AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING ARTICLES 1 , TI AND III OF CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA, ENTITLED "FLOOD DAMAGE PREVENTION" ; I` PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. HE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, ++1 FLORIDA: i :section 1 . That Section 12-5 of Article I , Chapter 12 of the ICode of Ordinances of the City of Dania , Florida , be and the same jis hereby amended to read as follows : "Sec. 12-5. DEFINITIONS. Unless specifically defined below, words or phrases used in this chapter shall be interpreted so as to give them the meaning they have in common usage and to give this chapter its most reasonable application : Addition (to an eNisting building) means any walled and roofed expansion to the perimeter of a building in which the addition is j connected by a common load-bearing wall other than a fire wall. 1 Any walled and roofed addition which is connected by a fire wall or i is separated by independent perimeter load-bearing walls is new (( _ construction . E . Appeal means a request for a review of the city's interpretation of any provision of this chapter or a request for a variance . Area of shallow flooding means a designated AO, AH, or VO zone on a community ' s Flood Insurance Rate Map (FIRM) with a one percent s: Seat ,a i . or cireater annual chance of flooding to an average depth of one to K three feet where a clearly defined channel does not exist , where the path of flooding in unpredictable and where velocity flow may be evident . Such flooding is characterized by bonding or sheet flow. Area of special flood hazard is the land in the flood plain i j within a community subject to a one percent or greater chance of flooding in any given year . The area may be designated as Zone A I on the Flood Hazard Boundary Map (FHBM) . After detailed ratemaking has been completed in preparation for publication of the FIRM, Zone A usually is refined into Zones A AO AH Al-30 AE A99 VO or V1--30 , VE or V. Base flood means the flood having one percent chance of being S ; jequaled or exceeded in any given year. 9991' Basement means that portion of a building having its floor subgrade (below ground level ) on all sides . Breakaway wall means a wall that is not part of the structural support of the building and is intended through its design and construction to collapse under specific lateral loading forces without causing damage to the elevated portion of the building or j the supporting foundation system. 7 I ' Building means any structure built for support , shelter, or enclosure for any occupancy or storage. (Also see Structure. ) { ' Coastal high hazard area means an area of special flood hazard M1, extending from offshore to the inland limit of a primary frontal dune along an open coast and any other area subiect to high JI 2 v ;,I W, ' velociLv wave action from storms or seismic sources ._ The area is 'f designated on a FIRM as Zone V1 - 30, VE, or V . The collapse or subsidence of land along the shore I - of a lake or other body of water as a result of erosion or undermining caused by waves or currents of water exceeding anticipated cyclical levels or suddenly caused by an unusually high water level in a natural body of water, accompanied by a severe storm or by an unanticipated force of nature, such as flash flood or an abnormal tidal surge, or , by some similarly unusual and unforeseeable event which results in flooding as defined in paragraph (a) (1 ) of this definition. l Flood Hazard Boundary Map (FHBM) means an official map of a community, issued by the Federal Emergency Management Agency, where the boundaries of the areas of special flood hazard have been defined as Zone A. Flood Insurance Rate Map (FIRM) means an official map of a community, on which the Federal Emergency Management Agency has ` delineated both the areas of special flood hazard and the risk premium zones applicable to the community. Flood Insurance Study is the official report provided by the I , Federal Emergency Management Agency. The report contains flood f profiles , as well as the flood boundary-floodway map and the water 5 MM t :Mr ldce elevation of the base flood . Flood phiin or flood-prone area means any land area susceptible to being inundated by water from any source (see definit.ton of "flooding") . FIorxl�lain management means the operation of an overall program of corrective and preventive measures for reducing flood da_ male, including but not limited to emergency preparedness plans flood control works and flood plain management regulations Flood Wain management regulations means zoning ordinances subdivision regulations building codes , health regulations I special purpose ordinances (such as a flood plain ordinance '- grading ordinance and erosion control ordinance) and other applications of police power. The term describes such state or 1 local regulations, in any combination thereof, which provide standards for the purpose of flood damage prevention and reduction Flood proofing means any combination of structural and non- structural additions , changes or adjustments to structures which reduce or eliminate flood damage to real estate or improved real property, water and sanitary facilities structures and their contents . Floodway means the channel of a river or other watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than one foot. "I The term does not include the floor of a garage used solely for parking vehicles . Freeboard means a factor of safety usually expressed in feet above a flood level for purposes of flood plain management. Freeboard tends to compensate for the many unknown factors that could contribute to floor heights greater than the height calculated for a selected size floor and floodwav conditions, such I .. as wave action , bridge opening9 and the hydrological effect of I i urbanization of the watershed . I f Functionally dependent use means a use which cannot perform its intended purpose unless it is located or carried out in close proximity to water . The term includes only docking facilities, i port facilities that are necessary for the loading and unloading of cargo or passengers, and ship building and ship repair` facilities but does not include long-term storage or related manufacturing i facilities . Highest adjacent grade means the highest natural elevation of the ground surface, prior to construction , next to the proposed I , walls of a structure. i Historic structure means any structure that is : (a) Listed individually in the National Register of Historic Places (a listing maintained by the Department of tl Interior) or preliminarily determined by the Secretary of the Interior as meeting the requirements for individual listing on the National Register; e r to r o s ( .�a I 1 I I x f (b) Certified or preliminarily determined by the Secretary of the Interior Its contributing to the historical 4 significance of a registered historic district or a district preliminarily determined by the Secretary to qualify as a registered historic district; Individually listed on a state inventory of historic places in states with historic preservation programs which have been approved by the Secretary of Interior; or Individually listed on a local inventory of historic places in communities with historic preservation programs that have been certified either: it By an approved state program as determined by the Secretary of the Interior; or Directly by the Secretary of the Interior in states without approved programs . 1 Mangrove stand means an assemblage of mangrove trees which is f i f mostly low trees noted for a copious development of interlacing ) adventitious roots above the ground and which contain one or more f� j of the following species: Black mangrove (Avicennia nitida) red mangrove (Rhizophora mangle) ; white mangrove (Languncularia racemosa) ; and button wood (Conocarpus erecta) . Manufactured home means a structure transportable in one or more sections which is built on a permanent chassis and is designed for use with or without a permanent foundation when attached to the required utilities The term "manufactured home" does not include a "recreational vehicle" . ,y� l+}�p Ott°.41j4. It is used as a reference for establishing various; elevations within the floodplain. For purposes of this chapter , the term is synonymous with National Geodetic Vertical Datum (NGVD) , to which base flood elevation shown on a community's flood insurance rate map (FIRM) are referenced National Geodetic Vertical Datum (NCVD) , as corrected in 1929 , i is a vertical control used as a reference for establishing varying elevations within the floodplain. New construction means for the purposes of determining i insurance rates , structures for which the "start of construction" commenced on or after the effective date of an initial FIRM or after December 31 , 1979 whichever is later, and includes any subsequent: improvements to such structures For floodplain management purposes , "new construction" means structures for which the "start of construction" commenced on or after the effective date of a flood plain management regulation adopted by a community i and includes any subsequent improvements to such structures New manufactured home nark or subdivision means a manufactured home park or subdivision for which the construction of facilities for servicing the lots on which the manufactured homes are to be affixed ( including at a minimum the installation of utilities the construction of streets , and either final site grading or the i pouring of concrete pads) is completed on or after the effective F M1 r �• � date of floodplain management regulations adopted by a community. 4 rvla `i; t» x Recreational vehicle means a vehicle which is (i) built on a i 9 `I V . F I x I :;inglr. rhasr. is ; ( ii ) 400 :;quaro foet. or ] r•ss uhon me•asure>d at the J largest horizontal Projections ; ( iii ) designed to be self-propelled nr permanently towable by a light duri• truck; and ( iv) designed primarily not for use as a permanent duelling but as temporary (� living quarters for recreational , camping, travel , or seasonal use. If Sand dunes means naturally occurring accumulations of sand in f ridges or mounds landward of the beach . Start of Construction ( for other than new construction or substantial improvements under the Coastal Barrier Resources Act (Pub. L. 97-348) ) , includes substantial improvement, and means the date the building permit was issued , provided the actual start of construction, repair , reconstruction, rehabilitation, addition, placement , or other improvement was within 180 days of the permit date . The actual start means either the first placement of permanent construction of a structure on a site, such as the pouring of slab or footings , the installation of piles, the I construction of columns , or any work beyond the stage of L i excavation ; or the placement of a manufactured home on a I foundation . Permanent construction does not include land i preparation, such as clearing , grading and filling; nor does it include the installation of streets and/or walkways; nor does it include excavation for a basement , footings, piers , or foundations or the erection of temporary forms; nor does it include the AEI 1.• installation on the property of accessory buildings , such as or sheds not occupied as dwelling units or not_ ) garages P• 9 Part of the . main structure. "Structure" for insurance covers a ur oses means a walled and roofed building other than a gas or liquid storage tank that in princi all above round and affixed to a permanent site as well as a manufactured home on a permanent foundation. For the latter purpose , the term includes a uilding while in the course of construction, alteration or repair, but does not include buildin materials or supplies intended for use in such construction, i alteration or repair, unless such materials or supplies are within an enclosed building on the premises ._ Substantial improvement means any reconstruction, i ^ rehabilitation addition or other im rovement of a structure the 1 y a cost of which equal or exceeds 50 percent of the market value of ,$k#� the :structure before the "start. of construction" of the � fr, k .� im rovement. . This term includes structures which have incurred err substantial damage" regardless of the actual repair work erformed. The term does not however , include either: Any project for improvement of a structure to correct existing violations of state or local health, . sanitary, or safety codespecifications which have been identified by the local code enforcement official and which are the 11 t • L VA r e Mi K. 4 minimum nect!ssary to assure safe living conditions; or j (2) Any alteration of a "historic structure" , provided that l the alteration will not preclude the structure ' s i continued designation as a "historic structure" . I ' , Variance is a grant of relief from the requirements of this - r chapter which permits construction in a manner otherwise prohibited by this chapter where specific enforcement would result in I i unnecessary hardship. Section 2. That Section 12-7 of Article I , Chapter 12 of the Code of Ordinances of the City of Dania , Florida, be and the same is hereby amended to read as follows : j "Sec. 12-7. BASIS FOR ESTABLISHING THE AREAS OF SPECIAL I!j FLOOD HAZARD. The areas of special flood hazard identified by the Federal Emergency Management Agency in its Flood Insurance Rate Map (FIRM) J #120034-001 and 002 , dated jjIl 5, 1983', August 18 , 1992, with I accompanying maps and other supporting data , and any revision i thereto, are adopted by reference and declared to be a part of this chapter . " ;. Section 3 . That Section 12-8 of Article I , Chapter 12 of the j Code of Ordinances of the City of Dania , Florida , be and the same is hereby amended to read as follows : "Sec. 12-8. ESTABLISHMENT OF DEVELOPMENT PERMIT. A development permit shall be required in conformance with the provisions of this chapter prior to the commencement of any development activities including the placement of manufactured 12 r _ - 1j homer: within 7,xu• A on the community ' s FIRM. � )) Section A_ That Section 12-3-1 (d) of Article II , Chapter 1.2 of . the Code of Ordinances of the Cit} Of Dania , Florida , be and the name is hereby amended to read as follows : "Sec. 12-34 . VARIANCE. PROCEDURES. (d) Variances may be issued for the reconstruction, on of historic structures rehabilitation or restorati �-;t,.,�l--RegiaEer-of—H-rstoric—Pl-eiees--or—efi�—^oi�t�,,.venterY—af �. - without regard to the procedures set forth in the r; remainder of this section, except for subsection (h) (1) and (4) , 1 and provided the proposed reconstruction , rehabilitation, or restoration will not result in the structure losing its historical designation and the variance is the minimum necessary to preserve { the historic character and design . " Section 5. That Section 12-34 (h) (3) of Article II , f ' Chapter 12 of the Code of Ordinances of the City of Dania, Florida, j . be and the same is hereby amended to read as follows: "Sec. 12-34. VARIANCE PROCEDURES. (h) (3) Any applicant to whom a variance is granted i shall be given written notice specifying the difference between the base floor elevation and the elevation to which the structure to be built and stating that the cost of flood insurance will be commensurate with the iincreased risk to life and property resulting from the reduced lowest floor elevation. " 13 S Yf :;rrr7t ion 6- That Section 12-51 of Article III , Chapter 12 t of the Code of ordinances of the City of Dania , Florida, be and the =+<une is hereby amended to read as follows: `Sec. 12-51 . GENERAL STANDARDS. In all areas of special flood hazard the following provisions are required: (1 ) New construction and substantial improvements shall be ' anchored to prevent flotation, collapse or lateral j movement of the structure resulting from hydrodynamic and j hydrostatic loads inr_ludin the effects of buo anc . (2) Manufactured homes shall be elevated_ nd anchored to ;..t, prevent flotation, collapse, or lateral movement . Methods of anchoring may include, but are not limited to, use of over-the-top or frame ties to ground anchors . This standard shall be in addition to and consistent with applicable state requirements for resisting wind forces. (3) New construction and substantial improvements shall be 1 constructed with materials and utility equipment resistant to flood damage. (4) New construction or substantial improvements shall be constructed by methods and practices that minimize flood damage, k (5) Electrical , heating, ventilation, plumbing, air- p a �1, K conditioning equipment, and other service facilities �a.a; shall be designed and/or located so as to aJ, prevent water from entering or accumulating within the components e 14 Y d 4 u�iT 4;,,.,. O �.Y y pl during CUnditions of flooding . I (G) New and replacement water supply :systems shall be designed to minimize or eliminate infiltration of flood waters into the system. (7 ) New and replacement sanitary sewage systems shall be `j designed to minimize or eliminate infiltration of flood waters into the systems and discharges from the systems I into flood waters. E (A) On-site waste disposal systems shall be located and i constructed to avoid impairment to them or contamination from them during flooding. (9) Any alteration, repair, reconstruction or improvements to f a structure which is in compliance with the I, provisions of I this chapter, shall meet the requirements of "new f construction" as contained in this chapter. " Section 7 . That Section 12-52 (1) of Article III, Chapter 12 I i of the Code of Ordinances of the City of Dania , Florida, be and the i :same is hereby amended to read as follows : I "Sec. 12-52. SPECIFIC STANDARDS. (1 ) Residential construction. New construction or substantial improvement of any residential structure shall have the lowest floor, including basement, elevated no lower than eight (8) feet NGVD or the base flood elevation as specified on the flood insurance rate map, whichever is greater. Section 8 . That Section 12-52 (3) of Article III , Chapter 12 of the Code of Ordinances of the City of Dania , Florida, be and { ` M the same is hereby amended to read as follows: "Sec. 12-52 SPECIFIC STANDARDS. (3) Elevated buildings. New construction or substantial j improvements of elevated buildings that include fully ' n enclosed areas formed by foundation and other exterior walls below the base flood elevation shall be defined to Vic. (a) Designs for complying with this requirements must either be certified by a professional engineer or i I architect or meet the following minimum criteria: 1 . Provide a minimum of two (2) openings having a total net area of not less than one square `tl inch for every square foot of enclosed area subject to flooding; I 2. The bottom of all openings shall be no higher than one foot above grade; and i 3 . openings may be equipped with screens, louvers , valves or other coverings or devices 1 provided they permit the automatic flow of floodwaters in both directions . (b) Electrical , plumbing, and other utility connections are prohibited below the base flood elevation; �- (c) Access to the enclosed area shall be the minimum necessary to allow for parking of vehicles (garage door) or limited storage of maintenance equipment used in connection with the premises (standard j 18 Ziul �( a 1 (.xterior dour ) nt rrntr� to the living area (stairway or elevator) ; and (d) The interior portion of such enclosed area shall not be partitioned or finished into separate rooms. � Located within areas of special flood hazard ( 4 ) ploodways. l" establishe areas designed as d in section 12-7 , are floodways .
