AN ORDINANCE OF THE CITY OF DANIA, FLORIDA AMENDING
CHAPTER 18 OF THE CODE OF ORDINANCES OF THE CITY OF
DANIA ENTITLED "PENSIONS AND RETIREMENT" TO CHANGE THE
AMOUNT OF THE MONTHLY RETIREMENT BENEFIT FOR BROWARD
SHERIFF'S OFFICE DEPUTIES AND LAW ENFORCEMENT OFFICERS
ACTIVELY PARTICIPATING IN THE DANIA POLICE AND
FIREFIGHTERS RETIREMENT SYSTEM RETIRING AFTER OCTOBER 1,
1991; CHANGING THE RETIREMENT AGE; CHANGING THE AMOUNT
OF EMPLOYEE CONTRIBUTIONS TO FUND SUCH BENEFITS;
CHANGING THE EARLY RETIREMENT AGE; PROVIDING FOR A
DEFERRED RETIREMENT OPTION PLAN; PROVIDING THAT ALL
ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR
PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO
THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the deputy sheriffs and law enforcement officers
employed by the sheriff of broward county who currently
partici ate in p the City of Dania Police and Firefighters
y 4 Retirement System have requested that the benefits

provided by the
system be increased and are willing to increase their employee
}, 1 contributions to the system by the amount sufficient to adequately
fund such benefit increases; and
WHEREAS, the city commission wishes to make such increased
benefits available at the participants expense; and
WHEREAS, the city receives and pays over to the retirement
system monies from the State of Florida pursuant to Chapter 185 of
the Florida Statutes which monies are required to inure to the
benefit of law enforcement members.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1 . That Section 18-42(2) (b) of Chapter 18 of the
Code of Ordinances of the City of Dania, Florida is hereby amended
to read as follows :

to seven percent (7%) of their respective earnings. All
firefighter members of the retirement system shall make
regular contributions to the fund at the following rates
based upon their respective earnings:

Dania in lieu of payroll deductions from police members '
earnings provided that the total of such police employee
contributions paid by the City of Dania plus the
employer contribution for police members made pursuant
to Section 18-44 (3) hereof shall not exceed the amount
which the Sheriff of Broward County would have paid on
behalf of said police members had they elected to joint
the Florida Retirement System. Should the total
employer and employee contribution rate for police
members for any year exceed the prevailing contribution
rate to the Florida Retirement System for that year, the
difference shall be paid by the police members by
payroll deduction from each employee's Broward Sheriff' s
Department earnings . The city and each police officer
participant shall enter into a written contract
providing for their respective obligations and rights as
provided herein. No members shall have the option of
choosing to receive the contributed amounts directly
instead of having them paid by the city directly to the
system. All such employee contributions by the city
shall be deemed and considered as a part of the member' s
accumulated contributions of members. This city "pick
up" of contributions is intended to comply with section
414 (h) (2 ) of the Internal Revenue Code. the employee
contributions of police and firefighter members shall be
computed and accounted for separately.
(b) Duration
Contributions which are deducted from employees'
earnings shall be deducted from said earnings before the
same are paid and together with those employee
contributions which are "picked up" and paid by the city
shall continue until the member has reached his normal
retirement date or his maximum retirement benefit level,
whichever occurs first, after which the employee
contributions shall cease and the picked up
contributions shall be paid directly to the employee as
part of the employee' s wages. "
Section 3. That Sections 18-41(2 ) (c) of Chapter 18 of the
Code of Ordinances of the City of Dania, Florida is hereby amended
to read as follows:
" (c) Authorization of the applicable payroll
deduction payable to the system, and. . . "
Section 4 . That Section 18-44 ( 3 ) of Chapter 18 of the Code
of Ordinances of the City of Dania, Florida, is hereby amended to
add the following sentence at the end of Section 18-44 (3) :

Sect_ Section 18-43 of Chapter 18 of the Code of
Ordinances of the City of Dania, Florida, is hereby amended
. � to re-number the current Section 16-43 as Section 18-43(a) of
this amended Section 18-43 and to add the following as (b) :
" (b) Deferred retirement option plan for police
' officers.
A police member may enter into the Deferred
Retirement Option Plan (DROP) which plan is to be
created and administered by the Board of Trustees of the
Fund on the first day of any month following the
completion of twenty-five years of credited service. A
member will no longer be required to make contributions
to the plan or, at his option, may be permitted to make
reduced contributions to the plan, and his retirement
benefits will accrue to his benefit through a separate
fund administered by the Board of Trustees. Police
members electing to participate in the DROP plan whose
contributions to the retirement system are either
discontinued or reduced shall receive a return of any
contributions made to the retirement system on their
behalf after the commencement of their participation in
the DROP plan or, at the member' s option, said
contributions shall be deposited into the separate fund
administered by the Board of Trustees. The DROP plan to
be created and administered by the Board of Trustees
must be created and administered in such a way as to not
increase the city's contributions to the retirement
system. "

for parity relating to retirement benefits for firefighter members
and law enforcement members in the future which may result from
future contract negotiations between the city and any employee
group.
