HomeMy WebLinkAboutO-1992-007 77 '� ORDINANCE NO. 07-92 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, ADOPTING 538. 17, FLORIDA STATUTES SECTIONS 538.03 THROUGH RELATING TO THE REGULATION POF ROVIDING FOR DEALERS FORADDITIONAL INCLUDES PAWNBROKERS) ; A HOLDING PERIOD AND RECORDS OF PROVISIONS RELATING TO TRANSACTIONS; PROVIDING FOR CODIFICATION; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. I 3 BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, %) FLORIDA: k Section 1 . That "Secondhand Dealers , Sections 538.03 through 538. 17 , Florida Statutes, as may be amended from time to time, relating to the regulation of secondhand dealers, which includes pawnbrokers, be and the same are hereby adopted. ion to the foregoing, Section 2 . That in addit the following additional requirements are hereby adopted: j i (a) Holding period. i A secondhand dealer shall not sell, barter, disexchange, alter, adulterate, or in any 30y workine of any secondhand goods within thirty ( ) g - days of the date of acquisition of the goods. Such holding periods are not applicable when the person known by the secondhand dealer to be the person from whom the goods were acquired desires to redeem, repurchase, or recover the goods, provided duce the record of the original the dealer can pro transaction with verification that the customer is the person from whom the goods were originally acquired, and provided that upon redemption, the dealer' s record reflects the signature and original right thumbprint of the redeemer, and the date and time of the redemption. In addition to the record-keeping requirements set forth in section 538.04 , Florida Statutes, secondhand dealers shall also maintain a record indicating the identity of the person to whom the disposition was made, including the date, time, and place of the disposition and the nature and terms of the disposition. The secondhand dealer shall require verification of the indentification by the exhibition of a government-issued photographic identification card such as a driver' s license or military identification card. The record shall contain the type of identification exhibited, the issuing agency, and the number thereon. The above information shall be recorded on the sales receipt. The duplicate of the sales receipt shall be maintained, along with the original record of acquisition kept by the secondhand dealer, and +. shall be made available upon request to any law enforcement officer employed by the Sheriff of Broward County, or any law enforcement officer employed by the municipal jurisdiction within which ! the particular place of business is located. Section 3. It is the intention of the Dania City Commissioners that the provisions of this ordinance shall become and be made a part of the City of Dania Code; and that the sections of this ordinance may be renumbered orrelettered and the word "ordinance may be changed to section, „article, or such other appropriate word or phrase in order to accomplish such intentions. Section 4 . That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. j Section S.
