F l Ah r MINUTES DANIA CITY COMMISSION SPECIAL MEETING SEPTEMBER 11, 1992 I ROLL CALL: Present: Mayor: Bill Hyde Vice Mayor: Bob Mikes Commissioners: Bobbie Grace � John Bertino Robert Donly Asst.City Atty: Tim Ryan City Manager: Robert Flatlet' City Clerk: Wanda Mullikin i 1. Kevin McCabe, Coastal Technology, advised that his comprehensive condition survey of the structural components of the pier in the aftermath of Hurricane Andrew has shown structural damage to the above- water components specifically to bents 5, 8, 12 and 17, which are the expansion pile caps. Mr. McCabe explained that movement and translation has occurred to the pile caps which has caused structural concrete cracking and disruption of the expansion joint material and that damage has occurred to additional beam members not previously noted in the original Southport Dredging Contract. City Manager Flatley confirmed with Mr. McCabe that the damage to the pier is moderate and that Southport ` Dredging (contractor for the pier renovations) could begin to drive piles and proceed with the renovation of the Pier immediately. Mr. Flatley reported that FEMA engineers will be conducting their own survey next week to determine if they agree with Coastal Technology's cost figures on storm damage for reimbursement purposes to the City. jHarvey Sasso, Coastal Technology, advised that the letters received from Southport Dredging expressing concern . for continuing with the renovation of the pier and asking to be held harmless will have to be addressed. Mr. Sasso stated that based on the report so far, it would appear that Southport could start work. Richard Donato, Esq., Southport Dredging, questioned Mr. Sasso on whether there will be additional damage or possible collapse when they begin pile driving? In response to Mr. Donato's question, Kevin McCabe mentioned that John McCloud and Harry Moore (Engineers for Southport Dredging were involved in every stage of the inspection and have copies of all of his field notes. He stated that some a ditional spauling could be expected to some of the very badlyy deteriorated beams or additional cracking to some of the affected pile caps during pile driving; but felt that tliese elements can be overcome during the construction operations and that the pier would not collapse. The same elements that existed prior to the hurricane still exist today and those elements would have to be addressed under any circumstance. Mr. Donato expressed the following points of concern: *Caps at the expansion Joint need repair at this point and this was not part of the original contract nor a contingent element of the original contract; *Two ends of the diaphragms at the expansion joint are broke; *Two caps on the soutlside are broke off; *I%Iany of the diaphragms have cracked and were not noted in the original diagrams; ` "13 of 30 caps need repair and none of those were in the original contract; *In the original contract out of 100 beams, 26 were to be repaired and now there is an additional 8 repairs needed; ,i , *There currently exists a previous repair of approximately 18 jackets on some of the piles and proximately 6 oth have split and he wasn't sure if these were going to be added to the contract as repair items or they are not necessary as they may not be part of the structural component; SPECIAL MEETING 1 SEPTEMBER 11, 1992 _ : t 1y ` M1 p i i , P !J "In the original contract a provision his been included to cover the costs for cracks in the beams needing repair up to 5 1/2 inches and that a provision needs to be addressed on cracks greater than 5 1/2 inches. Vice Mayor Mikes clarified with Coastal Technology that the damage done to the longitudinal beams is repairable and replacement is not necessary. Mr. Donato advised that Southport engineers do not agree that the 1 longitudinals Just need repair as they feel there are three to six of these beams that need to be replaced. Mr. Donato stated that Southport does not want to be held liable should the pile driving collapse the pier and felt them is a need to address the additional work needed that is not covered in the contract. 4 'Discussion of when construction is to begin on the pier ' On behalf of Southport Dredging, Mr. Donato requested to begin work in six months as winter weather conditions may cause additional delays. " Commissioner Bertino agreed that the City must address the additional damage that his occurred due to the hurricane and determine a reasonable cost to be paid to Southport above the original contract amount. Kevin McCabe advised that he submitted a cost estimate on the additional work that is needed to Mr. Moore with Southport. Mayor Hyde confirmed that Southport has a better understanding of the dynamics of the pier now then when they bid the contract as the structure has sustained a major hurricane and collapse has not occurred. City Manager Flaticy questioned Southport on whether they have someone lined up to begin the pile driving immediately and Mr. Donato stated that Southport is ready. He stated that they were lined up to begin August 25th and due to the hurricane this has been delayed. Mr. Donato restated Southport's position that a determination needs to be made on exactly what additional work has to be done, the costs involved and liability outlined. Mr. Donato suggggested to conduct a limited pile driving on 6pilings, with a qualified hold harmless agreement stating that if the contractor took all precautions to ensure that the pile driving operations do not adversely affect the existingg structural components then the remainder of that section could be relieved of liability: Mr. Sasso eYommen d red to use the following prudent precautions during the pile driving operation; to have inspectors full time on site watching all parties for evidence of cracking and for beams going into any sort of failure mode, and to install vibration sensors within the vicinity to measure the extent of vibration. City Attorney Ryan questioned whether there would be additional change orders even after the estimate for additional costs is obtained and whether Southport would remain bound to the liability requirements under the original contract. Mr. Donato stated that if Southport Engineers and Coastal Technology Engineers can come to an agreement on the work that needs to be done and arrive at a price in order to assume liability. The only expungement of liability they are asking for is in the event they are driving pile and concrete starts falling off the pier. Vice Mayor stated his need to see the pictures of the alleged damage to the structure for review before he makes a ( derision. Cty Attorney Ryan clarified that the extension request is actually for 8 months from Mar 3 to the end of October and he quoted the provision in the contract that says that if there are unavoidable delays that the extension is j: going to be in proportion to the amount of the unavoidable delay. So if there has been a 2 or 3 week delay then there should be a 2 or 3 week extension. He didn't feel the Commission was willing to accept an 8 month delay. "In the event construction will not begin immediately, request that the City retain a construction litigation legal specialist to pursue this matter in court. Mayor Hyde suggested to continue this item to the workshop meeting on Tuesday and felt that in accordance with Southport contract that work should begin immediately. Commissioner Bertino reminded Southport that the City needs the pier for a revenue source and completion time 1 is of the essence. He felt that the engineers should sit down and work this out and that court is not the answer. i l John Cavo, Southport Dredging, stated his efforts to negotiate with the City on lowering his original bid proposal, that there has not been a complete set of plans received on the work prior to the hurricane and that the pile cap e caps are has been changed at least three times. Now some of thos split all the way across and by the time plans are finalized that there will be an additional delay.
