HomeMy WebLinkAboutO-1993-023�f z ORDINANCE NO. 23- 93 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING SECTION 18-292 OF ARTICLE III OF CfiA!'TER 18 OF TI IE CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA BY ADDING A NEW SUBPARAGRAPH (d) THERETO -1.0 PROVIDE THAT ELECTED PUBLIC OFFICIALS BECOME VESTED AND ELIGIBLE FOR RETIREMENT BENEFITS UPON THE COMPLETION OF EIGHT (8) YEARS OF CREDITED SERVICE AS AN ELECIED PUBI.IC OFFICIAL AND { COMPLYING WITH OTHER REQUIREMENTS OF SAID 1 ARTICLE II1 OF CHAPTER 18: AND, BY AMENDING SECTION 18-29.1(d)(2) OF SAID ARTICLE 111 TO PROVIDE CREDIT FOR RETIREMENT PURPOSES FOR YEARS SERVED AS AN ELECI-ED PUBLIC OFFICIAL WHO SUBSEQUENT TO SUCH SERVICE BECOMES A REGULAR EMPLOYEE OF THE CITY; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICI' HEREWITH BE IZE13EALED TO THE EXTENT OF SUCI1 CONFLICT'; AND PROVIDING FOR AN EFFEC"FIVE DATE. BE IT ORDAINED BY THE CITY CONIMISSION OF THE CITY OF DANIA, l FLORIDA: 4. Sectionl, That subsections (a) and (c) of Section 18-29.2 of Article III of Chapter ` 18 of the Code of Ordinances of the City of Dania, Florida he amended as follows: j Section 18-29.2. Retirement dates and benefits. (a) Nonnal retirement date. A member may retire on the first day of the month coincident with or next following that "! date on which such member attains age sixty (60) and ¢ completes ten (10)years of credited service; provided, however, l any member of the prior plan on the amended plan effective date who is age fifty-eight (58) or older on such date may retire at age sixty (60) or older regardless of his length of credited 1 1 � ; eqy 1. 4, r Y �i service. Commencing on April 8, 1980, each member's normal ` retirement date shall be the first day of the month coincident with or next following the later of the member's fifty-fifth birthday or the date he completes ten ( 10) years of credited service as an employee or eight (8) years of credited services as an elected public official. "Iles provision shall not apply to any member whose employment termination date precedes April 8, 1986. (c) carry retirement date. Section 2. That Section 18-29.1(d)(2) of Article III of Chapter 18 of the Code of :d Ordinances of the City of Dania, Florida, is hereby amended to read as follows: Section 18-29.1 Membership (d) Regarding prior credited service (2) For members of the prior plan as of the amended plan c 1 effective date who have nut made contributions since I+ first eligible for prior plan coverage, service credit will be allowed only for those years during which such employees made contributions. Provided, however, such employees and any other employees who did not make contributions during any prior year when eligible to do so shall be allowed the right or option of repurchasing or buying back those years for which no contributions were made. The amount which must be paid by any such employee for this purpose shall be equal to the amount which he would have contributed had he been covered by the prior plan since he was first eligible plus - interest on such amount at a rate equal to the plan's current actuarially assumed rate of investment return. 2 r I .1 Pavments must he made in full prior to the member's i retirement. Any such "buy backs" shall cause credited service to be granted from the employee's date of k;y employment. Such "buy hack" arrangements and conditions shall he prescribed by the board, acting on a ,1 F-ra uniform and nondiscriminatory basis. C 2639 North Monroe Street Tallahassee, Florida 32399.1560 Re: Actuarial Impact Statement for the City of Dania Retirement Plan for General Employees Dear Mr. Slavin: The enclosed proposed ordinance would amend the above referenced Plan by changing the vesting ! schedule from a ten year cliff to an eight year cliff for those participants holding an elected office and to offer a buy-back provision to members of the Plan who had previous service as elected officials. The attached tables set forth the actuarial impact of the proposed ordinance. An explanation of each I column in the tables is as follows: Column 1 - January 1, 1993 data has been adjusted to reflect a service buy-back that occurred after the valuation date. This buy-back provision is already included in the Plan. Column 2 - Same as column 1 and changing the vesting schedule from a ten year cliff to an eight year cliff for those participants holding an elected office. Column 3 - Same as column 1 and column 2 and offering a new buy-back provision to 4 Members of the Plan who had previous service as elected officials.
