RESOLUTION NO.
85-92
A RESOLUTION OF THE CITY OF DANIA, FLORIDA,
AUTHORIZING THE EXECUTION OF A PARTIAL RELEASE
OF EASEMENT AND QUIT-CLAIM DEED BY THE CITY OF
DANIA TO TRAFALGAR ASSOCIATES OF SHERIDAN,
LTD. , FOR UTILITY EASEMENTS NO LONGER NEEDED
BY THE CITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, on May 14 , 1986, Dania was granted a Utility �.
Easement by U.S. Lend Lease, Inc. , a Delaware corporation, the
i predecessor in title to Trafalgar, and the Utility Easement was
! recorded on July 23, 1986 in Official Records Book 13585, at Page
291 of the Public Records of Broward County, Florida; and
WHEREAS, Dania' s Utility Easement covers an area larger than
is currently necessary; and F .
WHEREAS, Trafalgar is the current fee simple owner of the
real property located and situated in the County of Broward, State _
of Florida, more particularly described in Exhibit "1" attached

hereto and by reference made a part hereof; and

WHEREAS, Trafalgar has requested Dania to release a portion ;
of the Utility Easement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE p
CITY OF DANIA, FLORIDA:
Section 1 . That the conveyance of the uti.tity easement as
jdescribed in Exhibit "A" hereof from the City of Dania to
Trafalgar Associates of Sheridan, Ltd. , be and the same is hereby {
approved and the appropriate city officials are hereby directed to
execute the attached quit-claim deed prepared for that purpose.
Section 2 . That this resolution shall be in force and take

a municipal corporation organized and existing under the lave of
the State of Florida ("Grantor" or "Dania") and TRAFALGAR l
ASSOCIATES OF SHERIDAN, LTD. , a Florida limited partnership 'i..
("Grentea" or "Trafalgar") whose address is 695 Sheridan Street, .
Dania, Florida ]]004.

-'� RECITALS.
1. On May 14, 1986, Dania was granted a utility -
easement ("Utility Easement") by U.S. Lend Lsaae, -
Inc. , a Delaware corporation, the predecessor in
title to Trafalgar, and the Utility Easement was
recorded on July 23, 1986 1n Official Records Book -
_. 13585, at Pago 291 of the Public Records of Broward
County, Florida.
2. Dania's Utility Easement covers an area larger than -
is currently necessary.

4. Trafalgar has requested Dania to release a portion

NOW THEREFORE, Grantor, in consideration of the sum of ton
Dollars ($10.00) and other good and valuable consideration, to it I
in hand paid by the Grantee, the receipt and adequacy of which are
hereby acknowledged, has abandoned, cancelled, and has granted,
bargained, remised, released, quit-claimed, and sold to the
Grantee, and its successors and assigns forever, all of the right,
'i title, interest, claim, and demand which Grantor has in and to the ! ,
real property described in Exhibit "1". -
To have and to hold the same together with all and singular
the appurtenances thereunto belonging or in anywise appertaining,
and all the estate, right, title, interest, lien equity, and claim t;
whatsoever of Grantor, either in law or equity, to the only proper
use, benefit, and behoof of Grantee forever.
