A RESOLUTION OF THE CITY OF DANIA, FLORIDA, {
APPROVING THE LEASE AGREEMENT BETWEEN JOE
MAGGI AND THE CITY OF DANIA RELATING TO LEASE
OF PROPERTY LOCATED AT THE NORTHEAST CORNER OF
DANIA BEACH BOULEVARD AND NORTHEAST FIRST
AVENUE; AND AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE SAID AGREEMENT; AND
PROVIDING FOR AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA: a

Section 1 . That the certain Lease Agreement between Joe
e,
Maggi and the City of Dania relating to lease of property located
at the northeast corner of Dania Beach Boulevard and Northeast 1st
i Avenue, a copy of which is attached hereto and made a part hereof
as Exhibit "A" , be and the same is hereby approved and the
appropriate city officials are directed to execute same.
Section 2 . That this resolution shall be in force and take
effect immediately upon its passage and adoption.

LEASE AGREEMENT
THIS AGREEMENT, made this day of , 1992, by and -
i between JOE MAGGI hereinafter called "Lessor" , and the CITY OF
DANIA, FLORIDA, hereinafter called "Lessee" .
W I T N E S S E T H
FOR AND IN CONSIDERATION of the premises, the parties agree
as follows:
1 . Lessor leases to Lessee the property described in Exhibit
"A" , attached hereto and made a part hereof, to be used only for
public parking of motor vehicles, for a period of two (2 ) years
beginning with the date of this agreement, with options to renew
for one ( 1 ) year periods upon agreement of the parties hereto.
2 . Lessee shall landscape the parking area and shall provide
all maintenance of the area including restriping and resealing, if
necessary, and erect an appropriate sign to acknowledge the
owners ' contribution of the area for use by the public. Lessee
shall not be required to pay rent. If the property should cease
to be used for parking purposes, this lease shall terminate.
3 . The Lessee shall indemnify, defend, save and hold harmless ;
the Lessor from any damages, claims, demands, suits and
liabilities of any nature arising out of, because of, or due to
any accident, happening or occurrence on the leased property.
4 . The Lessee shall not assign this lease or sublet any
portion of the leased property and in no event shall permit any
commercial use. „
i 5. This lease agreement SHALL NOT PE RECORDED in the public
records of Broward County, Florida.
6 . If the Lessor at any time shall have need for any part of
the leased property for his own purposes, Lessor may terminate
this lease as to such part on 30 days notice to the lessee.
IN WITNESS WHEREOF, the parties hereto have caused these
presents to be executed the day and year first above written.
