Home My WebLink AboutO-1988-015 r F7 ORDINANCE NO. 15-83 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA, ADOPTED BY ORDINANCE NO. 100, BY ADDING ARTICLE 17, ENTITLED: "DOWNTOWN DANIA REDEVELOPMENT DISTRICT" ; BY CREATING AN OVERLAY DISTRICT CALLED "DOWNTOWN DANIA REDEVELOPMENT DISTRICT" GENERALLY LOCATED IN THE VICINITY OF FEDERAL HIGHWAY SOUTH OF GRIFFIN ROAD AND NORTH OF STIRLING ROAD; PROVIDING SPECIFIC BOUNDARIES ; PROVIDING FOR APPLICATION FOR PERMITS; PROVIDING FOR ADOPTION OF THE MAIN STREET COMMERCIAL RENOVATION DESIGN GUIDELINES ; PROVIDING FOR SEVERABILITY; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND ! PROVIDING FOR AN EFFECTIVE DATE. . i WHEREAS, the City Commission of the City of Dania, Florida , has determined that it is desirable to enact measures to specifically regulate and provide for the growth and development of the downtown area; and WHEREAS, the City Commission of the City of Dania has determined that the most efficient means of so doing is by the creation of an overlay district. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: SECTION 1 : That the Code of Ordinances of the City of Dania be amended by adding thereto, in their entirety, as follows: DOWNTOWN DANIA REDEVELOPMENT DISTRICT SECTION 00-001: CREATED. There is hereby created the Downtown Dania Redevelopment District hereinafter described as the "DDRD" or the "downtown district" which shall be an "overlay district" whose regulations shall supplement , and be cumulative to, the development regulations of any zoning area situated within the aforesaid district . SECTION 00-002: BOUNDARIES . Area bounded generally by: Old Griffin Road on the North ; by Third Avenue on the West ; by Stirling Road on the South and on the Fast by Third Avenue south of Dania Beach Boulevard and Fronton Boulevard r } north of Dania Beach Boulevard . { -1- 0190 i SECTION 00-003: APPLICATION FOR PERMITS. Any application for a permit for development within the bounds of this district made subsequent to the date of enactment of this ordinance, shall comply with the district regulations contained within this article. The requirements of this section shall apply to, but not be limited in, their application to additions, alterations and redevelopment of existing structures. This section shall, however, not i be construed to require any application for a development permit when such application is not otherwise required by the Code of Ordinances of i the City of Dania. SECTION 00-004: MAIN STREET DESIGN MANUAL. i (A) The Main Street Design Manual , as may be amended, shall serve as a guide to the character and style of all signage, lighting, fencing, site improvements and the exterior of commercial , business, `i office and residential-office buildings. (B ) A copy of the pain Street Commercial Renovation Design i Guidelines is attached hereto, marked Exhibit 'A ' , and made a part hereof by reference. i i SECTION 00-005: REVIEW PROCEDURE. i j (A) Processing of all exterior renovation to and new construc- tion, exclusive of interior renovations, shall be subject to the requirements of Chapters 26 and 28 of the City Code . (B) In addition to the requirements of Chapters 26 and 28 of the City Code, the applicant shall submit the following with the site plan application for work in the downtown district : ( 1 ) Samples of proposed exterior building materials. (2 ) Detail drawings and general specifications for all exterior doors and windows . (3 ) Catalog cuts and general specifications for all exterior hardware , .lighting , drain gutters and metallic building detailing. (4 ) Architectural building elevations including color scheme. , -2- I I SECTION 2: SEVERABILITY. f i 2. 01 : Should any word, phrase, clause , section or subsection of this ordinance for any reason be held invalid or unconstitutional by f any court of competent jurisdiction, the invalidity thereof shall not affect the validity of any remaining portions of this ordinance. ' SECTION 3: CONFLICT. r j I i 3. 01 : All ordinances or parts of ordinances and all lresolutions or parts of resolutions in conflict herewith are hereby I 1 repealed to the extent of such conflict . SECTION 4 : EFFECTIVE DATE. 4. 01 : This ordinance shall take effect immediately upon its passage and adoption by the City Commission.
