Home My WebLink AboutR-1992-086 z i RESOLUTION NO. 86 - 92 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING THE REAPPORTIONMENT PLAN OF THE BROWARD COUNTY METROPOLITAN PLANNING ORGANIZATION; PROVIDING FOR SEPARABILITY; PROVIDING FOR COPIES; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 339 . 175( 3 ) (a) , Florida Statutes, requires the Governor of the State of Florida to review the composition of the various Metropolitan Planning Organizations ' memberships at least every five years; and r WHEREAS, the Interlocal Agreement among Broward County and the municipalities of Coral Springs, Deerfield Beach, Fort Lauderdale, «R {� Hollywood, Pembroke Pines, Plantation, Pompano Beach, Sunrise, Davie, k�r Hallandale, Lauderhill, Margate, Miramar North Lauderdale, Oakland Park, and Tamarac and the Florida Department of Transportation provides in Section 12 that no later than four years and four months following the effective date of the Agreement that the MPO would {_' appoint a subcommittee to study the membership of the MPO; and C WHEREAS, the M.P.O. appointed the subcommittee and the subcommittee submitted its recommendation to the M.P.O. and the M.P.O. i approved the recommendation on March 21, 1991, pending guidance from the Governor's office; and WHEREAS, The Governor's letter of April 10, 1992, requested that the Broward County M.P.O. submit a membership reapportionment plan by July 1 , 1992 ; and WHEREAS, Section 12 also requires that "The M.P.O. shall approve a recommendation regarding reapportionment and shall make a good faith 1 effort to obtain evidence that the recommendation of the M.P.O. has Resolution No. 86-92 <uz, ' •,:-n.........-r-:+x{'nvr.+n�.-. .-,.....:. F �r >u J u, r -:1 i been approved by the Board of County Commissioners and by more than fifty ( 50 ) percent of the municipalities in Broward County as well as municipalities representing more than fifty ( 50) percent of the I municipal population within Broward County. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. The M.P.O. has received a recommendation for ff reapportionment from the subcommittee which was appointed pursuant to I Section 12 of the Interlocal Agreement among Broward County and the municipalities of Coral Springs, Deerfield Beach, Fort Lauderdale, Hollywood, Pembroke Pines, Plantation, Pompano Beach, Sunrise, Davie Hallandale, Lauderhill, Margate, Miramar, North Lauderdale, Oakland Park and Tamarac and the Florida Department of Transportation. Section 2. Pursuant to Section 12 of the Interlocal Agreement the I M.P.O. must make a good faith effort to obtain evidence that the i recommendation of the M.P.O. has been approved by the Board of County Commissioners and by more than one-half of the municipalities in Broward County as well as municipalities representing more than fifty , ( 50 ) percent of the municipal population within Broward County. i Section 3 . The City Commission of the City of Dania, Florida, hereby approves the M.P.O. reapportionment plan which is attached hereto as Exhibit "A" . Section 4 . If any section, subsection, sentence, clause, phrase or portion of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such I � _2_ 86-92 Resolution No. n, i holding shall not affect the validity of the remaining portions of this resolution. Section 5 . That a certified copy hereof shall be furnished to the Broward Metropolitan Planning Organization and to such other parties as may be designated by the city manager. Section 6. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 7 . That this resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on the 23rd day of June , 1992.
