ORDINANCE NO. 05-91 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING SECTION 5. 44 OF CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA BY ADDING A SUBSECTION (e) THERETO TO PROVIDE REGULATIONS FOR THE SCREENING OF DUMPSTERS; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That Section 5.44 of Chapter 28 of the Code of Ordinances of the City of Dania, Florida , is hereby amended by adding a subsection (e) thereto which shall read as follows: " (e) The screening of dumpsters shall be installed at all 'lc non-residential developments which shall be achieved through the use of walls and shrubs. Such screening shall be in accordance with the standard design and y '7 engineering specifications maintained in the building department. Such design standards shall provide for a imasonry wall enclosure extending to a height at least a six (6 ) inches above the top of the dumpster with gated vehicular access opening and separate pedestrian opening; a concrete floor and service apron; an exterior appearance which is compatible with the building or buildings it serves; and a location or orientation which facilitates safe vehicular movements, convenience for users and accessibility for servicing vehicles. The ' dumpster enclosure location shall be as follows : I 1. Dumpster enclosure must be located away from project entrances and no closer than twenty-five ( 25 ) feet to any dwelling unit or outdoor recreation area. 2. Dumpster enclosures should be located no further than 150 feet from a building egress point or from any dwelling unit. 3. Locate dumpster enclosures so that collection vehicles do not have to back out into major roads. 4. Orient dumpster enclosures to permit fully mechanically assisted pick-up by front end loading trucks. Ordinance No. 05-91 i i; r 5, When dumpsters are to be serviced from an alley, enclosures should be angled thirty ( 30) degrees and recessed off the alley approximately six (6) feet. The intent of recessing the enclosure is so that gates do not open into the alley obstructing traffic and so adequate sight distance can be maintained." Section 2. Except as herein amended, all other provisions of said Section 5.44 of said Chapter 28 shall remain in full force and effect. Section 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. 11 Section 4.
