HomeMy WebLinkAboutO-1980-234 i ORDINANCE NO. 234 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, PROVIDING FOR AND ESTABLISHING A SCHEDULE OF FEES AND CHARGES FOR STRUCTURAL, PLUMBING, ELECTRICAL, MECHANICAL, MISCELLANEOUS CONSTRUC- :I TION, SITE PLAN AND OTHER DEVELOPMENT SUCH AS DRAINAGE, WATER DISTRIBUTION AND SEWER COLLEC- TION SYSTEMS PERMITS; AND PROVIDING A METHOD OF COMPUTING THE ESTIMATED COSTS OF CONSTRUC- TION; AND PROVIDING OTHER MISCELLANEOUS PRO- VISIONS AND FEES REGARDING INSPECTIONS , RE- INSPECTIONS, FAILURE TO REQUEST FINAL INSPEC- TION, AND FAILURE TO OBTAIN VALID PERMITS; AND PROVIDING FOR INCLUSION IN THE CITY CODE; AND PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND 1 ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. i { WHEREAS, Section 7-2 of the 1971 Code of Ordinances of City of Dania, Florida, promulgated, enacted and ordained by Ordinance No. 1� 580, Sections 1 and 2 , was passed and adopted on June 21, 1971; and i WHEREAS, said Section 7-2 of said Code of Ordinances was sup- plimented by City of Dania Resolution No. 21. 6 passed and adopted on i September 18, 1972 , which adopted by reference the then current fee schedule of the Board of County Commissioners of Broward County, Florida, concerning structural, plumbing, electrical , zoning and , as the fee schedule to be followed by various other fee permits 1 City of Dania; and WHEREAS, on the 25th day of February, 1974 , Ordinance No. 41. 6 was adopted on first reading and on second and final reading, which said ordinance promulgated, enacted and ordained a new section of the said 1971 Code of Ordinances to be known as Section 7-3, which in- creased the fees, as then appearing in said Section 7-2 of said 1971 Code of Ordinances, for each and every category, by an amount equal to 30% resulting in the collection of an additional charge of 30% of the amounts shown for each category in said Section 7-2; and WHEREAS, after an extensive study and review of the existing I fees , charges and regulations concerning same made by the Building i 1 Official of City of Dania with the assistance and advice of the j i City Engineer the results of which have been presented to the City , p d `* fi rein u Commission of City of Dania with the recommendation that a new schedule of fees, charges and regulations concerning same be adopted; i and the City Commission of the City WHEREAS, it is the opinion of i i of Dania, Florida, that the fees to be charged by City of Dania for j permits regarding all structural , plumbing, electrical zoning and other incidental matters should be amended to reflect said recom- mended changes as the same are hereinafter set forth; and WHEREAS , it is the intent of this ordinance to adopt a new schedule of fees, charges and regulations concerning said subject I matter, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That the schedule of fees concerning structural , ,. � plumbing, electrical, zoning and various other premit fees to be charged in City of Dania, Florida, shall be as follows : PERMITS AND INSPECTION FEES 1 . Registration of contractors holding certificate of competency and an occupational license in a community other than the City of Dania. Annual Registration Fee $25 . 00 2 . Each reinspection 10 . 00 STRUCTURAL PERMIT FEES Any person desiring a permit to be issued shall , in addition to filing an application therefore and before such permit is issued, pay a permit fee as required in this section, based on the estimated cost or units of construction. The Building Official may require a verified contract, estimate of cost and/or descriptive date for deter- mining the permit fee . 1 . Failure of licensed contractor to request final inspection on any work shall subject said contractor to payment of a fee of $15 . 00 and an approved final inspection prior to the issuance of any further permits . For any other building work not mentioned in this ordinance the fees required by this ordinance or any other ordinance of the City shall be paid, and all requirements of this ordinance or any other ordinance shall be enforced by the inspectors specifically charged with such enforcement, or by City Employees designated by the City Manager, if not otherwise sepcifically provided for. The said fees shall include payment for the permit and for inspection of the work , after the same shall have been completed. If the Building Inspector shall , upon his inspection after completion of the work or apparatus find that the same does not conform to and comply with the provisions of this ordinance , tie shall notify the contractor or owner, indicating the corrections required; and when he shall be notified that the corrections have been made , he shall again inspect the work or ap- paratus, and when due to any one of the following reasons , a charge -16- J of $10 .00 shall be made for each trip: 1. Wrong address . 2. Condemned work, resulting from faulty construction. 3 . Repairs or corrections not made when inspection is called. 4 . Work not ready for inspection when called. The payment for reinspection fees, correction of workmanship or violations , shall be made before any further permits will be issued to the person responsible for or owing same. "Licensed persons or firms" doing installations or work without a valid permit shall be charged a $60 .00 fee or double permit fee, whichever is greater. "Homeowners" doing their own work without a valid permit shall be charged a double permit fee, as provided for in the South Florida Building Code . Section 2 . If any section, sentence , clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 3 . It is the intention of the City Commission that the provisions of this ordinance shall become and be made a part of the City of Dania Code; and that the sections of this ordinance may be renumbered or relettered and the word "ordinance" may be changed to "section" , "article" or such other appropriate word or phrase in order to accomplish such intentions . Section 4 . That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 5. That this ordinance shall be in force and take effect immediately upon its passage and adoption.
