AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING CHAPTER ITS 13ENTIRETY CODE OF ORDINANCES EXISTING ARTICLE IV ORDINANCESOF THE CITY OF DANIA, FLORIDA, ENTITLED "GARBAGE AND TRASH" ; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO ° EXTENT F H A ND PROVIDING FOR ANEFFECTIVEDATERETROACTIVETO OCTOBER 1, 1991. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That the existing Article IV, Chapter 13 of the ,M Code of Ordinances of the City of Dania, Florida, be and the same a is hereby amended in its entirety to read as follows: "Sec. 13-68. Definitions. 3 Containerized Service, as used herein, shall mean service by a detachable container designed or intended to be ; I mechanically dumped into a packer type truck in excess of eighty (80 ) gallon capacity. Garbage, as used herein shall mean and refer primarily to food wastes consisting principally of animal and vegetable matter, subject to decay, and sacks, cans or tins used for the purpose of storing or containing foods, meats and , vegetables . Trash, as used herein shall mean and refer to grass cuttings, tree branches and shrubbery trimmings which are contained in plastic bags or containers not exceeding 32 gallons . Bulk Trashes as used herein shall mean and refer to furniture, appliances, concrete rubble, mixed roofing material, rock, gravel and other earthen materials, equipment, wire and cable and other acceptable material defined in the agreement between the City of Dania and Reuter Recycling of Florida, Inc. under "Acceptable Waste" . Bulk Yard Trash, as used herein, shall refer to all large cuttings of vegetative and wood matter which are a part of normal yard maintenance. 37-91 Ordinance No. Trash excluded from regular pick up, as used herein shall mean tires, batteries, nny materials considered hazardous by county or state ordinances, bulk trash and bulk yard trash over 6 cubic yards and trash as defined in the agreement between the City of Dania and Reuter Recycling of Florida Inc. under "Unacceptable Waste" . Residential site/unit, as used herein shall mean the lot or parcel of land on which is constructed a single-family home. Multiresidential family buildings, as used herein, shall be any structure or combination of structures situated on adjacent or contiguous land and designed to be occupied, in whole or in part, as the residence or living quarters of more than four (4 ) families at the same time. Multiresidential unit,_ as used herein, shall be that part of a multifamily residential building designed to be occupied, in whole, or in part, as the residence or living quarters of not more than one family at the same time. Such residential units shall not include mobile homes which are located within a duly licensed mobile home park and shall not include a residence that adjoins or is a part of a building from which a duly licensed business is conducted or operated. Multifamily residential buildings which are a part of a cooperative apartment, townhouse, condominium or similar( 5) imilar kdevelopment with a combined total of .five ( or more residential units shall not be included in the deff or of ' a multifamily residential unit or building. Pickup Point, as used herein, shall mean a particular location on a lot or parcel of land which is designated by the city manager after conferring with the contractor collecting such garbage or trash for the pickup of garbarge or trash which unless otherwise designated shall be a location within one foot of the lot line adjoining a public right-of-way. Time of Pickup, as used herein, shall mean between the hours of 7 :00 a.m. and 7 :00 p.m. Collection of garbage and trash on Sunday is prohibited except between the hours of 10:00 a.m. and 4 :00 p.m. Sec. 13-69. Service provided by city. 1. Solid Waste (a) For each residential and multiresidential unit containing no more than four (4 ) units the city shall provide, twice a week, unlimited pick up of garbage and trash as described hereinabove, which is contained in thirty two ( 32 ) gallon garbage cans or plastic bags. However, structures containing 4 units shall have the -2- 37 -91 Ordinance No . _ option of city provided pickup or contracting with a private sanitation company for containerized service or trash removal. (b) Multiresidential structures containing four (4 ) units or more must use containerized service provided by a private licensed sanitation company, except for those 4 unit structures that have chosen the option of city provided service. 2. Bulk Trash Pickup (a) For all residential and multiresidential units containing no more than four (4 ) units, the city shall provide pick up, once a month, of bulk trash as defined hereinabove. However, structures containing four (4 ) units shall have the option of city provided pick up or contracting with a private company for trash removal. ^• ,., (b) The maximum amount of bulk trash to be picked up shall be six (6) cubic yards (approximantely 5 ' x 61 ) per residential unit. Trash exceeding the maximum cubic yards will require a special pickup as described hereinbelow. i 3. Bulk Yard Trash Pickup ' (a) For all residential and multiresidential units icontaining no more than four (4 ) units, the city shall provide chipper service, once a month, of bulk yard trash as described hereinabove. However, structures containing four (4 ) units shall have the option of city provided pick up or contracting with a private company for trash removal. ^ j (b) The maximum amount of bulk yard trash to be disposed of shall be 6 cubic yards (approximately 5' X 61 ) per residential unit. Trash exceeding the maximum cubic yards will require a special pickup as described hereinbelow. 4. Scheduled Pickup (a) Bulk Trash and Bulk Yard Trash as described hereinabove, must not be put out for pick up prior to the Friday immediately preceding the week that pick ups are scheduled in designated areas. 5. Special Pickup (a) Special trash pick ups are available for resident owner or occupants that do not wish to wait for a regular pick up in their area or have in excess of the -3 37-91 Ordinance No. w; cubic yards provided for in this ordinance. (b) Trash for special pick up must be kept separate from trash for regular pick up* if this stipulation is violated, the city will notify owner or occupant of the necessity of a special pick up and the charge based on the combined volume of trash. Monthly fees for regular pick up of garbage, bulk trash and bulk yard trash, are payable regardless of occupancy. 9 , illegal dumping of trash throughout the city shall result in a fine up to $500.00 and/or six ( 6 ) months in jail. 10 . The amount of the collection fee imposed in this ordinance for the collection and disposal of garbage and trash is hereby declared to be a debt due to the city, and person rny equired under the terms of this ordinance to have any accumulation of garbage and trash removed and dispose amount offtat any time shall be liable to the city such ee shall o collectionle P therefor and in any court of competenturisdicationnthecaseof the cost. of collection and the amount of garbage and trash, _q_ 37-91 Ordinance No . �— i Gi collection fee shall constitute a lien against the premises to the same extent and character as the lien for special assessments and with the same penalties and with the same rights of collection, foreclosure, sale, or forfeiture as obtained by special assessment liens and may be enforced in the same manner by the city. This will not apply to charges for special pickups charged directly by the city contractor. Sec. 13-70. Containerized Service. To those multiple residential units using containerized service, the owner or occupant shall contract with a private contractor as provided for in Ordinance No. 22-91 for the use of private disposal systems using containers having a capacity of 80 gallons or larger, or otherwise legally dispose of garbage or trash by means other than city provided services. Sec. 13-71. Pickup Time. All collection of garbage and trash shall be done between 7:00 a.m. and 7 :00 p.m. Collections of garbage and trash on Sunday is prohibited except between the hours of 10:00 a.m. ; i a and 4 :00 p.m. . 3 Sec. 13-72. Refunds and Adjustments of Garbage and/or j Trash Pick Up Charges. 'J Any and all applications or requests for refunds or adjustments of garbage or trash pick up charges must be filed with the city clerk-auditor no later than sixty ( 60) days from and after September thirtieth of each fiscal year, with such refunds or adjustments limited to charges made and paid during that fiscal year. I Sec. 13-73. Reward for Certain Information. The city will pay an award in the amount of twenty-five ' dollars ($25.00) to anyone furnishing information that leads to the apprehension of anyone illegally dumping tires within the city limits. Section 2 . That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 3 . BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . Charges h, For the bi-monthly charge of $37 .70 per unit, the city shall provide the following sanitation and trash services for each residential and multi-residential structure containing no more than 4 living units . However, structures containing four (4 ) units shall have the option of city provided pickup or contracting with a private sanitation company for containerized service or < trash removal. i 2 .
