HomeMy WebLinkAboutO-1985-047 0,1 i ORDINANCE NO. 47-85 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA , AMENDING SECTION 5 . 22 OF ARTICLE 5 , OF CHAPTER 28 , OF THE CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA, TO PROVIDE CHANGES IN HEIGHT REGULATIONS BY THE ADDI- TION OF A NEW SUBPARAGRAPH DESIGNATED (h) ; AND PROVIDING THAT EXCEPT AS HEREIN AMENDED, ALL OTHER PROVISIONS OF SECTION 5. 22 SHALL j REMAIN IN FULL FORCE AND EFFECT ; AND PRO- VIDING THAT ALL ORDINANCES OR PARTS OF ORDI- NANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. i BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: i Section 1. That Section 5 . 22 of Article 5, of Chapter 28 of the 1980 Code of Ordinances of the City of Dania, Florida, entitled, "Permitted Exceptions to Height Regulations" , be and i the same is hereby amended by the addition of anew sub-paragraph (h) to read as follows : 1 "Section 5. 22 : (h) For any and all buildings to be erected in any ,•. zoning district in Dania the permitted height shall not exceed five (5) stories or sixty-two (62) feet , whichever of the two ( 2) shall be the least. " I Section 2. The only permitted exceptions to Section 5 . 22 (h) will be for structures for the housing of elevators , stair- ways , tanks , skylights , ventilating fans , air conditioning or similar equipment required to operate and maintain the building, I radio and television antennae for reception purposes only, church steeples , flagpoles and chimneys may be erected no more than f forty percent (40%) above the footage height limits for the dis- trict within which it is located as prescribed by this chapter; provided, however, that such structures located upon the roof area shall not cover in the aggregate a roof area greater than fifteen percent ( 15%) of the ground floor area of such building i or structure. i Section 3. Permitted exceptions or variances to Section i 5 . 22(h) must be approved by a four-fifth (4/5) vote of the i i membership of the Dania City Commission. J 1 I r i e Section 4 . That except as herein amended, all other pro- visions of said Section 5. 22 shall remain in full force and effect. Section 5. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 6. That this ordinance shall be in force and take effect immediately upon its final passage and adoption. PASSED and ADOPTED on First Reading on the loth day of September 1985 .
