HomeMy WebLinkAboutO-1979-226 ZKCE t tJYfif}/9 1 i ORDINANCE NO. 226 t i AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING SECTION 3 OF CITY OF DANIA ORDINANCE NO. 112 PASSED j AND ADOPTED ON OCTOBER 12 , 1976 TO PROVIDE ADDITIONAL QUALIFICATIONS AND REQUIREMENTS THAT MUST BE MET BY WRECKER OR TOWING SERVICE COI,- PANIES IN ORDER TO BE PLACED ON TILE APPROVED ROTATION LIST USED BY THE CITY OF DANIA FOR SUCH SERVICES WHEN REQUIRED BY THE CITY OF DANIA; AND PROVIDING THAT ALL ORDINANCES OR PARTS OR ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HERE- WITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 That Section 3 of City of Dania Ordinance No. 112 as passed and adopted on October 12 , 1976 shall be amended to read as follows : "Section 3 That the City Manager shall approve tc be placed on such list a wrecker or towing service which meets the following qualifications: 1 . The owner, presidont or representative of such commercial wrecker service must be physically available within the limits of the city on a daily basis . 2 . The owner , or president, of the com- mercial wrecker service must have a com- mercial garage located in the City of Dania, Florida, with such garage having a sufficient enclosed storage area (with a chain link fence constituting a sufficient enclosure) to store at least eighty (80) wrecked motor vehicles I and at least six (6) indoor storage stalls J ) f tj{ f i r f with all of such storage area being con- tiguous to said garage . 3. The owner, or president, must own within the city limits the site of his i garage or wrecker service, including the area where the storage area is located , in fee simple. 4 . All tow trucks shall have the following equipment: a. The name of the establishment must be lettered in a professional manner on both sides of the vehicles (magnetic sign shall not be acceptable) . b. There shall be a rotor beam type light mounted on top of the wrecker in such a manner LhaL it can be seen from the front, rear and both sides . This light shall be amber in color, and shall not be in operation when a wrecker has been dispatched on a tow call . The rotating amber light will be used at the scene of the tow, and while towing the vehicle back to a compound. No tow vehicle will be equipped with a siren.. C. Amber lights shall be installed on the front of the wrecker, with amber reflectors on the front Sides . d. Rod lights and rcd reflectors shall be installed on the rear and rear sides. e. Dollies . f. Minimum of one (1) four pound CO2 � I fire extinguisher or equal , k . One (1) pair of blot cutters . 1 . One (1) set of jumper cables . M. One (1) four-way lug wrench. n. One (1) flashlight. o. One (1) set of red reflectors . P. One (1) set of three portable reflectors. { q. Five (5) thirty minute fuses . r• Two (2) red flags at least 1 ' x 11 . 5. Wreckers will be classified as follows: a. Class "A" for cars and light trucks will have the following equipment: e t 1 . Tow truck shall have a i minimum manufacturer capacity Of 10,000 pounds OVW. 2. Boom capacity of not less than four (4) tons . 3 . Power winch with a pulling capacity of not less than four (4) tons . 4 . Minimum of two hundred feet (200 ' ) of 3/0 inch cable . 5. Cradle to tow platy or tow -ling to pick up vehicles . Cradle to tow Plate to be equipped with safety chains and so constructed that no further damage will occur when picking up vehicle. I 3 - r r;� 1 ri ANIL j 6 . Dual wheels . b. Class "B" for one and two ton trucks will have the following equipment: 1 . Tow truck shall have a minimum manufacturer capacity of 15,000 pounds CVW. 2. Boom capacity of not less than six (6) tons. 3. Power winch pulling capacity of not less than. ten (10) tons . 4 . Minimum of tyro hundred feet (200 ' ) of at least 7/16 inch cable . 5. Cradle tow or tow sling to pick up vehicle. Cradle tow plate to be equipped with safety chains . 6 . Double booms so constructed as to permit splittings . Each boom to operate independently or jointly. 7. Dual wheels. C. Class "C" semi trucks, house trailers , buses, etc. , shall have the following equipment: 1. Tow truck shall have a minimum manufacturer capacity of not less than 25,000 pounds GVW. 2. Boom capacity of not less than fifteen (15) tons. 3. Power winch pulling capacity of not less than twenty-five (25) tons . - 4 I J I 9 I i F7 .1, 1 4 . Double booms constr cted to permit separating; each boom to operate independently or jointly. 5. Minimum of two hundred feet (200 ' ) of at least 9/16 inch cable. 6 . Airbraken so constructed as to lock all wheels automatically upon failure of same. 7. Cradle tow plate or tow sling to pick up vehicles . Cradle tow plate to be equipped with safety chain. 8. Dual wheels. 6 . The wrecker service owner shall own, lease, or have a sufficient number of Class "A" , "B" and "C" wreckers available to his use , so that he may res- pond to tow calls from the City of Dania Police Department or other departments within thirty (30) minutes , and forthwith proceed to remove any type of vehicle or vehicles from the streets or prop- erty of the City of Dania. 7 . The wrecker service owner shall meet all the requirements of the Florida High,,-Jay Patrol and the Florida Statutes in rendering service as required. 8. All towing vehicles used shall be equipped with two way radio communication system. The communication system shall be between the towing company' s base station and all tow and service trucks utilized in providing police and/or city towing service. I _ 5 - J I 2 9 . That the service shall maintain in favor of the City of Dania such liability insurance as the City Manager shall find necessary, taking into consideration the volume and type of services per- formed pursuant to this ordinance by the service. 10 . The enclosed storage areas required in para- graph 2 above shall be under the personal control at all times of an employee of the service or shall be securely locked, providing in any event that service shall be available to the public for in- spection or retrieval of motor vehicles between the hours of nine and five o ' clock on each day, Monday through Saturday, excepting legal holidays as de- fined by the laws of the State of Florida. " w- • Section 2. Severabili.ty . If any section , sentence , clause or phrase of this ordinance is held to be invalid or unconstitutional by any Court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 3 . Inclusion in code. It is the intention of the City Commission that the provisions of this ordinance shall be- come and be made a part of the City of Dania Code; and that the sections of this ordinance may be renumbered or relettered and the word "ordinance" may be charged to "section." , "article" or such other appropriate word or phrase in order to accomplish such intentions . Section 4 . That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be repealed to the extent of such conflict . Section 5 . That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on First Reading on the 13tb day of 6 - { R i, Novembel 1979 .
