HomeMy WebLinkAboutO-1987-003 j j F7 i ORDINANCE N0. 03-87 I AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, ANNEXING TO THE CITY OF DANIA CERTAIN PROPERTIES DESCRIBED AS LOT 5 , BLOCK 1 OF WILMA MANORS PER PLAT RECORDED IN PLAT BOOK 31 , PAGE 4 , OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, LESS THAT PORTION DESCRIBED AS FOLLOWS : COMMENCE AT THE SE CORNER OF THE NE 1/4 OF SECTION 29 , TOWNSHIP 50 SOUTH , RANGE 42 EAST; THENCE ALONG THE EAST LINE OF SAID SECTION NORTH 1 DEGREE 26 MINUTES 01 SECOND WEST 1986. 64 FEET; THENCE SOUTH 88 DEGREES 25 MINUTES 10 SECONDS WEST 35 FEET TO THE NE CORNER OF LOT 3 OF SAID BLOCK 1 ; THENCE ALONG THE NORTH LINE OF LOTS 3 AND 4 OF SAID BLOCK 1 SOUTH 88 DEGREES 25 MINUTES 10 SECONDS WEST 240.03 FEET TO THE NE CORNER OF SAID LOT 5 AND THE POINT OF BEGINNING; THENCE ALONG THE NORTH LINE OF SAID LOT 5 SOUTH 88 DEGREES 25 MINUTES 10 SECONDS WEST 40. 32 FEET TO THE BEGINNING OF A CURVE CONCAVE SOUTHWESTERLY HAVING A RADIUS OF 25 FEET; THENCE FROM A TANGENT BEARING OF NORTH 88 DEGREES 25 MINUTES 10 SECONDS EAST RUN SOUTHEASTERLY ALONG SAID CURVE 33 .42 FEET THROUGH A CENTRAL ANGLE OF 76 DEGREES 35 MINUTES 45 SECONDS TO A POINT OF REVERSE CURVATURE; THENCE SOUTHEASTERLY ALONG A CURVE CONCAVE EASTERLY HAVING A RADIUS OF 5769 . 58 FEET A DISTANCE OF 66. 50 FEET THROUGH A CENTRAL ANGLE OF 00 DEGREES 39 MINUTES 37 SECONDS TO THE EAST LINE OF SAID LOT 5 AND THE END OF SAID CURVE; THENCE ALONG SAID EAST LINE NORTH 1 DEGREE 26 MINUTES 11 SECONDS + WEST 83. 80 FEET TO THE POINT OF BEGINNING; SAID LANDS SITUATE , LYING AND BEING IN BROWARD COUNTY, FLORIDA, TOGETHER WITH ANY INTEREST OF PETITIONERS/OWNERS IN ADJACENT PUBLIC RIGHT-OF-WAY; AND PROVIDING FOR FILING OF COPIES; AND PROVIDING FOR AN EFFECTIVE DATE. i WHEREAS , the owners of that property described hereinbelow have petitioned the City Commission to annex such property to the City of Dania; and 1 WHEREAS, the City Commission has determined that: 1 . Such property, in fact , is owned by the petitioner, RONALD J. GATTO and no others, as evidenced by Opinion of Title submitted by Joseph L. Schwartz , Esquire, Miller & Schwartz , P.A. , dated January 23 , 1987 , a copy of which is attached hereto as Exhibit A; and 2. Such property is contiguous to the City of Dania, Florida , and 3. Such property is reasonably compact; and 4. The annexation of such property will not result in the creation of an enclave; and WHEREAS , the City Commission has determined further that the City can provide necessary municipal services to such property; and WHEREAS, the annexation of such property will be in the best interest of the City of Dania and its residents. i 1 ' i t L a 1 NOW, THEREFORE , BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. Section 2. That the boundary lines of the City of Dania, Florida, be and the same are hereby re-defined to include the land herein described. Section 3. That this ordinance shall be published once a week for four (4 ) consecutive weeks in a newspaper of general circulation within the City of Dania , such publication to occur between the first and second readings hereof by the City Commission. Section 4 . That a certified copy of this ordinance shall be filed with the Clerk of the Circuit Court of Broward County, Florida and with the Department of State of the State of Florida. Section 5. That this ordinance shall be in force and take effect immediately upon its final passage and adoption. PASSED and ADOPTED on First Reading on the loch day of February , 1987.
