HomeMy WebLinkAboutNULL (513) r MINUTES i DANIA CITY COMMISSION WORKSHOP MEETING OCTOBER 19, 1993 ROLL CALL: Present: Mayor: Bobbie Grace Commissioners: John Bertino Bill Hyde Albert Jones City Manager: Robert Flatley i City Attorney: Frank Adler City Clerk: Wanda Mullikin Absent: Vice Mayor: Bob Mikes (excused) Vice Mayor Mikes was excused from this meeting. 1. Chief Farley advised that BSO is now enforcing Dania's Ordinance regarding the restriction of refrigerator trucks making deliveries to shopping centers based on a recent l review by their legal department. Chief Farley advised that the majority of violations are enforced and that his department's first priority is always the emergency issues. He said that better enforcement of City Ordinances would be adhered to in the future. Commissioner Jones suggested that there is a need for better visibility of patrol officer in some sections of the City. Chief Farley advised that deputies are now assigned certain zones in the : City so they will be more familiar with the area they patrol and to make law enforcement recommendations for their zone. Further discussion followed on parking problems in the City and refrigerator trucks making deliveries at the Publix Shopping Center. Chief Farley brought up the possibility of using one of the McCutcheon properties, currently under the protection of the Marshall's office, for a resource center and sub-station in the community. He asked for a waiver on the water deposit and utilities cost since the facility is WORKSHOP MEETING 1 OCTOBER 19, 1993 r going to be used for the community. Commissioner Bertino suggested that the City use the water deposit already on file for BSO for this property. Chief Farley said that he would distribute copies to the Commission of the geographical boundary assignments and zone profiles. Chief Farley updated the Commission on the mobile unit being ready for use and shift schedules. ITEM 4 WAS HEARD AFTER ITEM 1 ' ITEM 2 WAS HEARD AFTER ITEM 3 j 2. City Manager Flatley mentioned that interest rates are very desirable and available to the City of Dania for financing the pier through the Florida League of Cities. Chris Youmans, William R. Hough & Company, presented information on the "A" rated 25 year bond proposal verses the "AAA" rated insured bonds and gave general cost information on purchasing an insurance policy for the bonds. Marie Jabalee, Finance Director, advised Mr. Youmans that the existing bond is secured by the first pledge of sales tax. j Mr. Flatley said that the fishing concession and restaurant at the pier should generate approximately $136,000 a year to cover the debt service so that tax payers will not be impacted. He mentioned that the Deerfield Pier estimates $200,000 and the Pompano Pier = estimates S260,000 at year and that the proposed pier restaurant should meet this projection. Mr. Flatley advised that the life span of the pier is between 40 to 50 years and the bond financing is for 25 years. Staff will select three finalists on Friday from five proposals submitted so that the Commission can conduct interviews on November 2. I . Marie Jabalee, Finance Director, advised the Commission that a proposal was submitted to refinance the existing $750,000 bond to a fixed 5.25% rate for 10 years. The current program is fixed at 5.75% for five years and variable for the last five years. Marie asked Mr. Youmans to include the fixed rate option in the bond issue when he brings back his recommendation on the "AAA" verses the "A" rated bonds. City Manager Flatley said the County is going to have Pete Marwick conduct a study on whether or not to buyout the Melaleuca Gardens area. The study should be completed by December 1. Citizens should be notified of the options available to them and a survey should be conducted to determine who wants to remain and who wants to be bought out in the Melaleuca area. He recommended to hold an ISIS noise demonstration at City Hall on the noise impact to the Melaleuca Gardens area and to have an opportunity to respond to questions from the public. WORKSHOP MEETING 2 OCTOBER 19, 1993 f _ i Ed Curtis, Esq. advised that it should cost between 54,000 to $4,500 to rent the 1SIS equipment. The equipment would have to he set up and an operator will have to pre-program approximately ten points for the Melaleuca Gardens area. Fie felt that it would be beneficial for Mr. Young, Environmental Attorney, to attend the demonstration and that his costs are included in the estimation. The noise demonstration will include four commercial type aircraft and should cover the entire range of single event contours affecting the Melaleuca Gardens area. Discussion followed on a study that is needed to justify airport use of lands for funding purposes and a joint Commission meeting to be scheduled with the County prior to i December 1. Jay Field, Chairperson for the Airport Advisory Board, encouraged the Commission to address impacts placed on the Ravenswood area with the same consideration as the Melaleuca + Gardens area. He reminded the Commission that there are no guarantees that the FAA will I 1 adhere to restrictions placed on runway operations in the Interlocal Agreement with the County. Ed Curtis felt that the restrictions arc enforceable because the runway restrictions arc going to be tied to the funding process for the project. Mr. Field thought that the agreement should include provisions to allow Ravenswood residents to vote on whether to remain or be bought out in the event of property condemnation. 1 The Commission generally agreed that noise demonstrations be conducted on all of the 1 impacted areas at the I.T. Earl Burkstein, Attorney for Seacoast Sanitation, mentioned the intent by his client to pursue a settlement agreement with the City to resolve the misunderstanding in the tipping fee that has been pending for quite sometime. He clarified that at the mitigation session Seacoast Sanitation agreed to pay $65,358.50 less the actual amount of money for costs and damages incurred by Seacoast figured at around $9,000. Mr. Burkstein said that Seacoast will pay the $56,000 at one time instead of over a three year period if the other pending matters can be settled. City Manager Flatley clarified that the City is not in a compromising position in this legal matter as there is documentation and taped recordings of the pre-bid conference indicating that the City proceeded correctly. r Mr. Burkstein mentioned Seacoast's interest to contract with the City in 1995 for garbage r pickup in the Griffin area when the IWS Contract expires. Wanda Mullikin, City Clerk, advised that the County extended their contract with IWS to 1996 and the City extended as well to conform to the expiration date on the Seacoast contract in 1996. The City can then bid for garbage service for both areas of the City at one time. ,I WORKSHOP MEETING 3 OCTOBER 19, 1993 r �. Ky Mr. Burkstein said that Seacoast has agreed to a S.40 per month per unit increase which is less Ivlanzella, Seacoast Sanitation, said he was not than what was in the original lawsuit. Lou 1i asking for a rue increase but rather a fair rate adjustment because Reuter Recycling increased their rue to $61.70 per ton from the S57.00 per ton quoted at the pre bid conference. Mr. C. i Burkstein stated that Seacoast's rate is still less than what the other bidders submitted. Mayor Grace clarified that the S65,358.50 was a penalty imposed on the City when Seacoast violated the terms of the contract and did not take the trash to the Reuter Plant. Seacoast would not be giving the City anything but rather the City would be recouping moneys for the shortfall imposed because of Seacoast. Mr. Burkstein confirmed that from this point forward Seacoast will bring all refuse collected in the City to the Reuter Plant. Commissioner Bertino questioned whether it is legal for Reuter to charge the City for i recycling services when they act as a transfer station because they send everything onto the Palm Beach County incinerator for less than what the City is charged. City Attorney Adler stated that all four cities agreed to the procedure for disposal of the trash by Reuter during the shut-down period and that Reuter is supposed to be separating the trash and hauling the residue to the County. City Manager Flatley advised that Seacoast submitted a low bid in Tamarac the same way that they did in Dania and that other bidders reviewed our records to try and find out how they bid so low. After about three or four months of negotiating back and forth they couldn't conic to contract with Tamarac. Tamarac had to toss out all the bids and rebid the service The second time around, Seacoast was the lowest bidder and the Tamarac City Commission tossed them aside and said they just couldn't come to an agreement. Mr. Flatley said that he would not want to lose the Seacoast bid but felt that Seacoast was well aware of the amount at the pre-bid conference and that the City is not in default. City Manager Flatley presented a letter from Steven Snyder, Aragon Group, advising that an exterior maintenance program is being planned for Seafair. The maintenance will include new awning canopies, painting and roof repairs after the hurricane season. The Commission followed with discussion of the possibility of the Broward County Aquarium being placed on this site. Commissioner Bertino requested City Attorney Adler to review the contract to see if there are any terms that would require Seafair to pursue business enterprises for the Seafair site.
