Home My WebLink AboutO-1985-037 ORDINANCE NO. 37-85 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING THE SPECIAL EXCEPTION USES WITHIN THE ZONING CLASSIFICATION RM-2 TO ADD ADULT RESIDENTIAL CARE FACILITY; PROVIDING FOR DEFINITION OF ADULT RESIDENTIAL CARE FACILITY; AMENDING THE SCHEDULE OF USE REGULATIONS TO INCLUDE ADULT RESIDENTIAL CARE FACILITY WITHIN RM-2 DISTRICT; AMENDING THE SCHEDULE OF LOT, YARD AND BULK REGULATIONS, CITY OF DANIA, TO INCLUDE ADULT RESIDENTIAL CARE FACILITY WITHIN RM-2 DISTRICT; PROVIDING FOR PARKING REQUIREMENTS FOR ADULT RESIDENTIAL CARE FACILITY; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Dania, Florida, wishes to provide for meaningful diversity of housing choices throughout the City; and WHEREAS, the City recognizes the need of the City's elderly residents for housing which provides special services for their care; and WHEREAS, the City wishes to provide for the inclusion as a special exception use such housing facilities within the City's zoning regulations for `dew RM-2 District; and WHEREAS, the City recognizes that the demand made by such facilities on the City's municipal services will be less than that of the presently permitted uses within the zoning classifications RM-2. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: SECTION I: That Article 2, §2.20, of the City of Dania Zoning Ordinance be amended to include the following definition: 3.02. Adult Residential Care Facility: Any housing facility for one hundred (100) or more elderly residents situated on property which has direct access to and is adjacent to either a minor arterial containing at least one hundred ten (I101) feet of right-of-way or a principal arterial as designated on Broward County Traffieways Plan, which facility contains units with no more than one (1) sleeping room regardless of the number of accessory rooms including living rooms and bathrooms; and contains a central dining facility which serves at least one (1) full meal per day; and provides central housekeeping services to its residents no less than weekly; and employs a full-time registered nurse on call to the residents; and provides planned i -1- .f F7, activities, which activities may include, but are not limited to, social, educational and recreational activities. SECTION II: That Article 2, §2.10, of the City of Dania Zoning Ordinance be amended to include the following: 21. 1. Dwelling Unit, Adult Residential Care Facility: A room or group of rooms located within an Adult Residential Care Facility designed exclusively or occupied as separate living quarters for no more than two (2) residents and containing no more than one (1) sleeping room regardless of the number of accessory rooms, including living rooms and bathrooms. Adult Residential Care Adult residential care facilities require .5 Facilities. parking spaces per dwelling unit. A dwelling unit for the purpose of this requirement is composed of one (1) sleeping room regardless of the number of accessory rooms including living rooms and bathrooms. -2- J SECTION VI: That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION VII: That this Ordinance shall be in force and take effect immediately upon its final passage and adoption. PASSED and ADOPTED on First Reading on the 13th day of August 1985.
