HomeMy WebLinkAboutO-1988-016 - c ORDINANCE NO. 16-88 I i AN ORDINANCE OF THE CITY OF DANIA, FLORIDA AMENDING CHAPTER 3, ARTICLE II, OF THE CODE OF ORDINANCES OF THE CITY OF DANIA BY ADDING SECTION 3. 39 TO BE ENTITLED "SIGNS IN THE DOWNTOWN DANIA REDEVELOPMENT DISTRICT" ; PRO- VIDING FOR SEVERABILITY; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CON- FLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT AND PROVIDING FOR AN EFFECTIVE DATE. j WHEREAS, the City of Dania, Florida, through Ordinance 222 designated as Chapter 3 Article II of the Code of Ordinances of the i City of Dania, Florida, has enacted signage and advertising regulations ; and WHEREAS, the City of Dania has created a Downtown Dania Redevelop- ment District; and i WHEREAS, the Main Street Design Manual contains design guidelines for signage in the Downtown Dania Redevelopment District; and I WHEREAS, there are certain additions, clarifications, and changes necessary for the proper implementation of the Downtown Dania t Redevelopment District guidelines . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY I OF DANIA, FLORIDA: i SECTION 1 : SCOPE. q 1 . 01 : The City of Dania, Florida, does hereby amend Ordinance 222, also designated in the Code of Ordinances of the City of S Dania, Florida, as Chapter 3 Article II as follows: 1 j 1 . 02: This overlay is intended to provide for appropriate and consistent sign requirements where applied within the overlay boundaries as defined by Section 3 of this ordinance. These require- ments, when more stringent, shall supersede any conflicting requirement within the Dania Zoning Ordinance. Any requirements, procedures , exemptions, etc. , found within this overlay, shall remain in effect . SECTION 2: PERMITTED SIGNS. 2. 01 : Exterior signage for all development in the Downtown i Dania Redevelopment District shall be in accordance with the following requirements : -1- r (1 ) Pole (ground ) Sign: A sign erected upon a pole or poles which is a self- supported structure, wholly independent of any building or other structure or support, is a pole sign. Pole signs shall be permitted subject to the following jconditions: 1 (a) Pole signs shall only be permitted on lots on 7 which buildings are set back a minimum of 25 feet from Federal Highway . 7 (b) The sign shall be set back 10 feet from any lot 1, line , and 30 feet from the intersection of any two street lines . (c) One ( 1 ) pole sign shall be permitted per deve- lopment , indicating the name of the development and/or the individual uses within the develop- j ment . Development is to mean a business or office facility, including one or more uses, not necessarily owned by one party or a single land owner, which are adjacent to and utilize a common parking area or areas . The sign shall not exceed ° 12 feet in height or 25 square feet in area. (2 ) Flat Wall Signs : Flat wall signs may be erected parallel to the face of, or on the outside wall of , any building and supported throughout � their length by such wall . Flat wall signs shall be permitted subject i to the following conditions : (a) A flat wall sign shall extend no more than 18 i inches beyond the building face. i (b) Total flat wall signage shall not exceed 2. 5 square feet per each one ( 1 ) linear foot of building frontage, subject to the additional requirements: i . Signs shall not exceed a vertical dimension of 2. 5 feet, a horizontal dimension of 15 feet, and a total sign area of 40 square feet. ii . Signs shall be set back at least one ( 1 ) foot from the edge of a building or store. (c) Wording on flat wall signs shall include only the name of the business which is currently operating within the building or storefront to which the sign is attached . Such wording shall not exceed a 24 inches in height . (d) A maximum of one flat wall sign shall be permit- ted per building or storefront business , pro- vided when a building abuts a side street, one additional flat wall sign, in accordance with this section, shall be permitted on the side 1 street . i -2- i l (e) Flat wall signs shall be located only in that portion or the parapet above the awning and/or entranceway and below the roofline . In multi- story buildings, said signs shall be located only between the first floor awning and/or entranceway and the second floor window. ( 3) Projecting Pedestrian Signs: Projecting signs located below a first floor window { shall be permitted subject to the following requirements : j (a) Each store shall be permitted one sign, not to exceed 38 inches by 12 inches, and located a j minimum of 7 feet 6 inches above the sidewalk, i and 2 feet from the curb line. (b) Each sign shall consist of 1/4 inch plexiglass D.R. pan formed plastic , suspended from the underside of the awning carriage. i ( 4 ) One Nameplate Identification Sign shall be permitted on or near the front and/or rear door of the business being conducted on the premises, with sign area not to exceed four square feet . ( 5 ) "For Sale" signs, "For Rent" signs, and "Construc- tion" signs, shall be as per Section 3-33 of the City Code. (6 ) A1.1 other signage, including painted wall or awning signs, shall be prohibited. SECTION 3: OVERLAY BOUNDARIES. I i 3. 01 : Area bounded generally by: Old Griffin Road on the North; by Third Avenue on the West ; by Stirling Road on the South ; and on the East by Third Avenue south of Dania Beach Boulevard and Fronton i ' Boulevard north of Dania Beach Boulevard. r SECTION 4: REVIEW PROCEDURE. 4. 01 : All signs shall receive approval of plans by City of i Dania Building & Zoning Department with appeal of adverse decisions to Y be decided by the City Commission. t SECTION 5: COMPLIANCE REQUIRED. 5. 01 : All signs within the Downtown Dania Redevelopment District of the City of Dania , shall be required to comply with the regulations of this Section, as amended, by removal or modification of i same no later than five ( 5 ) years from the final adoption of this i section. SECTION 6: SEVERABILITY: i i 6. 01 : Should any word, phrase , clause, section or subsection of this ordinance for any reason be held invalid or unconstitutional by any court of competent jurisdiction, the invalidity thereof shall not affect the validity of any remaining portions of this ordinance . I SECTION 7: CONFLICT: jI 7. 01: All ordinances or parts of ordinances and all 1 resolutions or parts of resolutions in conflict herewith shall be repealed to the extent of such conflict . SECTION 8: EFFECTIVE DATE. 8. 01 This ordinance shall take effect immediately upon its a passage and adoption. PASSED and ADOPTED on first reading on the 22nd day of March , 1988.
