HomeMy WebLinkAboutO-1987-008 - . k I `4 ORDINANCE NO. 08-87 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING THE CITY ' S CERTIFIED LAND USE PLAN FROM LOW ( 5 ) RESIDENTIAL AND LOW MEDIUM ( 10 ) RESIDEN- TIAL TO COMMERCIAL, ON A PARCEL OF LAND CONTAINING APPROXIMATELY 34. 8 ACRES MORE OR LESS, AND LOCATED ;( IN SECTION 33, TOWNSHIP 50 SOUTH, RANGE 42 EAST; BOUND ON THE EAST BY BRYAN ROAD AND ON THE SOUTH BY PROPOSED NORTHWEST 2 STREET; LOCATED APPROXI- MATELY 550 FEET EAST OF INTERSTATE 95 AND APPROXI- MATELY 100 FEET SOUTH OF JAMAICA STREET; AND GENERALLY INCLUDING TRACT A, RE-AMENDED PLAT OF HOLLYWOOD PALMS AS RECORDED IN PLAT BOOK 36 , PAGE 46 , OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; PROVIDING FOR SEVERABILITY; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CON- FLICT; AND PROVIDING FOR AN EFFECTIVE DATE. a j WHEREAS , the City of Dania has adopted a Land Use Plan Element which has been certified by Broward County, and WHEREAS, the City of Dania wishes to amend the Land Use Plan Element in accordance with Section 163. 3184 , Florida Statutes, and the Broward County Land Use Plan , said amendment area being described as { follows: i APPROXIMATELY 34 . 8 ACRES IN SECTION 33 , TOWNSHIP 50 SOUTH, ( RANGE 42 EAST; BOUND ON THE EAST BY BRYAN ROAD AND ON THE SOUTH BY PROPOSED NORTHWEST 2 STREET; LOCATED APPROXIMATELY 550 FEET EAST OF INTERSTATE 95 AND APPROXIMATELY 100 FEET SOUTH OF JAMAICA STREET; AND GENERALLY INCLUDING TRACT A, RE-AMENDED PLAT OF HOLLYWOOD PALMS AS RECORDED IN PLAT BOOK 36 , PAGE 46, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA. WHEREAS , the adoption of this Ordinance amends and revises those 1 land uses set forth in Ordinance No. 252 adopted on December 9 , 1980. i NOW THEREFORE , BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY i j OF DANIA, FLORIDA: Section 1 . That the map portion of the City of Dania Land Use Element is hereby amended to reflect those uses depicted in Exhibit A i i attached hereto and made a part hereof. 3 Section 2. In the event that any section or provision of this Ordinance, or any portion thereof , and paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid , such ; decision shall not affect the validity of the remainder hereof , as a , � J i .l whole or part thereof, other than the part declared to be invalid i j Section 3 . That all ordinances or parts of ordinances and all i resolutions or parts of resolutions in conflict herewith be and the j same are hereby repealed to the extent of such conflict. j Section 4 . This ordinance shall not become effective immedi- ately, but shall become effective upon the happening of the latter of: i I (a) Recertification by the Broward County Planning Council ; j or (b) Adoption of County Land Use Plan Amendment by the I Broward County Commission. I In the event that recertification is rejected , altered or modified, j Jj or that the proposed County Land Use Plan amendment is rejected , altered or modified, as may be applicable, this ordinance shall be void and of no effect.
