ORDINANCE NO. 30-88
AN ORDINANCE OF THE CITY OF DANIA, FLORIDA,
AMENDING SECTION 18 OF THE CODE OF ORDINANCES
OF THE CITY OF DANIA ENTITLED "PENSIONS AND
RETIREMENT" TO PERMIT THE DEDUCTION OF
RETIREES ' HEALTH INSURANCE PREMIUMS FROM
PENSION BENEFIT CHECKS ; PROVIDING THAT ALL
ORDINANCES OR PARTS OF ORDINANCES AND ALL
RESOLUTIONS OR PARTS OF RESOLUTIONS IN CON-
FLICT HEREWITH BE REPEALED TO THE EXTENT OF
SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the current Police and Firefighters Retirement system
prohibits the assignment of benefits provided thereunder, and
WHEREAS, Section 112. 0801 of the Florida Statutes requires the
City to offer health and hospitalization insurance coverage to
retirees and their eligible dependents ; and
WHEREAS, it is advantageous for both the City and the retirees
for the premiums which are paid by the retirees for said coverage to
be deducted from the retirees ' pension benefit checks; and y .
WHEREAS, the City Commission is desirous of amending the
Retirement System to permit such deductions .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1 . That Section 18-49 (3 ) of the Code of Ordinances of
the City of Dania, Florida, be and the same is hereby amended by
deleting said subsection ( 3 ) and substituting the following in its
place:
"NON-ASSIGNABILITY. No benefit provided for herein shall be
assignable or subject to garnishment for debt or other legal process
except benefit recipients that authorize the premium for health and
hospitalization insurance coverage which is made available by the
City to said beneficiaries pursuant to Section 112. 0801 of the
Florida Statutes or other applicable laws.
Section 2. That all ordinances or parts of ordinances and all
resolutions or parts of resolutions in conflict herewith be and the
same are hereby repealed to the extent of such conflict .

Section 3. That this ordinance shall be in force and take
effect immediately upon its passage and adoption .
