HomeMy WebLinkAboutO-1993-025 PURL i ORDINANCE NO. 25- 93 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING THE DANIA COMPREHENSIVE PLAN REDESIGNATING APPROXIMATELY FOUR AND EIGHT-TENTH (4.8) ACRES OF LAND LOCATED ON THE EAST SIDE OF SE 5 AVENUE BETWEEN SE 7 AVENUE AND SE 10 AVENUE, AS MORE PARTICULARLY DESCRIBED AS ALL OF "AMENDED PLAT HOLLYWOOD BEACH PARK NO. 2", ACCORDING TO THE PLAT 1 THEREOF AS RECORDED IN PLAT BOOK 14, PAGE 51, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, ALSO KNOWN AS THE WEST ONE-HALF OF THE NORTHWEST ONE- QUARTER OF THE NORTHWEST ONE-QUARTER OF THE t SOUTHWEST ONE-QUARTER OF SECTION 2, TOWNSHIP 51 SOUTH, RANGE 42 EAST, BROWARD COUNTY, FLORIDA, PROVIDING FOR TRANSMITTAL TO THE BROWARD COUNTY PLANNING COUNCIL AND THE STATE OF FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS; PROVIDING FOR SEPARABILITY; PROVIDING THAT ALL ORDINANCES OR { , PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. 1 WHEREAS, the City of Dania, adopted the City of Dania Comprehensive Plan on April 11, 1989; and WHEREAS, the Planning and Zoning Board for the City of Dania has held duly advertised public hearings and voted to recommend approval of the land use amendment to the City Commission; and WHEREAS, the City Commission of the City of Dania has conducted a duly advertised public hearing on October 26, 1993 pursuant to Section 163.3184 (15) regarding adoption of the proposed land use plan amendment pertaining to the property described as follows: E ` ALL OF "AMENDED PLAT HOLLYWOOD BEACH PARK NO. 2", i- ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 14, PAGE 51, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, ALSO KNOWN AS THE WEST ONE-HALF OF THE NORTHWEST ONE-QUARTER OF THE NORTHWEST ONE-QUARTER 25-93 ORDINANCE NO. L (15 OF THE SOUTHWEST ONE-QUARTER OF SECTION 2, TOWNSHIP 51 SOUTH, RANGE 42 EAST, BROWARD COUNTY, FLORIDA, at which public comment was accepted, and the objections, recommendations for modifications and comments of Local, County, Regional and State Planning Agencies were considered; and WHEREAS, the City Commission of the City of Dania, Florida deems it in the best interest of the citizens of the City of Dania to adopt the amendment to the Dania I Comprehensive Plan pertaining to the property as herein described above, and NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance. Section 2. Approximately 4.8 acres of land located east of SE 5 Avenue between SE 7 Avenue and SE 10 Avenue more particularly described as follows: f ALL OF "AMENDED PLAT HOLLYWOOD BEACH PARK NO. 2", ACCORDING I TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 14, PAGE 51, OF t THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, ALSO KNOWN AS THE WEST ONE-HALF OF THE NORTHWEST ONE-QUARTER OF THE NORTHWEST ONE-QUARTER OF THE SOUTHWEST ONE-QUARTER OF SECTION 2, TOWNSHIP 51 SOUTH, RANGE 42 EAST, BROWARD COUNTY, FLORIDA, shall be redesignated from Low (1) Residential to Medium (16) Residential. Section 3. The City's land use plan map and certified comprehensive plan are hereby amended to include the amendment and redesignation described herein. Section 4. The City Clerk is directed to transmit this amendment to the Broward Planning Council with a request that the Broward Planning Council recertify the City of Dania i Land Use Plan. ORDINANCE NO. 25-93 _ s i i i Section 5. The City Clerk is hereby directed to transmit this amendment to the Department of Community Affairs pursuant to Florida Statutes, Chapter 163. Section 6 That all ordinances or parts of ordinances and all resolutions or parts of I I resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 7. If any section, subsection, sentence, clause, phrase or portion of this I ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this ordinance. Section 8. This ordinance shall become effective upon recertification of the City of Dania Comprehensive Plan by the Broward County Planning Council.
