A RESOLUTION OF THE CITY OF DANIA, FLORIDA APPROVING THE AMENDED AGREEMENT FOR CONSULTING ENGINEERING AND SURVEYING SERVICES BETWEEN THE CITY OF DANIA AND BERRY AND CALVIN, INC. ; AND AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE SAID AMENDED AGREEMENT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That that certain amended agreement for Consulting Engineering and Surveying Services between the City of Dania and Berry b Calvin, Inc. , a copy of which is attached hereto and made a part hereof as Exhibit "A" be and ' the same is hereby approved, and the appropriate city officials are hereby directed to execute same. „ Section 2. AMENDED AGREEMENT FOR CONSULTING ENGINEERING AND SURVEYING SERVICES WHEREAS, The City of Dania, a municipal corporation, entered into an agreement for consulting engineering and surveying services with Berry & Calvin, Inc. , a Florida corporation, on January 22, 1991; and; WHEREAS, Berry & Calvin, Inc. and the City of Dania are desirous of amending said engineering and surveying services agreement; NOW, THEREFORE, for and in consideration of the promises, 1 mutual undertakings and agreements herein contained and assumed, the jcity and the engineer hereby covenant and agree that said agreement be amended to read as follows 1 . Definitions: The following definitions shall apply: i a. Engineer - Berry & Calvin, Inc. b. City - City of Dania c. General Consulting Engineering Services - general ( . services performed by Berry & Calvin, Inc. where a specific scope of work cannot be defined as outlined in Section 2, paragraph a. below. d. Project Consulting Engineering and Surveying Services - pro7ects performed by Berry & Calvin, Inc. where a specific scope of work can be defined. 2 . Scope of Work: The scope of work performed by Berry & Calvin shall include but not be limited to the following items: a. General Consulting Engineerinq Services - Berry & Calvin, Inc. will perform general consulting services as needed for the city consisting of the following items as directed by the city where a specific scope of work is not easily defined: 1 . Plan review i 2. Water and sewer field tests 1 3. Observe water taps 4 . Provide sewer locations 5. Perform pipeline inspections 6. Perform drainage inspections 7 . Perform roadway inspections 8. Respond to resident complaints. ! 9. Attend meetings with staff on general items ( 10. Attend commission meetings on general items f 11 . Consult with the Utility Department on operations issues. EXHIBIT "A" b. Prolect Consulting Enqineerinq and Surveying Services - l Berry & Calvin, Inc. will provide consulting services to the city for specific engineering and surveying projects with a defined scope of work as directed by the city in- cluding but not limited to: 1 . Roadway design and inspection 2. Drainage design and inspection. 3. Water treatment plant design, upgrade and inspection 4 . Wastewater treatment plant design and inspection 5 . Pump station design and inspection 6 . Water system design and inspection 7. Sewer system design and inspection B. Flood routing 9. Environmental permitting and reports 10. Engineering reports 11. Surveying services 12 . Any governmental permitting and approvals 13 . Any other specific services as directed by the city manager or department heads 14 . Assist in grant applications 3 . Compensation for Services :- Berry & Calvin, Inc. will be ; compensated for services provided to the city in the following manner: a. General Consulting Enqineerinq Services - Berry & Caly n Inc. will perform the general scope of services as outlined in l .c and 2.a of this agreement at the hourly rate described in 3.c below. The billing `- invoices submitted to the city shall include the following: 1. Amount of time billed 2 . Hourly rate 3. Job number and description ., 1 4 . Type of activity (ex: phone call or field inspec- tion 5. Category of General Services provided as outlined in 2 .a of this agreement. b. Project Consulting Enqineerinq - Berry & Calvin, Inc. will prepare the necessary engineering reports; engineering design plans; provide the necessary bid documents; administer construction activities when applicable; assist in permitting activities; and provide any other functions necessary on specific projects as directed by the city, and as outlined in the scope of work. Berry & Calvin, Inc. will provide a lump sum fee ` . to the city as soon as a scope of work is established. The fee will be based on the hourly rates indicated below. C. Hourly Rates - Berry & Calvin, Inc. will perform the work for the city at the following hourly rates : Principal $105.00/hour Associate $ 90.00/hour EXHIBIT "A" Senior Engineer S 80 . 00/hour Engineer $ 60 . 00/hour Junior Engineer S 50.00/hour Survey Associate S 85. 00/hour Senior Surveyor S 75 .00/hour Director of Platting S 55 .00/hour Field Crew Supervisor $ 70.00/hour Survey Crew $ 90.00/hour � . Senior Inspector $ 50.00/hour Field Inspector $ 45.00/hour Computer Technician $ 50.00/hour Technician $ 45.00/hour ' Senior Draftsperson $ 40.00/hour Draftsperson $ 35.00/hour Junior Draftsperson $ 30.00/hour Administrative Secretary $ 40.00/hour Administrative Assistant $ 45.00/hour Clerical $ 30. 00/hour These hourly rates will be applicable through calendar year 1992. Any increase in these hourly rates thereafter will be based on the CPI in effect as of January 1st of each year after notification by Berry & Calvin, Inc. and verification by the city. d. Reimburseable Expenses - The city shall reimburse Berry & Calvin, Inc. for the following items : j 1 . Governmental fee paid out of pocket by the I Engineer. 2. Authorized travel expense j 3. Reproduction costs. 4 . Telephone and fax expense 4 . Ownership of Drawings: Completed tracings, reports and master specifications shall remain in the possession of the engineer but shall be for the use of the city for I projects authorized by the city. { 5. Miscellaneous Provisions : The following miscellaneous 1 provisions shall be applicable to this agreement: 1 a. The engineer will supply the city with proof of adequate comprehensive and professional liability insurance. b. This agreemeent may be terminated by either party with 30 days written notice. All work product accomplished to the date of termination shall be forwarded to the city and the city shall satisfy 1 all outstanding invoices to the time of termination. C. This agreement shall be binding upon the successors r' and assigns of the respective parties hereto. r + � ' d. Invoices will be submitted twice a month and shall be payable within 30 days. ,, EXHIBIT "A" e. Closure: by the parties in consideration of the mutual covenants and d that prom se0 hereto, it is hereby agree I ' the engineer shall furnish professional engineering and surveying services, and the city shall make payment for the same in accordance with the terms and conditions set forth in the agreement, such work as may be directed from time to time by the city and such supplemental agreements as may be appended hereto from time to time by mutual agreement.
