HomeMy WebLinkAboutR-1991-019 4i RESOLUTION NO. 19-91 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING AGREEMENT BETWEEN THE CITY OF DANIA AND FRANCISCO PONS, M.D. , FOR SERVICES AS MEDICAL DIRECTOR FOR THE MEDICAL RESCUE DIVISION OF THE CITY OF DANIA, UPON THE SAME TERMS AND CONDITIONS OF THE, EXISTING CONTRACT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE, CITY OF DANIA, FLORIDA: Section 1. That that certain agreement for medical director between the City of Dania and Francisco Pons, M. D. , upon the same terms and conditions which are set forth in the existing agreement for same, a copy of which is attached hereto and made a part �} hereof as Exhibit "A" , be and the same is hereby approved and the q appropriate city officials are hereby directed to execute same . �# Section 2. ADLER, City Attorney Resolution No. 19-91 t EMERGENCY MEDIAL SERVICE MEDAL DIRECTOR AGREEMENT THIS AGREEMENT made this 1st day of April , 1991, between the City of Dania, a Florida municipal corporation , hereinafter referred to as City, and Francisco Pons , M.D. , hereinafter referred to as Dr. Pons. W I T N E S S E T H : the City for WHEREAS, Medical Rescue Services are provided by ts Fire Department, under contract to its citizens by means of i Medical Services: and the Broward County Emergency f delivery of advanced o WHEREAS , the state of the art paramedics trained to the emergency Medical Rescue Services by p EMT-II) , Emergency Medical Technicians level of advanced emergency (Paramedics) , requires intravenous administration of technical i' resuscitative drugs and performances of sophisticated emergency procedure: and it the administration of drugs and performance of such WHEREAS, intravenous emergency procedure as endotracheal intubation, catheterization, electrical defibrllation, and any other invasive i emergency procedure may only be performed by or under the direction of a licensed Florida physician according to the medical practice art of the State of Florida: and advanced Emergency WHEREAS, the City desires to provide Medical Services to its citizens by means of the Dania Fire Department: and 1 ®XHIBIT "A" L � V WHEREAS , the City is required under the terms of Florida Statute 401. 46, to contract with a licensed physician to serve as the City' s Medical Director if the City wishes to provide advanced Emergency Medical Services. NOW, THEREFORE, in consideration of the mutual promises and convenants set forth herein , the parties hereto mutually agree as follows: ARTICLE I - SCOPE OF SERVICES Dr. Francisco Pons shall provide the following services : , � • t" 1. Consult in planning for emergency medical rescue services provided by the Dania Fire Department including recommendation for the provision of vehicles , equipment, t �a supplies, distribution of resources, personnel , emergency i medical technician training, and utilization of medical "j facilities. 2. Consult in the coordination of training of Fire Department li emergency medical technicians, including testing and I certification procedures in conformance with the laws and regulations promulgated by the state of Florida and municipal government. 3. Conduct periodic review sessions with the Fire Department emerge,ncy medical technicians in regards to medical management of individual medical rescue cases. 4. Provide personnel to periodically ride rescue with emergency rescue personnel and provide on-site personnel evaluation and training sessions. 2 i i I } 0.i 1 5. Coordinate hospital and emergency department liaison between the various community hospitals and the Emergency Medical Rescue Service of the Fire Department. 6. Coordinate and supervise the telemetry radio communications of the Dania Fire Department emergency medical rescue units for the purpose of medical supervision of on-site emergency medical care by the paramedics. 7. Provide liaison services between the Dania Fire Department and the various community hospitals utilized by the Broward County Emergency Medical Rescue Service. In addition, provide liaison for the Fire Department to the Broward County Medical Association, the Health Planning Council, Broward Community College, and any other agency or institution " 9 affecting the education of paramedics or community policies regarding the provision of emergency medical services. 8. Coordinate the implementation of quality control procedures for monitoring the quality of emergency medical care to the patients served by the Fire Department emergency medical rescue service and coordinate the establishment of any necessary data collection and research activities necessary to the implementation of such a quality control mechanism. 9. Dr. Pons, or his designee, who must be approved by the Rescue Commander, will provide three hours of training to each shift on a monthly basis. 10. Dr. Pons, or his designee, who must be approved by the Rescue Commander, will give a three hour monthly medical meeting. 3 i 11. Dr. Pons , shall comply with all state guidelines , as they refer to duties and responsibilities of a Medical Director. ARTICLE II CITY AGREES TO THE FOLLOWING: provide administrative liaison 12. The Dania Fire Depa rtment will to Dr. Pons , the medical advisor, through the direction of Chief Thomas D. Grammer and will cooperate to the greatest possible extent in the delivery of competent emergency medical care including implementation of the policies set by +r Dr. Pons and the Rescue Commander. To provide any secretarial assistance necessarily required by Dr. Pons through the office of the Fire Chief. 15. The City will provide limited liability insurance coverage for the Medical Director. Should such professional liability i this insurance coverage for the activities required by ilable for any reason or should the agreement become unava ional liability insurance increase to premium for such profess evel as determined by the City of an unacceptable cost l Dania, it is understood that, subject to the termination provisions herein, the parties may agree to renegotiate the . reimbursement schedule for services rendered. 4 ,. 1 B ' 6i � v inning April 1, 1991 , and 16. This contract shall be in effect beg and will be renewable continuing through September 30 , 1992, l 12 month periods upon agreement of the parties for additiona 21 days prior to the expiration date.
