Home My WebLink AboutO-1991-014 ORDINANCE NO. 1414-9_91---- AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, REGULATING THE ERECTION OF BILLBOARD ADVERTISING SIGNS IN THE CITY F DANIA; PROVIDING FOR CODIFICATION; PROVIDING FOR SEPARABILITY; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR RESOLUTIONS IN CONFLICT H PARTS HEREWITH TH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS , City Ordinance No. 261 passed and adopted on final reading on April 28, 1981 , prohibited the erection of billboard advertising signs within the corporate limits of the City of Dania, Florida; and 1A WHEREAS , since the enactment of said Ordinance No. 261 , corporate limits of the city have been substantially enlarged and extended; and , 1 WHEREAS , it has been determined by the city commission that the prohibition of the erection of billboard advertising signs should be extended to all areas of the City of Dania except on a Ifederal-aid primary highway or on an interstate highway. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMPASSION OF THE CITY OF DANIA, FLORIDA: Section 1. Purpose. The purpose of this ordinance is to establish reasonable regulations for the erection of billboard advertising signs in the City of Dania, Florida, in order to: (a) balance the right of individuals to identify their businesses and convey their messages and the right of the public to be protected against the unrestricted proliferation of billboard advertising signs; (b) further the objective of the comprehensive plan; Ordinance No. 14-91 i 4- Y (c) facilitate the creation of an attractive and harmonious community; (d) protect the public health , safety and welfare; (e) reduce traffic hazards; and ( f) protect property values. Section 2. Definitions. As used in this ordinance unless the context otherwise indicates : "Billboard advertising sign" shall mean a sign designed for the application of letters , numerals, symbols , characters or illustrations by painting , light , projections , bills or posters which is to be changed regularly, periodically or frequently. Billboard advertising signs advertise goods, products, or ' services not sold on the premises on which the sign is located. The terms "billboard" , "off-premises sign" , and "outdoor advertising sign" may be used interchangeably. M i Section 3 . Prohibition. It shall be unlawful to erect a i billboard advertising sign within the corporate limits of the City w� ?.� of Dania , Florida , except as a special exception use in all C-3, C-4, I-R and I-G zoning classification districts along a federal-aid primary highway or an interstate highway with such I signs to be located at least one thousand five hundred ( 1 , 500 ) feet from any other permitted sign on the same side of the ' highway, and with each said sign being subject to all the provisions of the city building and zoning codes and Chapter 479, Florida Statutes . Section 4.
