ORDINANCE NO.
AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING
CHAPTER 25 OF THE CODE OF ORDINANCES OF THE CITY OF
DANIA, FLORIDA, ENTITLED "TRAFFIC" BY ADDING SECTION
25-90 TO ENABLE THE CITY OR ITS AGENT TO TRANSMIT TO THE
STATE OF FLORIDA DEPARTMENT OF HIGHWAY SAFETY AND MOTOR
VEHICLES, INFORMATION CONCERNING PERSONS WHO HAVE THREE
(3) OR MORE OUTSTANDING PARKING VIOLATIONS OR PERSONS
WHO HAVE ANY OUTSTANDING HANDICAPPED PARKING VIOLATIONS;
PROVIDING FOR CODIFICATION; PROVIDING FOR SEPARABILITY;
AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES
AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Florida Statutes Section 316. 1967 enables a
municipality, upon passage of an ordinance, to transmit to the
Department of Highway Safety and Motor Vehicles (hereinafter
"Department" ) information concerning persons with three (3 ) or
p more outstanding parking violations or persons with any
J outstanding handicapped parking violations so that the Department
dshall mark the registration record of such persons; and
WHEREAS, the city or its agent is able to provide such
information to the Department on a magnetically encoded computer

tape reel or cartridge, which is machine readable by the
Department's computer as required by Florida Statutes Section
316 . 1967; and
WHEREAS, pursuant to Florida Statutes Section 320.03( 8) , the
Department is authorized to withhold the issuance of any license
plate or revalidation sticker of any person with three ( 3) or more
outstanding parking violations or any outstanding handicapped
parking violat
ions based upon the information provided by the
city; and
WHEREAS, the Department will not issue any license plate or

revalidation sticker until persons with three ( 3) or more
outstanding parking violations or any outstanding handicapped
parking violations obtain releases from the city showing that such
outstanding violations have been paid or resolved; and
WHEREAS, the city manager has recommended to the city
commission that it enact this ordinance in order to facilitate the
possible recovery of approximately several thousand dollars in
outstanding parking fines; and
WHEREAS, the city commission accepts his recommendation and

finds that such an ordinance would promote the health, safety and
welfare of the citizens of Dania.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:

Section 1. That Section 25-9 is hereby added to the Code of

Ordinances as follows:
"Sec. 25-90. Transmission of Information to the Department of
Highway Safety and Motor vehicles.
The director of parking enforcement or his authorized
agent is authorized and required to supply the State of
Florida Department of Highway Safety and Motor Vehicles
(hereinafter the "Department" ) with a magnetically encoded
computer tape reel or cartridge, which is machine readable
by the Department's computer system, listing persons who
have three (3 ) or more outstanding parking violations or
persons who have outstanding violations of Section 25-46 of
the City of Dania Code of Ordinances for parking in spaces
designated for use by disabled or handicapped persons. "
Section 2. That except as herein amended, all other
provisions of said Chapter 25 of the Code of Ordinances of the
City of Dania, Florida, shall remain in full force and
effect.
Section 3 It is the intention of the Dania City

Commissioners that the provisions of this ordinance shall become
and be made a part of the City of Dania Code; and that the
sections of this ordinance may be renumbered or relettered and the
word "ordinance may be changed to "section, " "article, " or such
other appropriate word or phrase in order to accomplish such
intentions.
