1. City Attorney Adler read the tittle of the ordinance for second reading amendin the Dania

Will Allen, Growth Management Director, advised that the land use change is from commercial recreation and
low medium residential to commercial and that the proper advertisements have been published
Ed Stacker, representing Banyan Management Corp., introduced Daniel L. Smith & Associates (consultant for the
permitting process on behalf of Banyan Management Corp.) and confirmed plans for developing a shopping center
on the property,
Mayor Hyde opened the public hearing.
Alex Buchsbaum, Vice President Griffin Civic Association, felt the development will have a positive impact to the f
neighborhood and asked for adoption of the ordinance.
Delores Micelli and Josephine Megna came forward to express the need for developing a shopping center for the
area and encouraged approval.

Hearing no further comments, the Mayor closed the public hearing.
I1 Mr. Stacker advised that the shopping center is estimated at 300,000 square feet.

The Commission took no action on this issue and City Attorney Adler stated that meetings are scheduled in the
next few days with Southport Dredging in regards to them proceeding with the pier renovation project.
3. Will Allen, Growth Management Director, advised that the City has to sign an agreement with the State FM
of Florida regarding reimbursement from FEMA and recommended approval of the resolution that
authorizes the Mayor and City Manager to execute all documents necessary for reimbursement.

4. City Manager Fladey mentioned that most cities have decided to burn the storm debris rather than
disposing of it by other means and that in the beginning when Commissioner Bertino suggested this there
were environmental concerns to resolve.

City Manager Flatley stated that Dania can go with the contractor being used by Hallandale at the lowest cost and
that this cost is reimbursable from FEMA.
Commissioner Bertino commented on the need to check the materials prior to burn for possible contamination.
The Commission generally agreed with the burn and Cliff Taylor advised that he still must obtain approval from
Broward County before proceeding.
5. City Manager Fladey presented a resolution authorizing the Mayor and the City Manager to execute
all documents necessary for application to the Internal Revenue Service relating to auon of the City

of Dania Police and Firefighter's retirement System as a bona fide pension plan within the context of the
Internal Revenue Service Code. Mr. Fladey advised that this has already been approved by the Commission
and that it has become necessary to adopt this resolution.
Vince Thompson mentioned that he presented the Commission with some revisions to comply with IRS
regulations last year and that the Commission adopted them by ordinance. He stated the need to make this
application so that there is no problem with qualifying the plan before IRS.
Commissioner Bertino felt that as long as the City is not required by law to file this application with IRS to leave

The Commission decided to continue this issue to the next regular meeting of October 13, 1992.
This special meeting adjourned.

A Public hearing is scheduled for the 8 :00 p.m September 22, 1992 City
Commission meeting concerning the request for a land use change at the
Southwest corner of Griffin Road and SW 31 Avenue. The request is to
change the existing land use designations of Low Medium Residential p'
(13 . 2 acres) and Commercial Recreation (16 . 6 acres) to Commercial for
the 29 . 8 acre site .
This land use change was authorized for transmittal to the State Land
i Planning Agency, the Department of Community Affairs by Resolution No.
1 120-91 adopted by the City Commission ,on October 8 , 1991 . The
Department of Community Affairs has completed its review of the proposed
comprehensive plan amendment. A letter was sent to Mayor Hyde on July
31 , and received on August 4 , 1992 , copy of the letter is attached. It
indicates no objections to the proposed amendment . The City of Dania
has 60 days or by October 4 , 1992 to adopt , adopt with changes, or
determine that the City will not adopt the proposed amendment .
The recommendation continues to be to approve the amendment . This site
i was annexed to the City of Dania to help provide a commercial tax base
for Dania . Such a development will not cause any adverse impacts on the
site or on surrounding sites . This is evidenced by no objections from
local , county, regional and state agencies. There are adequate services ; i
available to serve the site at adopted levels of service so the proposed t. >.
commercial designation complies with concurrency requirements. j
The County Commission voted 5-1 to approve the change to the
comprehensive plan at their September 14 , 1992 meeting. It should be
noted that there are objections to the proposed change . The objectors ,
from the Harger Hills development on SW 37 Avonne north of Stirling
Road , are really concerned with the approximate 240 acre Oakridge Golf f! _
Course site . The concerns are for conserving open space and oak i
hammocks and keeping traffic off of their street south of the golf j r

needs to be scheduled for the second reading prior to October 3 , in
order to comply with statutes . It is suggested that a meeting be
scheduled for September 29 for the second reading .
This item has received strong support from residents and business west
of Ravenswood Road . Their support was crucial in obtaining approval
j from the County Commission. They should he thanked at the public
hearings . The proposed land use change will lead to review of an
1 approximately 300 , 000 sq. ft . shopping center. The site would need to
be platted, rezoned and site plan approval would be required . The land
use amendment is only the first step toward developing the property.
The City Commission will be seeing more detailed plans in these future

amendment have been distributed to appropriate state, regional
and local agencies for their review and their comments

The Department has reviewed the proposed amendment for
consistency with Rule 9J-5, Florida Administrative Code, Chapter
163, Part II, Florida Statutes, and the adopted City of Dania YJ}Comprehensive Plan. The Department raises no objections to the r�
proposed amendment, and this letter serves as our Objections,Recommendations and Comments Report. 4 .
This letter and the enclosed external agency comments are
being issued pursuant to Rule 9J-11. 010, Florida Administrative Code. Upon receipt of this letter, the City of Dania has 60 +wY
days in which to adopt, adopt with changes, or determine that the
City will not adopt the proposed amendment. The process for
ji adoption of local comprehensive plan amendments is outlined in
8. 163 . 3184 , Florida Statutes, and Rule 9J-11 . 011, Florida Adminis-

Within ten working days of the date of adoption, the City of
Dania must submit the following to the Department: '
1
Five copies of the adopted comprehensive plan amendment; I
A copy of additional changes not previously reviewed;
A copy of the ordinance adopting the amendment; and
A listing of findings by the local governing body, if any,
which were not included in the ordinance.
The above amendment and documentation are required for the
Department to conduct the compliance review, make a compliance
= determination and issue the appropriate notice of intent.
As a deviation from the current rule requirement above, you
are requested to provide one of the five copies of the adopted
amendment directly to the Executive Director of the South Florida
Regional Planning Council to be consistent with recent legisla-
tion. The regional planning councils have been asked to review
adopted amendments to determine local comprehensive plan consis-
tency with the Comprehensive Regional Policy Plan. Your coopera-
tion in this matter is appreciated. (The Department will be
promulgating a rule revision in the near future to implement the
new legislation. )
