ORDINANCE NO. 16-91
AN ORDINANCE OF THE CITY OF DANIA, FLORIDA,
AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES
OF THE CITY OF DANIA, FLORIDA, BY ADDING
ARTICLE VI THERETO ESTABLISHING A MARINE
ADVISORY BOARD; AND PROVIDING FOR THE TERM OF
MEMBERS, RULES OF PROCEDURE AND DUTIES; AND
PROVIDING THAT ALL ORDINANCES OR PARTS OF
ORDINANCES AND ALL RESOLUTIONS OR PARTS OF
RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED
TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING
FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA:
Section 1. That Chapter 2 of the Code of Ordinances of the
City of Dania , Florida, be and the same is hereby amended by
adding Article VI thereto which reads as follows : 9
4, "ARTICLE MARINE ADVISORY BOARD
Sec. 2-119. Established.
There is hereby established a marine advisory board
to serve in an advisory capacity to he city commission.
-' Sec. 2-120. Compensation; term.
The members of the marine advisory board shall
serve without compensation, and each member shall serve
for a term of one (1 ) year from the date of his
appointment.
Sec. 2-121. Rules of procedure.
The marine advisory board shall be governed by the
following rules of procedure:
( 1 ) The board shall select its own chairman and
secretary, unless the chairman is designated
by the city commission.
( 2 ) It is suggested that the board meet not less
than once each month, and more frequently if
the press of business requires. Notice to the
members shall be given by the chairman or his
representative.

(3 ) Absence by any board member from four (4 )
consecutive meetings shall constitute an
automatic resignation of such member unless
his absence is excused for good cause by
majority vote of other members of the board
present and voting .
(4 ) A majority of the members of the board shall
constitute a quorum at any ni-eting of the
board, but no action shall be binding when
taken by the board except at a meeting as
provided in this section and duly recorded in
the minutes of the meeting .
(5) A record of the proceedings of the board shall
be made and kept in the offices of the board' s
secretary and shall be open to inspection at
all times.
(6) All meetings shall be open to the press and
general public and all persons desiring to
`, ,.♦ appear before the board shall be given
reasonable time to present their views on any
._ matters being considered by the board.
(7) The chairman shall act as presiding officer at
all meetings of the board but may designate
another member to preside as chairman pro tem
during the chairman' s absence .
j (8 ) A written report shall be submitted to the
d city commission not less than once each
a � three month period setting forth the matters
considered by the board along with the board' s
recommendations to the city commission. A
copy of the minutes of each meeting shall be

submitted to the city manager.
Sec. 2-122. Duties.
The marine advisory board may consider any subject
matter it considers appropriate and in addition, is
specifically directed to consider and make
recommendations on the following subjects:
( 1 ) Conditions of waterways and needed
corrections, including a study of the most
feasible and economical method of maintaining
the depths of waterways within the city.
( 2) Waterway safety and traffic control on
waterways.
(3 ) Activities of waterways patrol .

(4 ) Operation of privately owned marinas.
(5) Operation of small boat docking areas.
(6) Hurricane procedures.
(7 ) Instructional schools.
(8 ) Relations with the Coast Guard .
(9) Regulation of waterskiing and surfboarding .
( 10) Operation of the excursion boats.
(11 ) Operation of the charter fishing fleet.
( 12) Regulation of boat docking in public navigable
waters.

launching , docks, etc.

( 16) Sanitation problems and proposed laws

Section 3. Except as herein amended , all other provisions of

said Chapter 2 of the Code of Ordinances of the City of Dania ,
Florida, shall remain in full force and effect.
Section 4. That all ordinances or parts of ordinances and
! all resolutions or parts of resolutions in conflict herewith be
and the same are hereby repealed to the extent of such conflict.
Section5• That this ordinance shall be in force and take
effect immediately upon its final passage and adoption.
