The motion passed on the following roll call vote: Commissioner Bertino-yes Commissioner Donly-yes Contntissioner Grace -yes Mayor Hyde- yes i 1. Engineers' and Attorneys' recommendations for Dania Fishing Pier Project. City Attorney Adler advised that the Commission needs to address a Pay Request and a Change Directive as approvc'ci by the attorneys for all the parties involved. (a) Pay Request Kevin McCabe, Coastal Technolo&y, presented Southport Dredging, Inc. Pay Request No. 1 for work performed from August 1 to August 31 covering mobilization and the removal of handrails costs. I A motion was made by Commissioner Donly, seconded by Commissioner Grace to approve the City of Dania Pier Renovation Pay Request No. 1 in the amount of$34,515 subject to the approval of City Manager Flatley. The motion passed on the following roll call vote: Commissioner Bertmo-yes Commissioner Grace-yes Commissioner Donly-yes Mayor Hyde-yes (b) Change Directive A jI For the record, Kevin McCabe read his cover letter and the entire Attachment 1 of Change Directive A. The i pu ose for the Change Directive involved the partial suspension of the language of technical specification 03410- 3.STo to alleviate the Contractors responsibility for replacement of structural damage to the Pier as a result of his construction activities. The document covered the time extension of 65 days and established a new contract price of $655,031.00. City Attorney Adler recommended approval as submitted. A motion was made by Commissioner Bertino, seconded by Commissioner Donly to approve Change Directive A. Insofar as Southport has not responded to this notice and no further work has been performed during the month of September, I am forwarding this to you for consideration. I have reviewed the Contractor's schedule of values and work progress, and payment could be made for the following items: Item 1. The Contractor has requested a change due to his concerns that Hurricane Andrew has caused additional structural damage that is not included with the original contract. As such lie is requesting a total waiver of Contractor Uability for damage to the pier as u result of his construction activities. The Contractor is also requesting a 7 month time extension to complete this contract based on his claim that winter weather will prohibit him from driving any piling. Based on numerous discussions with the Contractor, and our evaluation of apparent structural damage that may have occurred by the hurricane, we could recommend the City consider a temporary partial release of Contractor liability for damage during installation of the first 20 piles as partial performance of the contract. This will determine what, if any, additional damage to the directive will allow the Engineer to authorize the pier may result by construction. This change Contractor to place temporary supports to the pier at two (2) locations if required during pile driving. The cost for this shoring is S25,0W.00. Based on paragraph 10 (a) of the Supplemental General Conditions and other contract documents, we could recommend extending the contract 65 calendar days. This also includes time to allow the Contractor to install shoring. Although the Contractor has indicated that all piling would be installed by water hased equipment which requires calm waters, we could not recommend his time extension claim based on weather condition that have not yet occurred. 11 , We tru%t that this letter and backup documentation are sufficient for consideration by the City 4` Commission.
