HomeMy WebLinkAboutO-1985-002 ORDINANCE NO . 02-85 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, f AMENDING ARTICLE 5 . 22 OF CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA, TO PROVIDE CHANGES IN HEIGHT REGU- LATIONS AND AMENDING ARTICLE 6 . 21 OF CHAPTER 28 OF j T HE CE DANIA, FLORID O ORDINANCES OFF-STREET PARKING REQUIREMENTS; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CON- F LICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, I FLORIDA: Section I . That Article 5 . 22 entitled, "Permitted Exceptions to Height Regulations" of Chapter 28 , known and cited as "City of Dania Zoning Ordinance" be and the same is hereby amended by the addition of a new sub-paragraph (g) to read as follows : I { "Section 5 . 22: (g) For buildings erected in C-2 districts on tracts or parcels of land that are in one ownership , that I are not less than five acres in size , floor area total as defined herein , exclusive of floor area Utilized for parkin-, shall be permitted to a ratio of two hundred per cent (200%) of lot area, without limits as to the height of the structure, provided that the following minimum yard requirements , ex- t clusive of parking structures are met : MINIMUM YARDS : All building, except accessory parking structures , sGal1 have a setback of at least 75 feet from any street line and 50 feet from any property line , unless exceeded by the following:f i (a) Along those property lines which abut a single family or low density residential district as defined by the Dania Land Use Plan and which are not separated from the single family or low density residential dis- trict as defined by the Dania Land Use Plan by a minor arterial street or principal arterial street as desig- nated on the Dania Land Use Plan, the minimum required i setback shall be 1. 0 times the building height. (b) Along those property lines which abut an open space district or a residential district as defined by the Dania Land Use Plan other than single family or low density residential as defined by the Dania Land Use Plan and which are not separated from said open space or residential district as defined by the Dania Land Use Plan by a minor arterial street or principal arterial street as designated on the Dania Land Use Plan, the minimum required setback shall be 0 .6 times the building height. I 1 f I I i, i (c) Along those property lines which abut a commercial f district, industrial district , or a minor arterial j street as designated on the Dania Land Use Plan , the j minimum setback shall be 0 .3 times the building height . ! i (d) Along those property lines which abut a principal arterial street as designated on the Dania Land Use Plan the minimum setback shall be 75 feet. MINIMUM YARDS FOR ACCESSORY PARKING STRUCTURES: Ali accessory parking structures , whether or not attached to a main building, shall have a set- back of at least 75 feet from any street line and 50 feet from any property line , or 1 .0 times the parking structure height , whichever is greater . Provided, however , in no instance shall such setback be less than as otherwise provided in this ordinance . j (1) LOCATIONAL STANDARDS : The provisions of this sub- paragraph s a on y apply to those parcels or a portion thereof that : (a) have frontage on and abut Sheridan Street and j are located east of Southeast 2nd Avenue , or; (b) have frontage on and abut Dania Beach Boulevard i and are located east of Fronton Boulevard, or; (c) have frontage on and abut Stirling Road or Griffin Road and are located west of Bryan Road , or ; (d) have frontage on and abut U.S . Highway #1 and are located north of the Dania Cutoff Canal . (2) SITE PLAN APPROVAL: All site plans shall be sub- mitted to the City Commission for its review and approval prior to the issuance of a building permit . All site plans shall show avigation easements . , ? (3) LOT SIZE: No building shall be erected on a parcel es_s tTan 5 acres in area. (4) FLOOR AREA SIZE : Total floor area, exclusive of parking shal t exceed 200% of lot area ex- eluding street right-of-way as indicated by the Dania Future Land Use Plan. " i Section 2 . That the language defining the "Space Required Per Unit" for Use No. 5 of the "Schedule of Off-Street Parking Requirements , City of Dania, Florida" , contained in sub-paragraph (c) of Article 6. 21 entitled, "Off-Street Parking" of Chapter 28 , known and cited as City of Dania Zoning Ordinance , be and the same is hereby amended to read as follows : "Section 6 . 21: i (c) In all projects wherein the required parking is predi- cated on a specific use , the developer shall submit j J� I -2- R j r r ~ 71 F With the site plan a written statement setting forth the use intended and explaining how it will be limited and restricted, together with a statement as to the proposed occupancy load and number of vehicles utilizing parking facilities based upon said occupancy load. In the event any structure obtains a Certificate of Occupancy based upon the foregoing formula for specific f use of said structure, subsequently modifies said use so that it is no longer limited and restricted , then and in that event prior to the issuance of a Certifi- cate of Occupancy for the changed use, there shall be provided off-street parking in the number and amount as otherwise provided in this ordinance for structures not having said limited and restricted use . DETERMINATION OF PARKING REQUIREMENTS FOR NON-SPECIFIED USES : T e City Commission may authorize , or DU11GingS in excess of 200 ,000 square feet , park- ing requirements for specific uses which are not men- tioned in Section 6 . 21 of the Zoning Ordinance nor are similar to uses mentioned in Section 6 .21 of the Zoning Ordinance. Authorization of parking requirements for said specific uses shall be subject to the following: (1) Submission of documentation indicating: (A) Detailed explanation of proposed operation and how said operation related to proposed parking requirement . (B) Site plan, floor plan, tabular analysis or square footage by use, maximum number of employees , visitors , and customers , and hours of operation. (2) Determination by the City Commisison that suffi- cient parking is provided for the proposed operation. (3) Determination by the City Commission that parking is provided in accordance with the city zoning ordinance for alternative building uses should the proposed opera- tion discontinue or become unavailable . " Section 3 . That except as herein amended, all other provisions of said Sections 5 . 22 and 6 . 21 shall remain in full force and effect. Section 4 . That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. I Section 5. That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on First Reading on the 13th day of November, 1984 .
