinances of the City of Dania, Florida , as an addition or amendment thereto , and shall be 3 " appropriately renumbered to conform to the uniform system of the code. Section 8. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be { and the same are hereby repealed to the extent of such conflict . Section 9. That this ordinance shall be in force and take effect immediately upon its final passage and adoption.
