Home My WebLink AboutO-1986-040 ORDINANCE NO . 40-86 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING ORDINANCE NO. 16 AMENDING SUBSECTION (J ) , SECTION 4, ARTICLE 3, PART III , AND SECTION 3, ARTICLE 5, PART XII OF THE CHARTER OF THE CITY OF DANIA, FLORIDA, TO ENABLE THE CITY MANAGER TO PURCHASE SUPPLIES, SERVICES, MATERIALS AND EQUIPMENT IN THE AMOUNT OF $7, 500 .00 ; AND PROVIDING FOR THE PURCHASE OF SUPPLIES, SERVICES, MATERIALS AND EQUIPMENT IN AMOUNTS IN EXCESS OF $7 , 500. 00, BUT NOT MORE THAN $15, 000 . 00, WITHOUT COMPETITIVE BIDDING ; AND PROVIDING FOR A BIDDING PROCEDURE FOR PURCHASE OF SUPPLIES, SERVICES, MATERIALS AND EQUIPMENT IN EXCESS OF $15, 000.00, AND ALL CONTRACTS FOR THE CONSTRUCTION, EXTENSION AND/OR IMPROVEMENTS TO ANY CITY UTILITY IN EXCESS OF $1, 000.00; AND PROVIDING FOR PURCHASES DURING UNUSUAL CONDITIONS OR EMERGENCIES ; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT ; AND PROVIDING FOR AN EFFECTIVE DATE . BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORDIA : Section 1 . That Subsection (j ) , Section 4, Article 3, Part III of the Charter of the City of Dania, Florida , be and the same is hereby amended to read as follows : e.� " (j ) To purchase supplies, services, materials and equipment for the various departments of the City government ; and in such capacity he shall have the right to purchase supplies, services , materials and equipment for any department of the City in an amount up to and including seven thousand five hundred dollars ($7, 500. 00) whenever he deems it necessary and proper so to do . All purchases of supplies , services, materials and equipment for the City government in excess of seven thousand five hundred dollars ($7, 500.00 ) and in an amount up to and including fifteen thousand dollars ($ 15, 000.00) may be made by the city manager without competitive J bidding and without advertisement for bids if he is i imv authorized to do so in advance by a resolution adopted by the city commission . Contracts for the purchase of supplies , services , equipment and materials for the city government in excess of fifteen thousand dollars ($ 15, 000.00 ) and contracts for construction, extension and/or improvements of public utilities works in excess of one thousand dollars ($ 1, 000. 00 ) shall not be entered into or let except by authorization and approval of the City Commission, after advertisement for bids in a newspaper published in Broward County , Florida, which is generally circulated within the city limits of the City of Dania , Florida, with such publication to be published weekly for two consecutive weeks with the first publication to be not less than fifteen ( 15 ) days prior to the tl ; reception of bids . However, during unusual conditions or emergencies , the City Commission may, by resolution , authorize the purchase by the City Manager of designated supplies, services , equipment and materials in amounts in excess of fifteen thousand dollars ($15, 000 .00) , without competitive bids and without advertisement for bids ." Section 2 . That Section 3, Article 5, Part XII of the charter of the City Dania, Florida, be and the same is hereby amended to read as follows : "Sec . 3 Approval by City Commission of certain contracts . Contracts for the purchase of supplies, equipment , materials and services for the City i government in amounts up to and including seven I thousand five hundred dollars ($1 , 500. 00 ) may be made by the City Manager, without competitive bidding and without advertisement for bids whenever he deems it necessary and proper to do so . " Section 3 . That except as herein amended, all other provisions of said Parts III and XII of the City Charter shall remain in full force and effect . Section 4 . That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict . 1 3 i Z I Section 5 .
