CITY OF DANIA L Providing for . THE FURNISHING OF EMERGENCY MEDICAL SERVI_CES TO A PORTION OF BROWARD COUNTY FLORIDA i ' .. This is a Second Amendment to the above-titled Interlocal Agreement (the "Interlocal Agreement) , providing for the furnishing of emergency medical services to a portion of Broward County, Florida, between: BROWARD COUNTY, a political subdivision of the State of Florida, hereinafter referred to as "COUNTY" , by and f through its Board of County Commissioners, AND CITY OF DANIA, a municipal corporation organized and existing S under the laws of the State of Florida, hereinafter referred to as "CITY" , WHEREAS, in accordance with Chapter 171, Florida Statutes, as amended, the municipal boundaries of the CITY generally located north of Stirling Road and West of Ravenswood Road have been extended and enlarged through annexations, and will continue to be extended and enlarged, so as to include areas that were part of the unincorporated area of the COUNTY, which areas are identified on the map attached hereto and incorporated herein and will be collectively referred to as the "Dania Annexation Area" (or "Annexation Area") ; and WHEREAS, under the Interlocal Agreement between the COUNTY and CITY, the furnishing of emergency medical services to the Dania Annexation Area, upon the taking effect of each annexation, would pass from the responsibility of the COUNTY to the responsibility of the CITY; and WHEREAS, the COUNTY and CITY entered into an Amendment to Interlocal Agreement, dated January 2, 1990, believing it was in the best interest of both parties for the COUNTY to continue to provide emergency medical services to the Dania Annexation Area; and LM Y^ both parties to assure that interagency communications " are being handled accurately. 6. Except as amended herein, all terms and conditions of the Interlocal Agreement shall remain in full force and ; . ; effect. 7 . This Second Amendment to Interlocal Agreement shall be executed in four counterparts, each of which shall be deemed to be a duplication of the original. EICHEN L_ Assistant County Attorney -4- . 4 WHEREAS, the COUNTY and CITY now agree that it is in the best interest of both parties that the Amendment to Interlocal Agreement providing for the furnishing by COUNTY of emergency medical services to the Dania Annexation Area, dated January 2, 1990, shall expire and stand repealed as of the date of execution of this Second Amendment to Interlocal Agreement by the COUNTY and CITY; J and �! WHEREAS, the COUNTY and CITY agree that when the COUNTY'S and the CITY ' S communication systems are operational and functioning properly, the systems will be evaluated by both the COUNTY and the CITY to assure that interagency communications are being handled accurately; NOW, THEREFORE, In consideration of the mutual terms and conditions, pr omises, covenants and payments hereinafter set forth herein, the COUNTY and CITY agree to amend the Interlocal Agreement as follows: 1. That certain Amendment to Interlocal Agreement between Broward County and City of Dania providing for the furnishing of emergency medical services to a portion of Broward County, Florida ("the Dania Annexation Area") , dated January 2 , 1990, shall expire and stand repealed as of the date of execution of this Second Amendment to Interlocal Agreement by both parties. 2 . Attached hereto as Exhibit "A" and made a part of this Second Amendment and of the Interlocal Agreement itself, is a map identifying the Dania Annexation Area. 3 . For the purpose of calculating payments and compensation j under Section 3 . 8 of the Interlocal Agreement, the i population of the Dania Annexation Area shall be included in the population count for the CITY, but shall not be included in the population count for the unincorporated area of the COUNTY. 4 . The Dania Annexation Area as shown on the map attached hereto as Exhibit "A" shall be amended from time to time f as additional parcels are annexed into the CITY. The CITY 'S Fire Chief shall provide written notice to the _ COUNTY'S Director of Emergency Services of all such additional areas. Upon receipt of such notice, such additional areas shall automatically become part of the -r Dania Annexation Area hereunder and shall be covered by the terms of this Second Amendment to Interlocal Agreement. 5.
