HomeMy WebLinkAboutO-1983-030 i ; E ORDINANCE NO. 30 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, TO AMEND CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA, BY AMENDING SECTIONS 2 .10 , 5 . 17 and 5 . 30 THEREOF TO DEFINE ALLOWABLE DENSITY AND HOTEL, PERMIT MINOR ADDITIONS ON LOTS WITH EXISTING FIVE FOOT SET-BACKS AND TO PROVIDE REQUIREMENTS FOR SEPARATIONS OF MOBILE HOMES AND TRAVEL TRAILERS IN A MOBILE HOME AND/OR TRAVEL TRAILER PARK; AND PROVIDING THAT ALL ORDI- NANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CON- FLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. i BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That Section 2 . 10 - Definitions , of Article 2 of Chapter 28 of the Code of Ordinances of the City of Dania , Florida, be and the same is hereby amended (a) by adding the following sub-paragraph 19 , which shall read as follows : f _..� 11(19) Allowable Density. Allowable density shall be defined as the result of the number 1 of dwelling units on a particular parcel of i land divided by the area of the parcel of R land expressed in acres . For purposes of I this section, the area of the parcel of land !!!f shall include public right-of-ways , easements , or thoroughfares that shall have been required to be dedicated by any governmental agency, °f during platting as required by the Broward County r t Land Use Plan. " and (b) by amending sub-paragraph 30 thereof to read as follows : "(30) Hotel. A building or structure kept , e used, maintained, advertised as or held out s � to the public to be a place where sleeping a � accommodations are supplied for pay to transient i or permanent guests or tenants in which ten (10) i or more dwelling units are furnished for the accommodation of such guests ; and having or not 1 r!r'' I a �7 v having one or more dining rooms , restaurants , or cafes where meals or lunches are served to it such transient or permanent guests , such sleeping accommodations and dining rooms , restaurants or cafes , if existing, being con- ducted in the same building or buildings in connection therewith. " I I Section 2. That Section 5. 17 of Article 3 of Chapter 28 of the Code of Ordinances of the City of Dania, Florida, be and 1 the same is hereby amended by adding the following sub-paragraph i (c) , which shall read as follows : i I "(c) Side Set-Backs for Single Family Additions . I Minor additions to a single family residential istructure with existing five foot set-backs may be allowed to utilize a five foot side set-back with a maximum twenty foot extension along said five foot side set-back line . Set-backs currently in compliance with side set-back regulations have to be adhered to . This section applies to single family residences only . " Section 3 . That Subsection 530 , Yard Regulations , of IiI ' Article 5 of Chapter 28 of the Code of Ordinances of the City i of Dania, Florida , be and the same is hereby amended by adding the following sub-paragraph 5 . 37 , which shall read as follows : "5 . 37 . SEPARATION BETWEEN ANY MOBILE HOME OR i TRAVEL TRAILER USE. No part of any mobile home or travel trailer, or any addition or appurte- nance thereto shall be placed within ten (10) I f feet of any other mobile home or travel trailer, addition or appurtenance thereto , in any existing or new mobile home or travel trailer park use I located within the City of Dania. No part of any mobile home or travel trailer , or addition I i 1 -2- j or appurtenance thereto, shall be located within twenty-five (25) feet of any accessory or service building or structure used in con- nection with a mobile home park. " Section 4 . That except as herein amended, all other provisions of Chapter 28 of the Code of Ordinances of the City of Dania, Florida, shall remain in full force and effect . Section 5 . That all ordinances or parts of ordinances i and all resolutions or parts of resolutions in conflict here- with be repealed to the extent of such conflict . Sectio n 6 . That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on First Reading on the 8th day Of November 1983.
