City Manager Flatley mentioned the difficulty in dealing with County staff in pursuing negotiations regarding the airport litigation and the City's desire to protect the rights of property owners and tax base in the City. Mr. Flatley advised that the Legislative Delegation will hold a public hearing tomorrow to vote on a proposed deannexation and annexation bill relating to lands that will be turned over to Dania and lands that will be taken away that surround the airport. He advised that Representative Anne MacKenzie has stated her support i of Dania and her willingness to kill the bill if necessary. Commissioner Bertino felt that the proper message for the City to send to the Legislative Delegation is that negotiations are not completed with the County on lands surrounding the airport and that the bill is premature at this time and needs to be tabled. Further Commission comments were expressed on the need for residents to be the first concern and for mitigation to be provided on property buyout in the impacted areas in the Interlocal Agreement. r f SPECIAL MEETING 1 DECEMBER 69 1993 f A motion was made by Commissioner Hyde to deny item 1. Commissioner Hyde restated his motion, seconded by Vice Mayor Mikes, that Vice Mayor Mikes will present a position to the Legislative Delegation that the City has voted down the bill because the City has been negotiating all along with little progress with County Staff and that an Interlocal Agreement must be reached. Commissioner Bertino stated that the City needs to advise the Delegation that the bill is the Interlocal Agreement must be completed and made a premature and needs to be tabled as part of the bill. JCommissioner Hyde amended his motion, seconded by Vice Mayor Mikes, that Vice Mayor { Mikes will state a position to the Delegation that the bill is premature and should be tabled until the Interlocal Agreement is finalized and made a part of the bill and that further meetings should take place between the County and City Commission to identify impacts and mitigating impacts on affected neighborhoods. Commissioner Hyde stressed the need to make it clear that the first paragraph of the Interlocal Agreement should cover the needs of the residents and homeowners of Dania and City Manager Fladey concurred that this has always been the City's first concern. Discussion followed on whether the City should reconfirm their position all along that the runway is not necessary and whether funding should be discussed. It was the general consensus to not jinclude these issues in the Interlocal Agreement. fhe motion to amend passed on the following roll call vote: i Commissioner Bertino - yes Commissioner Hyde - yes Commissioner Jones- yes Vice Mayor Mikes - yes i Mayor Grace - yes A motion was made by Commissioner Bertino, seconded by Commissioner Hyde to pass the motion as amended. The motion passed on the following roll call vote: f Commissioner Bertino - yes Commissioner Hyde- yes Commissioner Jones - yes Vice Mayor Mikes-yes Mayor Grace - yes Commissioner Bertino felt that a poll needs to be conducted in the area to determine what property owners want around the airport and Mayor Grace allowed public comment at this time. Joe Bailey stressed the emotional and physical stress that is placed on the people in the impacted areas relating to the expansion who must try and deal with the loss of their homes. CEMBER 6, 1993 SPECIAL MEETING 2 DE ra,;q AVA i He stated that there is no amount of money that can compensate for the loss and that the City Commission's position with the Legislative Delegation should be to oppose the expansion of the South Runway and nothing else. Commissioner Bertino mentioned that the Commission has taken action to place the City in a financial disadvantage to fight the airport and that people have differences of opinions on what his litigation. Commissioner the Commission should and should not do in ta carlm and and methodical stated that the City must take logical steps in pursuing this issue and to remain in ca when addressing the County. t Vice Mayor Mikes stated that this Commission wants to kill the runway but that there is also it need to pursue a mitigation program that will protect the value on homes in the likelihood f tI at the expansion will go forward since Dania has very little power over the County. City Manager Flatley felt that the airport should pay for a survey to be conducted to poll the residents surrounding the airport to find out what they want and that Dania should have input into what goes into the survey. Cliff lacino presented an overview of the efforts by the City to oppose the airport over the years and commended City Manager Flatley for his leadership skills in representing the City. r Fred Gunther mentioned that the dilemma for property owners is that they are being asked to accept a price for their homes when they cannot replace what they have for the amount that the County is willing to provide and that they cannot sell or upgrade their properties. Kathy Stevens mentioned that a decision needs to be made on whether the expansion is going li to go through or not as prolonging it creates more of a problem to the residents. Mayor Grace informed the public that the Public Hearing will be held tomorrow with the Legislative Delegation at 4:00 p.m., 2600 Hollywood Boulevard. The Commission expressed appreciation to the public for attending tonight's meeting. I. City Manager Flatley advised that there is a possibility that the Legislative Delegation will be voting tomorrow on a bill concerning the transition of the administration of the Port from the Port Authority to the County and that the City may want to take action on a position to be presented. Mr. Flatley mentioned the many meetings that staff has attended regarding this issue and that Dania should not be impacted by any major changes with the } Port as Dania and Fort transition. The problem relates more with Hollywood and the Lauderdale are basically in agreement with the Port and the County. i Will Allen, Growth Management Director, advised that the version of the bill being presented by Representative Geller, who is the head of the Legislative Delegation, does not impose any real changes to Dania.
